Contract Award
D.1 The contract award will be made as a whole to the contractor offering the lowest price, after a determination of responsibility is made by the Contracting Officer and prices are determined to be fair and reasonable (see paragraph D.3). This means that low price will be the determining factor considered for award of this contract. “Offeror Quotes” as referred to in this solicitation shall include a completed Price Breakout Schedule as included in this solicitation.
D.2 Content. Offeror quotes and any supporting information shall be specific and complete in every detail and shall contain the information necessary to properly assess the Contractor's capability to perform the specified contract services, D.3 Quoted Prices. The completed Price Breakout Schedule will be reviewed for completeness and compatibility with the estimated price to perform the contract services. Quoted prices will be evaluated for price reasonableness. The Offeror’s price quote will also be evaluated for proportionality and balance. An Offerors’ price quote may be considered to have unbalanced pricing when it contains line item prices that are significantly over or understated when compared to the estimated cost or competitive pricing. An offerers’ quote may be rejected if the Contracting Officer determines that the lack of balanced pricing poses an unacceptable risk to the Government.
D.4 Overall Price Evaluations. The Government will evaluate quoted prices for award purposes by adding the Offerors’ total price for the base year, to the total prices for all option years. See FAR 52.217-5. Evaluation of pricing for option year periods, will not obligate the Government to exercise the option(s). All unit prices shall be inclusive of all costs associated with this contract. For example, there will be no additional payment for supervision, administration, equipment, supplies, profit or other items/services not included on the price breakout schedule.
D.5 Discounts. Prompt payment discounts will not be considered in the evaluation of quotes.
D.6 The Government intends to evaluate price quotes and award a contract without discussions with offerors. Therefore, the offeror's initial quote should contain the offeror's best terms.
D.7 A Government Representative may verify any information provided in the quote to better evaluate the Offerors’ ability to perform.
D.8 Simplified Acquisition procedures are being used per FAR Part 13 and Subpart 13.5.

DESCRIPTION/SPECIFICATIONS
SECTION C-1
General
C-1.1 PROJECT INFORMATION. The former West Virginia Ordnance Works (WVOW) is located on the east bank of the Ohio River in Mason County, West Virginia, approximately six miles north of the city of Point Pleasant which is approximately 55 miles northwest of Charleston and 41 miles northeast of Huntington. The DoD utilized the WVOW from 1942 to 1945 to produce trinitrotoluene (2,4,6-TNT) explosives from toluene, nitric acid, and sulfuric acid, with manufacturing ceasing in 1945. Explosives’ production contaminated the soil and groundwater surrounding the TNT manufacturing and process facilities, wastewater sewer lines, and wastewater holding and discharge holding areas. See the attached Figure 1 for site location and O&M Areas.
C-1.2 PROJECT PURPOSE. Remedial actions at Operable Units (OUs 1, 2 and 3) of the former WVOW included the installation of soil covers and Resource Conservation and Recovery Act (RCRA) soil caps over areas of contaminated soil. Remedial action at the Asbestos Landfill area included the installation of a soil cover over a dumpsite. The soil covers and RCRA caps serve as effective barriers between humans, wildlife, and the contaminated soil. These remedial actions were completed on lands currently managed by the West Virginia Division of Natural Resources as part of the Clifton F. McClintic Wildlife Management Area (MWMA).
Groundwater monitoring wells have also been installed to allow monitoring at the site.
Certain operational and maintenance (O&M) activities are required to maintain the integrity of the soil covers, RCRA caps, and groundwater monitoring wells. These activities include mowing, periodic soil cap repair (e.g. repair eroded areas, re-seed bare areas, etc.), warning sign replacement, ditch maintenance, fallen tree removal, well painting, entrance gate painting, and vegetation control.
