52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)

1. North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449).

2. The U.S. Army Corps of Engineer Norfolk District requests responses from qualified sources capable of providing: Scheduled and Demand Solid Waste Disposal Services at Craney Island Dredged Material Management Area in support of The Hampton Roads Drift Collection Program and Craney Island Facility Operations.

3. Period of Performance: Base year of services with four (4) additional one-year options periods.

4. Pricing shall be in accordance with Wage Decision: 2015-4341 (Rev 08) which was posted on www.wdol.gov on 1/10/2018.

5. This announcement will close at 2:00 P.M. Local Time on Tuesday, July 3, 2018. Contact Garland Cooper at 757-201-7748 or via email at garland.d.cooper@usace.army.mil Oral communications are not acceptable in response to this notice. All responsible sources may submit a quote which shall be considered by the agency. All quotes shall include solicitation number, price(s), a point of contact (name, email, and phone number), Tax ID, CAGE Code, DUNS, business size, and payment terms. Each response must clearly indicate the capability of the quoter to meet all specifications and requirements. Quoted prices must be valid for 30 days from date of receipt.

6. The basis for award will be made to the contractor whose quote is determined the Lowest Price Technically

Acceptable and offers the best value to the Government.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days .

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days;

provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

Performance Work Statement Dispose of Debris For Hampton Roads Drift Program

1. SCOPE

1.1 Scope. This work item describes the requirements for providing a 30 yard container and disposal of debris in the container.

1.2 The debris origin is litter removed from the waterways of Norfolk Harbor and is typically comprised of untreated timber, coal-tar creosote treated timber, chromate copper arsenate timber and line, timber fasteners, plastic floating objects and miscellaneous floating trash.

2. APPLICABLE DOCUMENTS

US Army Corps of Engineers Safety and Health Requirements EM-385 US Department of Labor Occupational Safety and Health Regulations US Army Corps of Engineers Quality Assurance Plan (QASP)

3. REQUIREMENTS

3.1 General. The Contractor shall provide a disposal container at the US Army Corps of Engineers Craney Island Dredge Material Management Area and shall empty the container when it is full to capacity.

3.2 Safety and health requirements shall be met in accordance with the applicable documents.

3.3 Material disposal: All materials handled and managed, shall be done in accordance with all Federal, State and Local laws, regulations and ordnances.

Note: Craney Island’s roads are unpaved and at times of heavy rain, the roads become slippery with numerous potholes. Additionally roads are elevated without barriers.

Note: Craney Island’s posted speed limit is 25 MPH.

Note: Craney Island has wild life at the facility such as deer, fox, possum, birds and snakes.

Note: The truck that is used to move the container on and off of the Corps facility must meet all state and local laws and regulations.

Note: The driver of the truck used to move the container on and off of the Corps facility, must have commercial driver’s license (CDL) in accordance with State regulations. The driver must have his or her license and the vehicle license in the vehicle at all times.

3.4 Disposal container.

3.4.1 Provide a 30 yard disposal container (dumpster), that is open on the top to allow loading of debris into the container through top side disposal .

3.4.2 The container provided shall be in good condition. The exterior of the container shall not have sharp objects protruding and shall have a door with a positive docking mechanism at one end.

3.4.3 The container shall be rigid enough, so that it is self supported when at rest on the ground and shall have walls that do not buckle or collapse when the container is fully loaded.

3.4.4 Safety labeling: The container shall be labeled at all hazard points as well as label stating not to climb into the container. The container shall have a label that states that this container shall not be used for hazardous materials.

3.4.5 Container purpose labeling: The container shall have a 24 inch x 24 inch (minimum size) label on both sides that state the following:

Note: Label can be of a material that is removable, such as magnetic, so that it could be placed on contractor’s alternate/future containers.

3.5 Container location.

3.5.1 The container shall be placed at the designated site at Craney Island for the duration of the performance period, with the exception that the container can be removed from the facility when the container is being emptied.

3.5.2 The specific location of the container shall be placed near the seawall, at the south east corner of the facility, or as directed by the Contracting Officers Representative (COR).

3.6 Container content disposal.

3.6.1 The container shall be emptied when full. The COR or his or her designated Corps of Engineers representative will call the contractor when the container is full. The contractor shall respond within 48 hours to remove the full container and provide an empty container to the location as stated above.

4. GOVERNMENT FURNISHED MATERIAL (GFM)

5. QUALITY ASSURANCE

5.1 The contractor shall partner with the Corps representative to fulfill the requirements of the QASP, in accordance with the applicable documents.

5.1.1 The Corps will inspect the site of the disposal container at Craney Island monthly to ensure that the requirements of the contract are met, including removal of full containers and return of an empty container.

5.1.2 The Corps will inspect the contractor’s disposal site 2 times during the annual contract period, to ensure that the debris are being disposed of at an authorized landfill.

5.2 The contractor shall ensure that the container is placed in the location assigned, each time the container is emptied and placed back at the Corps facility.

5.3 The contractor shall insure that the materials are transported, disposed of and handled, in accordance with applicable laws and regulations.

5.4 The contractor shall ensure that the required labeling is in satisfactory condition, each time that the container is placed back at the designated site, once emptied at its designated location.
