Environmental Support

The U.S. Army Corps of Engineers, Norfolk District requires Environmental Support (ES) services for Department of Defense (DoD) and other federal agencies. Services include compliance, conservation, prevention, real estate, restoration, scientific studies, sustainability, and technology within the United States, including Alaska and Hawaii.

Environmental Support for these eight services will provide support for DoD and other federal agencies.

Services may include, but are not limited to, environmental assessments, environmental outreach and awareness, development of environmental reports and plans, data collection, database management, Environmental Management System (EMS) support, master planning support, regulatory compliance, habitat monitoring, pollution prevention, and conservation of wetlands, forests, endangered species, and cultural and natural resources.

Current customers supported by ES include major commands and installations of the U.S. Army, U.S.

Navy, U.S. Air Force, U.S. Marines and U.S. Coast Guard. The U.S. Department of Homeland Security, Department of the Interior, and National Oceanic and Atmospheric Administration (NOAA) will also be supported along with DoD and other federal agency customers.

Eight services have been developed for ES: compliance, conservation, prevention, real estate, restoration, scientific studies, sustainability, and technology.

Compliance. Compliance activities ensure that current operations comply with Federal, state and local applicable environmental requirements and regulations. Such laws and regulations include but are not limited to, wastewater discharge, other point and non-point source controls, drinking water quality, endangered species, noise abatement, wetlands, air quality attainment, historic properties, hazardous materials/waste management, pest management and sewage treatment.

Services may include, but are not limited to, regulatory compliance with environmental laws such as the Clean Air Act, Clean Water Act, Sediment Control Act, Resource Conservation and Recovery Act (RCRA), Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), and the National Environmental Policy Act (NEPA). Water quality, environmental awareness and training, hazardous materials, hazardous waste, pollution prevention, spill prevention, air pollution, permit applications, scientific and technological investigations to accomplish environmental compliance, environmental risk and impact, and monitor compliance with mitigation measures. Preserving, protecting, and restoring environmental aspects such as air, drinking water, stormwater, and wastewater. Environmental Management System (EMS), which ensures environmental liabilities are managed to determine root causes for compliance deficiencies identified during inspections.

Services may include inspections to determine compliance status, report findings, and to provide guidance on methods used to implement or improve the EMS. Provide technical support required to implement and maintain environmental compliance in accordance with DoD policy and guidance, military, local, State, and Federal regulations. Develop, review, and update Records of Environmental Consideration (RECs), Memorandum of Environmental Consideration (MOECs), and other environmental documents, reports, and plans as required. Maintain an Environmental Performance Assessment System (EPAS), maintain a National Pollutant Discharge Elimination System (NPDES), perform internal environmental compliance (IEC) inspections, spot checks, site visits, surveys, monitoring, inventories, evaluations, assessments, investigations, data collection, analyze data, database management, outreach activities, environmental program development, implement new compliance regulations and program requirements, and implement control measures.

Conservation. Conservation activities focus on conserving, protecting, and enhancing natural and cultural resources. The main purpose of conservation is to ensure the long-term integrity of valuable resources, such as air quality, local and regional water supply, wetlands, forestry, flora and fauna, soil, endangered species habitat, and historic and cultural properties. Conservation includes the Integrated Training Area Management (ITAM) Program and other programs that develop preventive measures to mitigate potential environmental impacts caused by training, construction, testing or other operations. Natural and Cultural Resources Management is part of the conservation pillar and pertains to the management, conservation and restoration of the land itself and those renewable natural resources thereon.

Services may include, but are not limited to, site visits, surveys, investigations, monitoring, studies, inventories, collect and analyze data, determine potential threats, control nuisances, assess habitat quality, environmental impact statements and analysis, environmental assessments, acquisition and implementation of permits, database management, evaluations, develop reports and plans, and may involve the management and planning of natural resources, wetlands, forestry, fish and wildlife, threatened or endangered species, cultural and historical resources, ecosystems, habitats, and populations. Develop protection and enhancement projects, habitat improvement and maintenance projects, and establish, implement, and participate in public awareness programs.

