Section 00 00 00 - Procurement and Contracting Requirements

PROJECT DESCRIPTION

The Arlington National Cemetery Southern Expansion (ANCSE) is an approximately 60-acre expansion of Arlington National Cemetery (ANC). The expansion is being/will be executed under three separate construction projects: (1) Defense Access Road (DAR) and ANCSE Phase I; (2) ANCSE Phase II - South Parcel Operations Complex (Phase II); and (3) ANCSE Phase III - Cemetery Expansion (THIS SOLICITATION).

1) DAR/Phase I is currently under construction: Federal Highways Administration (FHWA) Eastern Federal Lands and Highways Division (EFLHD) is the lead design and construction agency. DAR is realigning roadways and utilities to maximize the contiguous land area available for cemetery expansion under Phase III (THIS SOLICITATION). The DAR contract includes applicable utility installations and rough grading to prepare the East Parcel for the start of construction of Phase IIIB as indicated in the graphic below.

2) The Phase II is currently under construction: USACE NAO is the lead design and construction agency. Phase II is comprised of an office building, maintenance facilities, laydown and storage space, a parking structure, and all supporting utilities in the parcel south of Columbia Pike which is being realigned under the DAR/Phase I contract. Phase II consists of Subphase IIA and IIB as indicated in blue font in the graphic below. Phase IIB includes applicable utility installations and rough grading to prepare the West Parcel for start of construction of Phase IIIA (THIS

SOLICITATION).

3) The Phase III Cemetery Expansion (THIS SOLICITATION) will provide more than 80,000 additional interment spaces including above ground cremated, in-ground cremated, in-ground traditional casketed, and in-ground crypts. A network of roadways, sidewalks, and pedestrian walkways will be constructed and tied into the existing system at ANC. New buildings include a visitor screening facility, public bathrooms, and an open-air committal shelter. To maintain the ANC character and status as a level III arboretum, extensive landscaping and horticulture plantings are included. The project involves substantial earthwork, extensive landscaping and installation of high-quality turf, and culturally significant structures with monumental decorative or commemorative stonework. The project includes integration of the existing Air Force Memorial, installation of pre-set concrete crypts, above-ground columbaria, ornamental security and boundary fencing, and a secure pedestrian access point. The Air Force Memorial is an existing structure within the construction zone that requires some demolition to merge the western and a portion of the northern memorial boundary with the cemetery expansion.

PHASE III SUB-PHASING

Phase III (THIS SOLICITATION) is currently being divided into three sub-phases indicated in ref font in the graphic above. The resulting contract will include all three subphases. Each sub-phase will have a separate NTP. A detailed sub-phasing plan is undergoing finalization and will require final approvals by the Virginia Department of Environmental Quality (DEQ). The Solicitation will be amended to include the final plans and specifications while the solicitation is pending and offerors are preparing their proposals. Offerors will be afforded an opportunity to revise their proposals after the amendment is issued.

The sub-phasing currently anticipated is as follows:

Three separate notices to proceed (NTP) will be issued for the Phase III project.

Phase IIIA and/or IIIB NTP may be issued at award of the contract, depending on the degree of completion of the DAR and Phase II contracts in the East and West Parcels, respectively.

NTP for Phase IIIA will be issued for work in the West Parcel. NTP for Phase IIIA will not be issued until the Phase IIB contractor has finished work in the West Parcel. The current estimation is NTP for Phase IIIA will be issued between April and July of 2026.

NTP for Phase IIIB will be issued for work in the East Parcel. NTP for Phase IIIB will not be issued until the DAR contractor has finished work in East Parcel. The current estimation is the NTP for Phase IIIB will be issued within three months of award of the contract.

NTP for Phase IIIC will be issued once Phase IIA and relocation of the existing Operations Complex are complete, which is currently targeted for March 2027.

PLANNED AMENDMENTS

The solicitation will be amended to incorporate the following elements:

1. Sub-Phasing: The upcoming amendment will include final sub-phasing drawings, revisions to specifications, and preliminary DEQ submission documents.

2. Air Force Memorial Driveway: The final condition for the Air Force Memorial Driveway will be amended into the solicitation.

3. Sheridan Gate: The initial solicitation will include the Sheridan Gate foundation and non-historic gate. The amendment will include plans and specifications to reconstruct and install the historic Sheridan Gate with an internal support structure.

The Government anticipates receipt and evaluation of non-price proposals pending issuance of the final planned amendment. Upon receipt of the amendment, offerors will be permitted to revise and re-submit proposals, if desired.

However, the Government does not anticipate the substance of the amendment will have a material impact on the preparation of the substance and content of the proposals responsive to Factor 1 through Factor 3 of the source selection evaluation criteria as defined herein.