Removed from this PWS, are those areas maintained in past contracts such as the former Quonset hut area, the Compost Building Area, Power Distribution Products (PDD) Building Area, and the OU11 Sellite Plant (8 acres). These areas are noted in Figures 3 and 8. Some monitoring wells have been closed, some new wells installed and some wells will no longer be maintained therefore the total wells for inspection and maintenance has changed from past contracts. There have also been additions to this contract that were not scoped in past contracts, this includes mowing/clearing the outfall drainage ditch at the YWR area, mowing the access road from the Burning Grounds to Pond 30, replacing warning signs and posts, and mowing/clearing four rock lined drainage ditches and underdrain at RWR area. See Figures 12c (sign),13c, 14, 14a, 15, 15a.
C-1.3 SCOPE OF WORK. The Contractor shall furnish all necessary management, personnel, materials, supplies, tools, equipment, fuel, and vehicles, except as otherwise provided herein, required to perform the operation and maintenance service at the West Virginia Ordnance Works project, as specified and in strict accordance with all Terms, Conditions, General, Specific and Technical Provisions, Drawings, Figures, Attachments, etc., contained herein or incorporated by reference. Award of a contract does not guarantee that the Government will renew additional Option years under the contract from the Contractor. The Government reserves the right to perform any portion of the services listed below.
Contractor's work and responsibility shall include, but shall not be limited to, all planning, programming, administration and management necessary to assure that all services provided are conducted in accordance with the contact and all applicable laws, regulations, codes, or directives. Contractor shall ensure that all work meets or exceeds critical reliability rates or tolerances specified or included in referenced documents. Contractor shall perform all related Contractor administrative services necessary to perform the work such as supply, procurement, quality control, Contractor financial control, mobilization/demobilization and maintenance of accurate and complete records and files.
It is emphasized that the work described in this contract is a necessary part of the Corps mission.
Much of the work described will be performed in areas open to the public for hunting and fishing. There are also a number of construction contractors that are working, sampling, and maintaining facilities that require access to wells and portions of the project accessed by roads and paths maintained under this SOW. Failure of a Contractor to perform required work, or to provide the work in the required specified time, or to inferior work could risk public health and safety for those working at the project or delay work by other contractors working at the site.
Therefore, it is the intent of the Government to ensure the required services are performed correctly, safely, timely and reliably for a fair and reasonable price. Because of the nature of the work the Government cannot "trade off" contractor non-performance for increased Government liability. Further, due to lack of Government personnel, the Government cannot "trade off" a Contractor's lack of Quality Control for increased Government Quality Assurance.
C-1.4. NEGOTIATION. The purpose of negotiation is to establish a fair and reasonable price for the job under consideration. The Government and Contractor will negotiate toward the most efficient method of work and the number of hours required. The most efficient method is that method of work which accomplishes the job safely, with high quality workmanship and at the lowest price. Once negotiated the Contractor must perform the job using the method of work and line items agreed upon during negotiations.
C-1.5 WORKING HOURS.
a. Normal Working Hours. Normal working hours, except as otherwise specified herein, shall be Sunday through Saturday, 6:00 a.m. to 9:00 p.m EST. Work that interferes with other ongoing functions at the project by the USACE or the McClintic Wildlife Management Area shall be scheduled around normal working hours, as specified by the Contracting Officer. Work may be conducted during federal holidays.
b. Inclement Weather Work. The Contractor shall maintain the schedule of services regardless of inclement weather except when severe conditions make it impracticable or dangerous to perform the work. The Contractor will be notified, by modification to the Contract, of any Contracting Officer determination to extend the performance period due to inclement weather such as disasters or severe storm damage.