Prevention. Prevention activities focus on proactively eliminating the potential for pollution to the greatest extent possible, and require the reduction of hazardous materials use and hazardous waste generation. This includes life-cycle management, accident prevention, source reduction, implementation of a materiel and waste tracking system (such as the Hazardous Substances Management System (HSMS), and the use of products, processes, practices and other measures that reduce or eliminate hazardous materials use and hazardous waste generation.

Services may include, but are not limited to, environmental assessments, baseline risk assessments, hazardous waste management, site inspections, sampling, database management, determine cleanup actions and disposal methods, risk management, emergency planning, emergency response, pollution prevention associated with air sources, hazardous wastes, resource conservation and recovery act cleanups, drinking water, wastewater and storm water, pesticides, landfills, and open burn/open detonation compliance sites, track and report hazardous waste data including generation, accumulation, and shipment, create reports from the Hazardous Material Tracking System, update, implement, and maintain a Hazardous Material Management Plan, prepare site-specific contingency plans, prepare Facility Response Plans and Spill Prevention, Control and Countermeasures Plans for oil and other petroleum products, and prepare Emergency Response Plans which identify activities necessary for compliance with regulations on emergency planning for release of hazardous materials, including the Risk Management Plan, and the Emergency Planning and Community Right-to-Know Act, and establish procedures to ensure installation compliance with environmental regulatory requirements.

Real Estate. Real Estate support may also be necessary for real estate programs of Federal agencies, requiring the need to develop strategies for acquisition, accessing and disposal, and transfer of real estate to and from government agencies. Real estate requirements may also be developed for implementation and execution of activities and programs that have an impact on acquisition, management and/or disposal of real property.

Services may include, but are not limited to, compliance with regulations in the Real Property/Master Planning Programs, maintaining environmental documentation, and verification of boundary identification for encroachment spills and dumping. Validate leases, easement, licenses, or permits, develop reports, perform briefings, surveys, and data collection, review documents, and database management. Perform investigations for land use requirements or type of property or land to be leased. Determine, prepare, and review documentation required, such as the Report of Availability, Environmental Impact Statement, Environmental Assessment, Environmental Condition of Property or Record of Environmental Consideration to ensure documentation supports the real estate action.

Work on environmental projects such as land exchanges, land leased, and conveyance of property to DoD and other federal agencies.

Restoration. Restoration activities ensure clean-up of contaminated sites based on health and safety risks in order to protect human health and the environment. A results-oriented cleanup program allows for more viable use of the land for DoD and other federal agencies. The Defense Environmental Restoration Program (DERP) consists primarily of the Installation Restoration Program (IRP), the Formerly Used Defense Sites (FUDS) Program, the Defense and State Memorandum of Agreement Program (DSMOA) and the Base Realignment and Closure (BRAC) Program. Other supportable programs include but are not limited to, Superfund, Brownfields, Residential Communities Initiative (RCI) and Formerly Utilized Sites Remedial Action Program (FUSRAP).

Where appropriate, activities are closely coordinated with the Environmental Protection Agency (EPA) and the applicable states.

Services may include, but are not limited to, site identification, site visits, data collection, database management, environmental assessments, program management, corrective action plans, long-term planning for installation restoration efforts, and restoration of ecosystems, habitats, and watershed areas. Restoration Advisory Boards, conferences, or environmental outreach and awareness, which may involve facilitating meetings, preparation of agendas, coordination of the facility and all associated media requirements, presentations, meeting minutes, public notices, fact sheets, and public outreach information.

Scientific Studies. Compliance, conservation, prevention, restoration, and sustainability services will involve some level of scientific studies to reach installation requirements for environmental support.

Section E - Inspection and Acceptance

CLAUSES INCORPORATED BY FULL TEXT

52.246-4 INSPECTION OF SERVICES--FIXED-PRICE (AUG 1996)

(a) Definitions. "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may (1) by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or (2) terminate the contract for default.