SOLICITATION PROVISIONS

A. BASIS OF AWARD

It is intended that this Request for Proposal (RFP) will result in a Firm-Fixed-Price contract. The Contracting Officer will award to the responsible Offeror whose proposal conforms to all the terms and conditions of the solicitation and whose proposal is determined to represent the best overall value to the Government. The Government reserves the right to accept other than the lowest priced or the highest rated non-price offer or to reject all offers. The Government will not award a contract to an Offeror whose proposal contains a deficiency, as defined in FAR 15.001, unless corrected through discussions, should the Government decide to conduct discussions.

Furthermore, the Government will not make an award based on a proposal that received a limited or no confidence assessment in Factor 1 or less than an acceptable rating in Factor 2 or Factor 3.

The Government will conduct a Best-Value Trade-off of four (4) evaluation factors. The factors are as follows:

Non – Price Factors Factor 1 – Past Performance Factor 2 – Project Approach Factor 3 – Small Business Participation Plan

Factor 4 – Price

The relative order of importance of evaluation factors is Non-price Factors 1 and 2 are of equal importance to each other and each is more important than Factor 3. All non-price factors (1, 2, and 3) when combined will be approximately equal to price (Factor 4). Award will be made to the responsible Offeror whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

The Government will evaluate all prospective proposals received in accordance with the solicitation instructions and the evaluation criteria defined herein.

The Source Selection Authority (SSA) will select the source whose proposal offers the best value to the Government in accordance with the evaluation criteria and basis of award stated in the solicitation. If award is not made on initial offers, the Contracting Officer will determine the competitive range, authorize discussions with only those Offerors determined to be in the competitive range and document the decision through approval of the Competitive Range Decision Document (CRDD).

Upon completion of the evaluation of final proposal revisions submitted by the Offerors in the competitive range, or if award is made on initial offers, the SSA will select the offeror whose proposal offers the best value to the Government. This decision will be documented to include the rationale of any business judgements and trade-offs made or relied on and the benefits associated with additional costs in the Source Selection Decision Document

(SSDD).

Any deviation and/or exceptions to the contractual terms and conditions of the solicitation (e.g., standard terms and conditions) may result in a determination to reject a proposal.

Failure to submit all data in the format indicated in this solicitation may be cause for determining a proposal incomplete and, therefore, not considered for evaluation, and for subsequent award. Exceptions to the contractual terms and conditions of the solicitation (e.g., standard terms and conditions) may result in a determination to reject a proposal.

This RFP does not commit the Government to reimburse any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this solicitation. Note specifically that the offeror will not be participating in a sealed bid procurement process under this acquisition method and issuance of this RFP does not constitute an award commitment on the part of the Government.

INTENT TO AWARD WITHOUT DISCUSSIONS: Proposals must set forth full, accurate and complete information as required by the Request for Proposal (including attachments). The penalty for making false statements in the proposal is prescribed in 18 U.S.C. 1001. The Government intends to evaluate proposals and award without discussions, clarifications, or any contact concerning the proposals received; therefore, each initial proposal should be submitted on the most favorable terms from a price and technical standpoint. Offerors are responsible for including sufficient detail in their proposals, in a concise manner, to permit a complete and accurate evaluation.

However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary. Offerors should not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. If discussions are held, the Government may engage in a broad give and take with each Offeror in the competitive range, in accordance with FAR 15.306 (d).

B. EVALUATION APPROACH

All proposals shall be subject to evaluation by the Source Selection Team (SST). The Source Selection Authority (SSA) will ensure that the evaluation of all Factors has been conducted in accordance with the Solicitation, approved Source Selection Plan, and all applicable acquisition laws and regulations.

Factor 1 will be assigned a performance confidence assessment for Factor 1 - Past Performance by the Technical Evaluation Team (TET). Factor 2 will also be evaluated by the TET and will be assigned an adjectival rating in accordance with definitions for Factor 2. Factor 3 will be evaluated by the Small Business Evaluation Team (SBET) and will be assigned an adjectival rating in accordance with definitions for Factor 3. Factor 4 will be evaluated by the Price Evaluation Team (PET) in accordance with the paragraph titled “Volume III, SECTION A – Factor 4 – Price (Contract Line-Item Number (CLIN) Schedule)”. Proposals will be evaluated using Price Analysis techniques and will be evaluated for price fairness and reasonableness. Price will not be rated or scored.

The Government will evaluate and rate the proposals against the specified evaluation criteria in the solicitation requirements for each non-price evaluation factor. Proposals will not be compared at this time. After all proposals are evaluated and rated, the Government will compare the ratings and relative advantages of proposals against one another to determine which Offerors are the most highly qualified.

The Government will evaluate the proposals and rate the quality of each non-price evaluation.