C-1.6 CONTRACTOR SUBMITTALS. Unless otherwise specified, the Contractor shall submit the following information to the COR prior to the pre-work conference for this contract:
a. Abbreviated Accident Prevention Plan (AAPP) prior to Notice to Proceed. Activity Hazard
Analysis (AHA) (due prior to starting work). Reference USACE Safety Manual EM385-1-1, March 1, 2015.
b. Emergency Contacts. A prioritized list, including phone numbers, of those persons (generally Contractor Representatives) to call in case of emergencies.
c. Quality Control Plan (QCP) including name(s) of QC inspector(s).
d. Schedule of Activities (due prior to starting work).
e. Manufacturers information and Safety Data Sheets (where applicable) for the paint and primer used at wells and wire mesh used for culverts and herbicide spray to coat cut vegetation.
f. Contractor invoice(s).
g. Plan/Procedure for paint/primer repairs to wells and bollards (due prior to starting work).
Submittals shall be prepared using Microsoft Word®, Excel®, and/or Adobe Acrobat®. The Contractor shall submit drafts of the AAPP/AHA, Schedule of Activities, Emergency Contact List, QCP, and Procedure for paint/primer repairs within 20 calendar days after receipt of Award. The Contractor shall submit drafts of the Groundwater Monitoring and Extraction Well Inspection Report for review by the Government within 20 days after completion of all work.
Following reviews, the Contractor shall respond to review comments and submit the final plans/report for acceptance. Until the AAPP/AHA, Emergency Contract List, QCP and schedule of activities submittal documents have been accepted by the Government no site work may be performed.
The draft AAPP shall be submitted electronically and a hard copy by mail by the Contractor to the COR for review. Once all comments have been resolved to the Government’s satisfaction, the Contractor shall submit the final document with all comments/responses included as appendices. The final document shall include one hard copy and one electronic copy of each document on CD/DVD. Hard copy documents shall be in a three ring white binder with front and spine overlays with the Contract Number, the Site name, and the Year of the contract. Tabs utilized shall be one piece high quality tabs.
All submittals for this Contract shall be sent to the USACE Contract Management office, ATTN:
Shane Hall, 502 8th Street, Huntington, WV 25701 using USACE ENG FORM 4025-R, MAR
95. Any invoices sent to the wrong person or location will not be accepted.
C-1.7 SITE SPECIFIC ABBREVIATED ACCIDENT PREVENTION PLAN and ACTIVITY HAZARD ANALYSIS. The USACE assigns a high priority to safety of the public, its own employees and contract workers, regardless of the task involved. Contractor may use Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs) or Activity Hazard Analysis (AHA) for the purpose of risk assessment. Before beginning each work activity Contractor performing that work activity shall prepare an initial assessment (AHA/JSA/JHA) listing each job step, anticipated hazards, site conditions, equipment, materials, personnel and control measures to be implemented. A Risk Assessment Code (RAC) shall be assigned to each step assessing the level of risk remaining after implementation of controls. Once this process is complete, a RAC will be assigned to the activity as a whole (cannot be lower than the highest step RAC). Residual risk must be communicated to the proper authority for acceptance in order to proceed. It is the Contractor's responsibility to prepare the AHA/JSA/JHA. Analysis with RAC shall be accepted by the KO and discussed with all engaged in the activity including Contractor, subcontractor(s), and on-site government representative prior to commencement of work. Names of Competent Person(s) and Qualified Person(s) required for a particular activity (e.g., mowing, tree removal, fall protection, or other activities specified by OSHA and/or EM 385-1-1) shall be identified and included in the AHA/JSA/JHA and proof of their competency/qualification.
Work crews of two or more must have two people holding current qualifications in First Aid and CPR from the American Red Cross, American Heart Association or a licensed physician.
Training must include a hands-on element and the contractor must maintain an appropriate First Aid kit on site. Single individuals working alone must have current certification in First Aid as a minimum.

Use of controlled substances or consumption of beer or alcoholic beverages by Contractor employees is strictly prohibited. The Contractor expressly agrees to remove from the site any individual whose continued employment is deemed by the COR to be contrary to the public interest or inconsistent with the best interests of the U. S. Army Corps of Engineers; and, will not use such individual to perform duties or services under this contract.
