NEW SEWAGE PUMPING EQUIPMENT

FOR BATTLE RUN CAMPGROUND LIFT STATION

AT SUMMERSVILLE LAKE, SUMMERSVILLE, WV

1.0 GENERAL

The contractor shall provide all necessary equipment for a complete replacement of the mechanical and electrical equipment in the existing Sewage Lift Station at the Battle Run Campground and Day Use Area at Summersville Lake, Summersville, WV. This requirement is for supplies and materials only. Major items to be furnished shall consist of two (2) submersible non-clog pumps and mounting bases, stainless steel guide rails, one (1) duplex pump control panel, four (4) float switches, piping, and related accessories to make a fully operational system. Available power at the site is 120/240 VAC, 3-phase, 4-wire, 60 Hertz, open delta.

Control Panel must be able to accept emergency power from a generator with safety interlock.

2.0 MANUFACTURER EXPERIENCE

The offeror shall be (or represent) a company experienced in the design and manufacture of wastewater pumping systems. The manufacturer shall have a minimum of ten years’ experience in the design and manufacturing of submersible sewage pumps and control panels of similar size and shall have a minimum of twenty-five (25) successful installations. The offeror shall submit detailed installation and Operations & Maintenance (O&M) instructions to the Contracting Officer. The Offeror shall also submit evidence that the local supplier has spare parts, equipment repair ability, and experienced service personnel.

3.0 PUMPS

The Offeror shall furnish two (2) submersible non-clog wastewater pumps. The pumps shall be supplied with a mating cast iron 3-inch discharge connection (mounting base) and be capable of delivering 125 U.S. GPM at a total dynamic head of 70 feet. An additional point on the same curve shall be 200 U.S. GPM at a total dynamic head of 47 feet. Shut-off head shall be 86 feet (minimum). The motor shall be an integral part of the unit. The motor shall be 10.73 HP connected for operation on a 230 volts, 3 phase, 60 hertz electrical supply service. The pump shall be supplied with a cast iron guide rail base fitted with a 3 inch discharge elbow. Each pump shall be fitted with 15-feet of Stainless Steel Lifting Chain. The working load of the lifting chain shall be a minimum of 50% greater than the pump weight. Each pump motor shall be equipped with 30 feet of power and control cable(s) sized in accordance with NEC standards. The pumps and motor shall be a Sulzer ABS XFP81E-VX-81E or equal.

4.0 PUMP DESIGN

The pump(s) shall be capable of handling raw unscreened sewage, storm water, and other similar solids-laden fluids without clogging. The discharge base and elbow shall be manufactured for permanent installation in the wet well and to be connected to the discharge piping. In order to prevent binding or separation of the pump from the guide rail system, the pump(s) shall connect to the guide rail base automatically and firmly, guided by no more than one guide bar extending from the top of the station to the discharge connection. Cable guide systems shall not be considered acceptable. The sliding guide bracket shall be a separate part of the pumping unit, capable of being attached to standard ANSI or DIN pump flanges so that the base is interchangeable with other pumps and not limited to a specific pump. Nonstandard flange dimensions shall not be considered acceptable. There shall be no need for personnel to enter the wet well to remove or reinstall the pumps. Positive sealing of the pump to the discharge elbow shall be accomplished by a field replaceable Nitrile rubber profile gasket mechanically held in place between the pump and the sliding guide bracket.

Metal to metal contact between the pump and discharge elbow shall not be considered acceptable. No portion of the pump shall bear directly on the floor of the sump. The pump with its appurtenances and cable shall be capable of continuous submergence to a depth of 65 feet.

5.0 PUMP CONSTRUCTION

Major pump components shall be of gray cast iron, ASTM A-48, Class 40, with smooth surfaces devoid of porosity or other irregularities. All exposed nuts and bolts shall be AISI type 316 stainless steel construction.

All metal surfaces coming into contact with the pumped media (other than the stainless steel components) shall be protected by a factory applied spray coating of acrylic dispersion zinc phosphate primer with a high solids two part epoxy paint finish on the exterior of the pump.