1. Past Performance Factor 1. The Government will evaluate the Offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the solicitation.

a. Recency. The Government will evaluate the recency of a submitted project and may deem a more recently completed project more advantageous than an earlier completed project or a not fully completed project. It is the Offeror’s ultimate responsibility to clearly identify the percentage complete and date of completion for each project submitted. If the Government is unable to determine the percentage complete or a date of completion of a submitted project, the project may be considered not recent.

Please see “Volume I – Section B – Factor 1 – Past Performance” below for the definition of “Recency”.

b. Relevancy. The Government will next rate the relevancy of recent projects submitted in accordance with the definitions of “Very Relevant”, “Relevant”, “Somewhat Relevant”, and “Not Relevant” as presented below. The relevancy rating is not a separate proposal rating but is only used in developing overall past performance confidence assessment rating. Relevancy criteria can be found in “Volume I Section B” below. The past performance relevancy rating is as follows:

Past Performance Relevancy Ratings for Factor 1

Rating Definition

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The Government will next consider how well the Offeror performed on the submitted projects. The Government will consider the recency and relevancy of the information, source of the information, context of the data, and general trends in contractor performance. With respect to relevancy, past performance on projects with more relevance will typically be a stronger predicator of future success and have more influence on the past performance confidence assessment rating than past performance on projects of lesser relevance.

c. Past Performance will be expressed as a degree of confidence in the Offeror’s ability to successfully perform the contract. See Section IV for additional information regarding ratings. The rating system used for the performance confidence assessment is as follows:

Performance Confidence Assessments for Factor 1

Rating Definition

Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

2. Project Approach Factor 2. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. See Section IV for additional information regarding ratings. The combined Technical/Risk Definitions are as follows:

Project Approach /Risk Ratings for Factor 2

Adjectival Rating Definition

3. Small Business Participation Plan Factor 3. All offerors (both large and small businesses) will be evaluated on the level of proposed participation of small businesses in the performance of acquisition. See Section IV for additional information regarding ratings. The Small Business Participation Plan Factor rating definitions are as follows:

4. Price Factor 4. The contract will be Firm Fixed Price. The Government will evaluate price reasonableness for the fixed price effort.

5. Definitions.

Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.

e. Significant Weakness. A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.

f. Uncertainty. Any aspect of a non- price factor proposal for which the intent of the Offeror is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).

g. Clarification. Limited exchanges between the Government and Offerors that may occur when award without discussions is contemplated. See FAR 15.306(a)(1).

h. Adverse Past Performance. Past performance information that supports a less than satisfactory rating from sources where the information is from other than formal rating systems such as “PPIRS” or

“FAPPIS.”

i. Discussions. Exchanges between the Government and the Offerors that are undertaken with the intent of allowing the Offeror to revise its proposal.

VOLUME I - SECTION B - FACTOR 1 – PAST PERFORMANCE

Submission Requirements

Please read carefully to ensure all elements are addressed in your submission.

The Past Performance factor is two-fold. One aspect of this factor assesses the level of experience similar to that being contemplated by this contract, what the firm has done in the past; the second aspect addresses how well the Offeror performed recent, relevant projects from the owner’s/client’s perspective.

The offeror shall submit the following:

1. The Offeror shall submit a minimum of one (1) project and may submit up to a maximum of five (5) projects that best demonstrate the Offeror’s past performance on recent and relevant projects. These terms are defined as follows:

Recent. To be considered recent, a project must be 100% complete within 10 years preceding the date of the Solicitation plus calendar days (i.e., March xx, 2025) or a minimum of 75% complete by date of the issuance of the Solicitation plus 80 calendar days (i.e., March xx, 2025). The Government will evaluate the recency of a submitted project and may deem a more recently completed project more favorable than an earlier completed project or a not fully completed project. It is the Offeror’s ultimate responsibility to clearly identify percentage complete and date of completion for each project submitted. If the Government is unable to determine the date or percentage completion or a date of completion of a submitted project, the project may be considered not recent.

Relevant. The Government will evaluate Offerors’ Past Performance record to assess the extent to which it clearly demonstrates similar experience in accordance with the criteria established herein.

If the Government is unable to determine the nature or extent of experience based on a submitted project, the project may be considered not relevant. Offerors may not submit classified information in their proposals.

Projects that demonstrate the highest degree of similarity to the criteria established herein will be evaluated most favorably for relevancy.

Similar in Scope and Complexity:

Offerors shall provide projects demonstrating similarity in scope, size and complexity to this project, as defined in the elements below. A project need not demonstrate more than one element, but experience that demonstrates completion of projects involving more than one element may be deemed more advantageous. Proposals with multiple projects demonstrating combinations of elements may be deemed more advantageous.

The Government will evaluate the Offeror’s Past Performance to assess the extent to which it clearly demonstrates similar experience in the following respects (as defined more fully in the plans and specifications):