The COR may require the Contractor to immediately remove from the work site any employee of the Contractor who is incompetent, or who endangers persons or property, or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform the work. Notification to the Contractor shall be made in person or by telephone promptly and shall be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor's obligation to perform all work required under this contract, and immediate replacement shall be made as required.
C-1.11 DAMAGE OR LOSS OF CONTRACTOR'S SUPPLIES AND PROPERTY. The Contractor is responsible for taking the action necessary to protect Contractor supplies, materials and equipment, and the personal property of Contractor employees from loss, damage or theft.
The Government assumes no responsibility for theft, damage, etc., of the above.

Such spills shall be reported to the COR immediately.
C-1.13 SUPERVISION. The Contractor shall personally supervise the work, or have a Contractor Representative at the project when work is in progress during work activities. The Contractor Representative(s) shall conduct overall management coordination and be the central point of contact with the Government for performance of all work under the contract. The
Contractor Representative(s) shall have full authority to contractually commit the Contractor for prompt action on all matters pertaining to administration of this contract, and shall be the on-site Contractor employee who is responsible for safety.
In addition to a Contractor Representative(s), the Contractor shall also appoint Quality Control Inspector(s) (QCI) who shall perform the Contractor's Quality Control Program. QCI's shall be responsible for implementing the Contractor's AAPP. All QCI'S shall have the authority to determine for the Contractor when work is ready for Government inspection and to make decisions for the Contractor on re-performance when necessary. The Contracting Officer and Government inspectors will deal directly with the QCIs or Contractor Representatives, for normal day-to-day administration of the contract provisions. The names of all individuals authorized to act on behalf of the Contractor as Contractor Representative(s) or QCI(s) shall be submitted in writing to the COR before work is performed (see Figure 17). The Contractor shall maintain and review with employees copies of contract work requirements, specifications, Activity Hazard Analysis, etc., at the work site areas which relate to each person's work responsibilities, to ensure employees comprehension of a job prior to initiating work.
C-1.14 CONTRACT DISCREPANCY REPORT (CDR). A CDR is a formal document used by the Government to process defects in services (see Figure 18). As initially issued to the Contractor, the CDR describes the discrepancy or problem. The CDR will be discussed with the Contractor or his representative when it is issued. The Contractor shall provide his written legible response on the CDR form within 24 hours of issuance. The Contractor's response must:
a. Identify the cause and corrective action taken, and
b. Identify Contractor action to prevent recurrence.
The COR will evaluate the Contractor's response and take appropriate action, which may include making necessary deductions. Upon finalization of the CDR, the Contractor and the COR must sign the form. The Contractor will be given a copy of the completed form. Should the Contractor not concur with any decision, etc., the Contractor may so state, in writing, and request a final decision by the Contracting Officer. The Contracting Officer monitors all CDRs issued, and CDRs are principle evidence used by the Contracting Officer in determining Government contract actions such as termination or decision not to exercise options.
Any time a CDR is issued, the Contractor or his authorized representative shall be available, in person, or telephone to the COR at the district office to discuss contract work items. If a CDR is issued, mutual effort will be made to resolve any and all problems identified to preclude their recurrence. Failure to provide appropriate Quality Control may result in issuance of a CDR and/or termination of the contract.
C-1.15 QUALITY CONTROL. The Contractor shall establish a quality control program to assure the requirements of the contract are provided as specified. This program must be approved by the KO prior to commencement of any work. One copy of the Contractor's quality control program shall be provided to the COR at least one week prior to the post-award conference. If changes to this program occur, updated copies shall be provided to the KO and COR.
The program shall include, but not be limited to the following:
1. An inspection system covering all the services stated in the contract specifications. It shall specify areas to be inspected on both a scheduled or unscheduled basis and the individuals who shall do the inspection. A method of identifying deficiencies in the quality of services performed before the level of performance is unacceptable.
2. A file of all inspections conducted by the Contractor and the corrective actions taken. This documentation shall be available for inspection by the COR upon request.