(End of clause)

Section F - Deliveries or Performance

52.211-11 LIQUIDATED DAMAGES--SUPPLIES, SERVICES, OR RESEARCH AND DEVELOPMENT

(SEP 2000)

(a) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages of $300.00 per calendar day of delay [Contracting Officer insert amount].

(b) If the Government terminates this contract in whole or in part under the Default--Fixed-Price Supply and Service clause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(c) The Contractor will not be charged with liquidated damages when the delay in delivery or performance is beyond the control and without the fault or negligence of the Contractor as defined in the Default--Fixed-Price Supply and Service clause in this contract.

52.242-14 SUSPENSION OF WORK (APR 1984)

(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly.

However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract. (c) A claim under this clause shall not be allowed (1) for any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order), and (2) unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

52.242-15 STOP-WORK ORDER (AUG 1989)

(a) The Contracting Officer may, at any time, by written order to the Contractor, require the Contractor to stop all, or any part, of the work called for by this contract for a period of 90 days after the order is delivered to the Contractor, and for any further period to which the parties may agree. The order shall be specifically identified as a stop-work order issued under this clause. Upon receipt of the order, the Contractor shall immediately comply with its terms and take all reasonable steps to minimize the incurrence of costs allocable to the work covered by the order during the period of work stoppage. Within a period of 90 days after a stop-work is delivered to the Contractor, or within any extension of that period to which the parties shall have agreed, the Contracting Officer shall either--

(1) Cancel the stop-work order; or

(2) Terminate the work covered by the order as provided in the Default, or the Termination for Convenience of the Government, clause of this contract.

(b) If a stop-work order issued under this clause is canceled or the period of the order or any extension thereof expires, the Contractor shall resume work. The Contracting Officer shall make an equitable adjustment in the delivery schedule or contract price, or both, and the contract shall be modified, in writing, accordingly, if--

(1) The stop-work order results in an increase in the time required for, or in the Contractor's cost properly allocable to, the performance of any part of this contract; and

(2) The Contractor asserts its right to the adjustment within 30 days after the end of the period of work stoppage;

provided, that, if the Contracting Officer decides the facts justify the action, the Contracting Officer may receive and act upon the claim submitted at any time before final payment under this contract.

(c) If a stop-work order is not canceled and the work covered by the order is terminated for the convenience of the Government, the Contracting Officer shall allow reasonable costs resulting from the stop-work order in arriving at the termination settlement.

(d) If a stop-work order is not canceled and the work covered by the order is terminated for default, the Contracting Officer shall allow, by equitable adjustment or otherwise, reasonable costs resulting from the stop-work order.

52.242-17 GOVERNMENT DELAY OF WORK (APR 1984)

(a) If the performance of all or any part of the work of this contract is delayed or interrupted (1) by an act of the Contracting Officer in the administration of this contract that is not expressly or impliedly authorized by this contract, or (2) by a failure of the Contracting Officer to act within the time specified in this contract, or within a reasonable time if not specified, an adjustment (excluding profit) shall be made for any increase in the cost of performance of this contract caused by the delay or interruption and the contract shall be modified in writing accordingly. Adjustment shall also be made in the delivery or performance dates and any other contractual term or condition affected by the delay or interruption. However, no adjustment shall be made under this clause for any delay or interruption to the extent that performance would have been delayed or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an adjustment is provided or excluded under any other term or condition of this contract.

(b) A claim under this clause shall not be allowed (1) for any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved, and (2) unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the delay or interruption, but not later than the day of final payment under the contract.

52.247-34 F.O.B. DESTINATION (NOV 1991)

(a) The term "f.o.b. destination," as used in this clause, means--

(1) Free of expense to the Government, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and

(2) Supplies shall be delivered to the destination consignee's wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(2) Prepare and distribute commercial bills of lading;