Sealing design for the pump/motor assembly shall incorporate metal to metal contact between machined surfaces. Critical mating surfaces where a watertight seal is required shall be machined and fitted with Nitrile or Viton rubber O-rings. Sealing will be the result of controlled compression of rubber O-rings in two planes and O-ring contact of four sides without requiring a specific torque limit. Rectangular cross sectioned gaskets requiring specific torque limits to achieve compression shall not be considered adequate or equal. No secondary sealing compounds shall be used.

Impeller: The impeller shall be of gray cast iron, ASTM A-48, Class 40 and shall be of the vortex, non-clogging dynamically balanced capable of passing a minimum of 3-1/8” diameter spherical solids. The impeller shall have a slip fit into the motor shaft and drive key, and shall be fastened to the shaft by a stainless steel bolt which is mechanically prevented from loosening by a positively engaged ratcheting washer assembly.

Self-Cleaning Wear Plate: The pump shall be equipped with a self-cleaning wear plate constructed from gray cast iron, ASTM A-48, Class 40. The wear plate shall be mounted to the volute with four stainless steel/brass adjusting screws to permit close tolerance adjustment between the wear plate and impeller for maximum pump efficiency. The wear plate shall be easily adjustable, without requiring disassembly of the pump. The wear plate shall be designed with a wave shaped inlet and an outward spiral V-shaped groove on the side facing the impeller, to shred and force stringy solids outward from the impeller and through the pump discharge. The use of non-adjustable wear rings shall not be considered equal.

Pump Volute: The pump volute shall be single piece gray cast iron, ASTM A48, Class 40, non-concentric design with centerline discharge. Passages shall be smooth and large enough to pass any solids which may enter the impeller. Minimum discharge size shall be as specified. The discharge flange design shall permit attachment to standard ANSI or DIN flanges/appurtenances.

Rotating Assembly: The rotating assembly (impeller, shaft and rotor) shall be dynamically balanced such that undue vibration or other unsatisfactory characteristics will not result when the pump is in operation.

Shaft: The pump shaft and motor shaft shall be an integral unit. Each shaft shall be of 420 stainless steel material and adequately designed to meet the maximum torque required at any normal start-up condition or operating point in the system. Maximum deflection shall not exceed .002" at the lower seal. Each pump shaft shall have a polished finish and have accurately machined shoulders to accommodate bearings, seals and impeller. Carbon steel or chrome plated shafts shall not be considered adequate or equal.

Mechanical Seals: Each pump shall be equipped with a tandem mechanical shaft seal system consisting of two totally independent seal assemblies. The seals shall operate in a lubricant reservoir that hydro-dynamically lubricates the lapped seal faces at a constant rate. The lower, primary seal unit, located between the pump and the lubricant chamber, shall contain one stationary industrial duty silicon-carbide seal ring and one rotating industrial duty silicon-carbide seal ring. The upper, secondary seal unit, located between the lubricant chamber and motor housing, shall contain one stationary carbon seal ring and one rotating seal ring made from corrosion resistant Cr-steel. Each seal interface shall be held in contact by its own spring system.

The seals shall not require routine maintenance, or adjustment, and shall not be dependent on the direction of rotation for proper sealing. Each pump shall be provided with a lubricant chamber for the shaft sealing system which shall provide superior heat transfer and maximum seal cooling. The lubricant chamber shall be designed to prevent overfilling, and to provide lubricant expansion capacity. The drain and inspection plug shall have a positive anti-leak seal, and shall be easily accessible from the outside of the pump. The seal system shall not rely upon the pumped media for lubrication and shall not be damaged when the pump is run dry. The following seal types shall not be considered acceptable or equal: Seals of proprietary design, or seals manufactured by other than major independent seal manufacturing companies. Seals requiring set screws, pins, or other mechanical locking devices to hold the seal in place, conventional double mechanical seals containing either a common single or double spring acting between the upper and lower seal faces, cartridge type systems, any system requiring a pressure differential to seat the seal and ensure sealing.

