The Project will be solicited as full and open procurement.

The Contracting Officer anticipates that the solicitation will include the following evaluation factors:

The relative order of importance of evaluation factors is Non-price Factors 1 and 2 are of equal importance to each other and each is more important than Factor 3. All non-price factors (1, 2, and 3) when combined will be approximately equal to price.

PROJECT LABOR AGREEMENT

• In accordance with EO 14063, Use of Project Labor Agreement for Federal Construction Projects, issued 4 Feb ‘22, mandates PLAs for large construction projects, with performance in the United States, with estimated contract cost of $35M

• What is a PLA?

o A pre-hire collective bargaining agreement unique to the construction industry negotiated between one or more construction unions and one or more construction employers (the Government does not sign, however, it would be incorporated into the contract) o Establishes terms and conditions of employment for a specific construction project, including:

Provisions that bind all contractors and subcontractors to the agreement;

No-strike, no-lockout clauses; and Grievance/arbitration procedures.

- USACE will neither negotiate nor become signatory to a PLA.

- The Solicitation will require all prospective offerors to submit a fully negotiated PLA with its price proposal offer.

PROJECT LABOR AGREEMENTS

The Solicitation will contain FAR 52.222-33 and the following language will be included:

Synopsis: “Offerors shall submit an offer subject to Project Labor Agreement (PLA) requirements in accordance with FAR 22.504, General requirements for project labor agreements. Any PLA reached pursuant to the PLA requirements in the solicitation does not change the terms of the contract or provide for any price adjustment by the Government.”

Solicitation, Supplementary Conditions Section 00 73 00: “Offerors shall submit a proposal subject to the Project Labor Agreement (PLA) requirement set forth in [insert section] of this solicitation. Any PLA reached pursuant to the PLA requirements in this solicitation does not change the terms of the contract or provide for any price adjustment by the Government. See FAR provision 52.222-33, Notice of Requirement for Project Labor Agreement, and FAR clause 52.222-34, Project Labor Agreement, for definitions and requirements pertaining to the use of a PLA on this contract.”

Submitted PLAs shall be reviewed for compliance with all statutes, regulations, Executive Orders, and agency/contract requirements as part of responsibility determination in accordance with FAR 9.1. Capacity Challenge

Without completion of Southern Expansion, ANC will reach 100% capacity in ~2041

The 2017 report outlined acceptable, and suitable options and/or actions

In 2016, Congress required the Army to report on the capacity at ANC and what might be done to preserve the cemetery.

• ~80,000 burial spaces over 38 acres

• Extends capacity to mid 2060s (current eligibility)

• Under design

• Added 27,782 burial spaces over 27 acres

• Extends capacity to 2040s (current eligibility)

• Completed 2018

ANC continues to be in high demand with the Nation’s large veteran population

Millennium Expansion

Southern Expansion

In 2018, ANC started a national dialogue, encouraging public input on the future of ANC. Two surveys yielded feedback from 250,000 respondents

National Dialogue & Revised Eligibility

The surveys showed strong support (96%) for keeping ANC open for our future war dead and MoH recipients and strong support (76%) for revising eligibility to ensure the cemetery remain active for future generations.

In the 2019 NDAA, Congress directed the SECARMY to revise eligibility to preserve

ANC as an active burial ground

“well into the future” (150 years)