3. A method of ensuring that employees have full knowledge of work assignments and that appropriate expertise is utilized with each work assignment.
4. A method of coordinating worker activities with the COR , Contracting Officer and/or Inspector. A suggested format for the Contractor Quality Control Plan is contained as Figure 17. Failure to provide appropriate Quality Control may result in issuance of a CDR, and/or termination of the contract.
C-1.16 QUALITY ASSURANCE. The Government will monitor the Contractor's performance in each functional area under this contract and reserves the right to use whatever additional surveillance procedures are deemed appropriate. The Government will monitor the contract to ensure compliance using a Quality Assurance Surveillance Plan (QASP), but reserves the right to alter the plan at its own discretion. The QASP is included as Figure 22 for information purposes only and will not be made part of any resulting contract. As appropriate, calculation of deductions for certain deficiencies will be made using the contract clause entitled "Inspection of Services" located in Section E, in lieu of the payment analysis method described in the QASP.
The Contractor shall notify the technical point-of-contact located in Section C-1 General, Paragraph C-1.21 prior to beginning a mowing event. Following the completion of each mowing event, the Contractor shall notify the same USACE Technical POC. At the time of completion, the USACE Technical POC will conduct a post-work inspection to ensure that work requirements have been met. The Contractor may participate in this inspection. See Section C-1 General, Paragraph C-1.17 for Deficiencies.
C-1.17 DEFICIENCIES.
a. General. If the Contractor fails to perform, or if performance in any area is judged unsatisfactory by the COR, the Government will take corrective action. If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no cost to the Government. When the defect in services cannot be corrected by re-performance, or cannot be corrected in the specified time frame, the Contractor is required to respond to a CDR (See Paragraph C-1.14), and deductions will be determined in accordance with Contract Clause entitled "Inspection of Services" located in Section E and in accordance with the Governments QASP.
b. Mowing. Deficiencies for mowing operations are described in detail in Section C-2, Paragraph C-2.2.
c. Corrective Action-If deficiencies are identified through the Quality Assurance Program, the Government must take action to correct those deficiencies using one, or in some cases a combination of , the following:
1. Stop Unsafe Work. The Government will immediately stop work on that portion of the job affected by a safety hazard, until it is corrected.
2. Issue a Stop Work Order. If the KO determines the deficiency is serious, he/she can issue a Stop Work Order.
3. Re-performance by the Contractor. If time permits, the Contracting Officer may require the Contractor to re-perform the service at no cost to the Government.
4. Re-performance by the Government or another Contractor. If time or the contract does not permit re-performance by the Contractor, Government employees or another Contractor may re-perform the service. The actual cost to perform the corrective work will be deducted and/or billed to the Contractor. This action will be used for mowing services not completed within the mowing cycle, except in rare circumstances.
5. Reduced value Deduction. The Government may reduce the Contract price to reflect the reduced value of the services performed. This method is normally used when the work is not performed by the Contractor, Government or another contractor. The amount of the deduction is equal to the value of the service(s) not performed. As appropriate, calculation of deductions for certain deficiencies will be made using approved methods allowed by the contract clause entitled “Inspection of Services” and/or the payment analysis method described in the
QASP.
6. The COR and Contracting Officer may discuss corrective actions with the Contractor to prevent future occurrences.
C-1.18 SAFEGUARDING GOVERNMENT PROPERTY. The Contractor shall cooperate with Government personnel in safeguarding Government property. The Contractor shall be responsible for promptly reporting all acts of vandalism, larceny, or pilferage to Government property to the COR. During the time that the Contractor is on the property, if there are activities on the site not sanctioned by the Government (e.g. ongoing trash dumping, vandalism), abandoned vehicles, or observed damage caused by tampering or vandalism, the Contractor shall contact the USACE immediately as specified in Section C-1 General, Paragraph C-1.21.