Bearings: Each pump shaft shall rotate on permanently lubricated, greased bearings. The upper bearing shall be a deep grooved ball bearing and the lower bearings shall be heavy duty double row angular contact ball bearing. Bearings shall be of sufficient size and properly spaced to transfer all radial and axial loads to the pump housing and minimize shaft deflection. B-10 bearing life shall be a minimum of 50,000 hours at Best Efficiency Point (BEP).

6.0 PUMP MOTOR

The motor housing shall be gray cast iron, ASTM A48 Class 40 and the motor shall be of the squirrel-cage induction shell type design, housed in an air filled, water tight chamber (NEMA B type) and shall be capable of continuous submerged operation underwater to a depth of 65 feet. The stator windings and stator leads shall be insulated with moisture resistant Class F insulation rated for 155°C (311°F). The stator shall be heat-shrink fitted into the stator housing. The use of bolts, pins or other fastening devices requiring penetration of the stator housing is unacceptable. The motor shall be designed for continuous duty handling pumped media of 40°C (104°F) and capable of handling up to 12 evenly spaced starts per hour.

The service factor (as defined by NEMA) shall be a minimum of 1.10. The motor shall have a voltage tolerance of +/- 10% from nominal. A performance chart shall be provided with the submittal showing curves for torque, current, power factor, input kW, output HP and efficiency. This chart shall also include data on starting and no-load characteristics. The rotor bars and short circuit rings shall be made of cast aluminum. The motor shall be designed for continuous duty while completely submerged.

Cooling System: Each unit shall be able to be provided with an adequately designed cooling system. The cooling jacket shall surround the stator housing, thereby providing heat dissipation of the motor. Impeller back vanes shall provide the necessary circulation the pumped media through the cooling jacket. The impeller and back plate interface shall incorporate dimensional tolerances designed to prevent damaging particles from entering the cooling jacket. In addition, the back of the impeller shall incorporate a cutter design which ensures that stringy or fibrous material cannot enter the cooling jacket. The cooling jacket shall be a non-clog design by virtue of these features, and clean out ports on the cooling jacket shall not be required.

Thermal Protection: Each phase of the motor shall contain a bi-metallic temperature monitor in the upper portion of the stator windings. These thermal switches shall be connected in series and set to open at 140°C +/- 5°C. They shall be connected to the control panel, and used in conjunction with, and supplemental, to external motor overload protection.

Seal Failure Early Warning System: An electrical probe shall be provided in the oil chamber for detecting the presence of water in the oil chamber. A solid-state device mounted in the pump control panel or in a separate enclosure shall send a low voltage, low amperage signal to the probe. If water enters the oil chamber, the probe shall signal the solid state relay in the control panel. The relay shall then energize a warning light on the control panel and/or cause the pump to be shut down (selectable in control panel).

Float switches, dual probes, or any other monitoring devices located in the stator housing are not considered to be early warning systems, and shall not be considered equal.

Power Cables: The power cables shall be sized according to NEC and CSA standards and shall be of sufficient length to reach the junction box without requiring splices. The outer jacket of the cable shall be oil resistant chloroprene rubber, and shall be capable of continuous submerged operation underwater to a depth of 65 feet.

Cable Entry/Junction Chamber: The cable entry design shall not require specific torque requirements to insure a watertight seal. The cable entry shall consist of a cylindrical elastomer grommet, flanked by stainless steel washers. A cable cap incorporating a strain relief shall mount to the cable entry boss compressing the grommet ID to the cable while the grommet OD seals against the bore of the cable entry.

The entry as part of the motor shall be FM approved for use in NEC Class I, Division I, Groups C & D hazardous locations. The junction chamber with terminal board shall fit to the cable entry boss. The junction chamber shall be equipped with a removable cover allowing for cable removal or voltage change without opening the motor. The junction chamber shall be sealed from the motor by means of a sealing gland.

7.0 DUPLEX CONTROL PANEL

A. Available power at the site is 120/240 VAC, 3-phase, 4-wire, 60 Hertz, open delta. All components and wiring shall conform to the 2017 NFPA 70 National Electric Code.

B. All control elements shall be housed in a NEMA 4X Stainless Steel door-in-door enclosure. The enclosure shall be fully gasketed. A combination motor starter and thermal magnetic circuit breaker shall be provided for each pump. The unit shall have instantaneous trip magnetic over-current protection.

C. The control circuit shall be 115 volts. The control circuit shall be connected through the heat sensing switches in the pump and shall disconnect the control circuit in case of a high temperature condition in the pump motor. A HP rated contactor for each pump shall be provided. A seal failure warning light shall be mounted on the dead front door for each pump.

D. “Hand-Off-Auto” switches and runtime meters shall be provided for each pump.

E. An alternator relay shall be supplied to alternate pumps on each successive cycle. A lag float switch shall be used to start both pumps if the inflow is greater than one pump can handle and shall also start the second pump in case the operating pump fails.

F. The power service at this location has a flicker requirement, therefore, the control panel shall have a provision, or delay circuit, which will not let both pumps start simultaneously. This provision shall cover the following scenarios: A) after a power failure when both the lead and lag floats are actuated, or B) if both hand switches are turned to “Hand” (run) simultaneously.

G. Lightning/surge protection shall be provided for the control circuits. A sufficient size condensate heater shall be provided for the entire control panel.

H. A terminal strip shall be supplied to make all power and control connections for the pump. All terminals shall be marked for easy identification. A ground terminal strip shall also be provided.

I. An emergency power plug (male with weatherproof cap) shall be provided on the exterior of the control panel. Plug shall match the existing receptacle (female) for the emergency generator at the project.

J. A high level alarm light shall be mounted on the top of the control cabinet. The light shall be enclosed in a red polycarbonate enclosure. The light shall be activated by the high level alarm float installed in the pump station.

K. A 120-volt Ground Fault Circuit Interrupter (GFCI) duplex outlet shall be provided within the control panel.

L. Quick Disconnect Features. The control panel will be located within Summerville’s flood control pool, and subsequently, will need to incorporate provisions for rapid disconnection and removal when flooding is anticipated. This provision affects mounting and Wiring connections.

1. Mounting: Provisions shall be provided for quick and easy removal of the control panel from its mounting stand. Sufficient hardware shall be provided such that when installed, the panel is securely mounted and weatherproof (high winds, etc.). All quick mounting hardware shall be stainless steel and compatible with the control panel enclosure material to prevent galvanic corrosion. The supplier shall propose a mounting system for approval during the submittal process

2. Wiring Connections: All wiring to the control panel for power, emergency power, control devices, and equipment loads shall be made with a receptacle/plug type setup. All connections providing power (normally energized) shall be the receptacle (female) type. All connections receiving power (load side) shall be of the plug (male) type. Receptacle/plug connections shall be configured on the panel for weather resistance. Oversizing of the control panel enclosure to accommodate receptacles may be required. Plugs for pumps and floats shall not be attached to the leads from the pumps or floats as they will be routed through existing conduits that penetrate the wet well. These plugs shall just be provided and the Government will attach them in the field.

8.0 FLOAT SWITCHES

Four (4) mercury float switches shall be provided for operation of the duplex pump station and high level alarm light. Each float shall contain thirty (30) feet of SJOW-A type cable. The floats shall be single pole, heavy duty mercury switches, epoxy encapsulated in a non-corrosive thick-walled ABS plastic float. Each float shall also contain a weight located inside the ABS float to prevent the float from remaining on the sewage surface level once the mercury switch is activated, preventing the float from accumulating a grease build-up.

9.0 PUMP DISCHARGE PIPING

The replacement pumps are for an existing lift station that has four (4”) ductile iron piping. This contract shall include two flanged 3” ductile iron pipe spools and two flanged 4” x 3” ductile iron reducers to replace the vertical piping from the pump bases to the existing 90° elbows near the top of the wet well. The reducers will attach directly to the elbows and the spools will be installed between the reducer and the pump base.

Gaskets, bolts, nuts, and washers shall be provided for each flanged connection. The pipe spools will be no longer than 10’-0” in length for the purposes of bidding; however, THE GOVERNMENT WILL PROVIDE

THE EXACT DIMENSIONS OF THE PIPE SPOOLS AFTER THE PUMP BASES AND REDUCERS

ARE INSTALLED. The pipe spools will then be fabricated and shall be supplied to the Government within two weeks.

Ductile iron pipe spools shall be fabricated from Class 53 thickness pipe in accordance to ANSI/AWWA C115/A21.15 and ANSI/AWWA C110/121.10 requirements. Flanges shall be drilled for ANSI Class 125# and shall be faced prior to shipment.

Fittings shall be flanged of ductile iron in accordance with ANSI/AWWA C110 requirements, and shall be rated for a maximum water pressure of 200 psi. Flanges shall be drilled for ANSI Class 125#.

10.0 SUBMITTALS

The contractor shall furnish three (3) Hardcopy sets and one digital copy (on CD/DVD) of all required submittals. The submittals shall clearly specify the materials of construction, equipment compatibility, and shop drawings for each unique item being supplied. The Government shall approve the submittals before any items are manufactured or delivered. The contractor shall provide the following submittals:

11.0 DELIVERY

Delivery shall be included in the cost of the materials provided. The new sewage pumping equipment shall be delivered to:

The facility is located at the following coordinates: 38° 13’ 19.54” N, 80° 54’ 28.26” W. Driving Directions can be provided.

Contractor shall make contact with Summersville Lake, 3 business days prior to delivery.

Business Hours: 0730-1600 Eastern Time Monday through Friday. Work may continue outside these times with permission from the onsite government representative. All work shall be performed during daylight hours. Delay of work may occur during excessive rainfall or wet periods due to access to the site.

Federal Holidays: When one of the designated holidays falls on a Sunday the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work that interferes with other ongoing functions at the project shall be scheduled around normal business hours to be approved by Project Manager. Work shall be scheduled around the above listed Federal holidays unless approved in advance.

Ten Federal holidays observed are as follows:

New Years Day (January 1st) Martin Luther King Day (3rd Monday in January) President’s Day (3rd Monday in February) Memorial Day (Last Monday in May) Independence Day Labor Day (1st Monday in September) Columbus Day (2nd Monday in October) Veterans Day (November 11th) Thanksgiving Day (4th Thursday in November) Christmas Day (December 25th)

Access to Work Location: Access to the work location shall be through the main road of the office.

Contractor and Government Equipment and Supplies: The contractor shall furnish all personnel, equipment, transportation, disposal, supplies and materials to perform the work. No government equipment or supplies shall be used for this project.

12.0 SYSTEM START-UP AND WARRANTY

Following installation of the above equipment by the Owner, a certified factory trained manufacturer's representative shall inspect the installation and assist in starting up the equipment for a period of no less than eight (8) hours. Manufacturer's "Start-up Reports" shall be completed by the representative and approved by the Owner. The manufacturer shall warrant the installation for a period of no less than one (1) year from the date of start-up. The warranty shall cover defects in pumps and controls.

13.0 MINIMUM SAFETY REQUIREMENTS

The Minimum Personal Protective equipment required for anyone entering upon Government property shall be long pants, safety toe shoes/boots, shirts with minimum 4 inch sleeves, reflective safety vest, hard hat, safety eyewear, and hearing protection as needed. Additional Personal Protective Equipment may be needed and should be determined using an Activity Hazard Analysis. All Personal Protective Equipment shall be in compliance with the U.S. Army Corps of Engineers Safety & Health Requirements Manual EM 385-1-1 as currently revised.

14.0 SECURITY REQUIREMENTS

All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities (i.e. flood control dams, locks and dams, etc.) shall receive authorization to be on our facilities based upon a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD 12). The Huntington District Security Management Office shall submit contractor(s) information in order to complete the background investigation and make a recommendation to the Contracting Office of an employee’s suitability for work on Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results provided by the Huntington District Security Management Office of the background investigation. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed a review of such items and determined they can be released.

Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or around all District facilities. The Contractor must also provide the following: (1) Name of the Contract Specialist with whom he/she is working, (2) Project Name, (3) Contract Number and (4) Task Order Number when applicable.

The documents listed below are required:

SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form). FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-258) may be obtained by Contracting Division by contacting the Huntington District Security Management office).

Contractor shall report any changes in personnel or at any time conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.

Following submission of paperwork, the Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, Security Management Office will make recommendations to the PCO or their Designated Representative. The Security Management Office cannot give approval due to unfavorable report(s). The Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise Contractor of the decision.

15.0 FOREIGN NATIONALS

The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters Staff to accomplish. All Foreign Nationals must comply with the following paragraph:

In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers’ contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States at least 10 business days (excluding Federal holidays) prior to the requested work start date. Such documentation shall include at least one of the following a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.

All foreign government Requests for Visit Authorizations to the Department of Army organizations must be submitted at least ten business days (excluding Federal holidays) prior to the requested start date of the visit due to attempting to support, accommodate and approve the high number of short-fused Requests for Visit Authorizations (RVAs) received into the Foreign Disclosure Office on a daily basis.

In order to assure forms are properly completed, and to minimize time delays, Contractor is encouraged to work closely with the Security Management Office. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.

Holiday Moratorium - The Department of Defense traditionally imposes a moratorium on Requests for Visit Authorization (RVA's) during the December and January timeframes each calendar year. Where it is possible, the Contractor should avoid scheduling visits unless they are mission essential during this timeframe. The DOD Foreign Visits System will be operational; however, Army foreign disclosure will only process RVA's designated as mission essential by the Contracting Officer. The only two exceptions to the 10 working day suspense requirement are (1) visits to the Army Secretariat and Army Staff, and (2) visits deemed mission essential or time sensitive by the U. S. Army. A waiver to the Office of the Deputy Chief of Staff, G-2 must be submitted to authorize the request.

Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

16.0 AT / OPSEC REQUIREMENTS

A. Access and General Protection/Security Policy and Procedures

All Contractor and all associated sub‐contractors employees shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or Security Office.

Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

B. Pre-screen Candidates using E-Verify Program

The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

52.204-16 COMMERCIAL AND GOVERNMENT ENTITY CODE REPORTING (JUL 2016)

(a) Definition. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity;

or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

(b) The Offeror shall enter its CAGE code in its offer with its name and address or otherwise include it prominently in its proposal. The CAGE code entered must be for that name and address. Enter ``CAGE'' before the number. The CAGE code is required prior to award.

(c) CAGE codes may be obtained via--

(1) Registration in the System for Award Management (SAM) at www.sam.gov. If the Offeror is located in the United States or its outlying areas and does not already have a CAGE code assigned, the DLA Commercial and Government Entity (CAGE) Branch will assign a CAGE code as a part of the SAM registration process. SAM registrants located outside the United States and its outlying areas shall obtain a NCAGE code prior to registration in SAM (see paragraph (c)(3) of this provision).

(2) The DLA Commercial and Government Entity (CAGE) Branch. If registration in SAM is not required for the subject procurement, and the offeror does not otherwise register in SAM, an offeror located in the United States or its outlying areas may request that a CAGE code be assigned by submitting a request at https://cage.dla.mil.

(3) The appropriate country codification bureau. Entities located outside the United States and its outlying areas may obtain an NCAGE code by contacting the Codification Bureau in the foreign entity's country if that country is a member of NATO or a sponsored nation. NCAGE codes may be obtained from the NSPA at https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx if the foreign entity's country is not a member of NATO or a sponsored nation. (e) When a CAGE Code is required for the immediate owner and/or the highest-level owner by 52.204-17 or 52.212-3(p), the Offeror shall obtain the respective CAGE Code from that entity to supply the CAGE Code to the Government.

(f) Do not delay submission of the offer pending receipt of a CAGE code.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations.
