This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a request for quotation (RFQ). This synopsis/solicitation is issued for commercial services in accordance with FAR Part 13—Simplified Acquisition Procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 effective January 19, 2017, and DPN 20161222 effective December 22, 2016. NAICS 621498 small business size standard is $20,500,000.00. This acquisition is set-aside for Women-Owned Small Business Concerns Eligible Under the Women-Owned Small Business Program. Please note, the contracting officer will ensure that the apparent successful offeror has provided all required documents to the WOSB Program Repository. The contract will not be awarded until all required documents are received. Attention is brought to the requirement of clause 52.219-30, the WOSB concern will perform at least 50 percent of the cost of the contract incurred for personnel with its own employees.

Quotes are due April 27, 2017 at 12:00 pm Eastern. Quote pricing, representations and other documentation shall be uploaded to www.fbo.gov. PLEASE UTILIZE THE PACKAGE UPLOAD FEATURE IN ELECTRONIC SUBMISSION/RESPONSES TO SUBMIT RESPONSES. Oral, faxed, emailed, and mailed quotations will not be accepted.

Any questions shall be addressed in writing no later than April 25 at 8:00 AM Eastern to Brian Williams, Contracting Officer, at email brian.j.williams9.mil@mail.mil. All questions and answers will be posted with the synopsis/solicitation at www.FBO.gov.

Description of requirement: The Florida Army National Guard (FLARNG) requires Periodic Health Assessments (PHA), to include, immunization updating, over 40 exams, phlebotomy, vision screening, behavioral health services, etc. with MEDPROS and DENCLASS systems updating, and Dental Treatment of Soldiers as described in the Statement(s) of work for the Contract Line Items identified. The contractor will be expected to set up mobile facilities and equipment one to two days prior to the start of the event, and equipment to be set up inside government facilities at least one day before the event, no later than 3:30 PM, in order to ensure full operations of systems. The Government may inspect facilities to ensure compliance with all applicable laws and contract requirements. (MEDPROS available through the Army Medical Operation Data System [MODS] at www.mods.army.mil.)

The Florida National Guard currently contracts for these services on an individual event basis, or through the Reserve Health Readiness Program (RHRP).

Performance Standards: In accordance with the Performance Work Statement (PWS) and exhibits, the contractor shall provide all management, labor, material, equipment, certifications and supplies necessary to provide Medical services, dental examinations, and health and dental record updating, MEDPROS and DENCLASS updating. DOEHRS direct computer upload compatible audiology exams and SPRINT testing, MEDPROS entry of all applicable and appropriate IMR/FMR functions including completion of the electronic PHA in the MEDPROS online module during the event by the provider. Soldiers will initiate the E-PHA questionnaire prior to event online. The contractor shall set up within the FLARNG facility except for audiology, if included in Technical Exhibit 3. If identified as required in Exhibit 3, separate contractor provided facilities shall be used on site for audiology (to include SPRINT if required).

Evaluation and Award

Award will be made on the basis of price in accordance with FAR 13.106-1. Award will be made to the responsible contractor (see FAR Part 9) whose quote represents the lowest overall price on a “multiple award” basis (see FAR 13.101(b)(1) and FAR 52.212-1(h)). Contractors must quote all items in the solicitation. The Government intends to evaluate quotes/offers and make award without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial quote/offer should contain the offeror’s best terms from a cost or price standpoint. Do not assume you will have the opportunity to clarify, discuss or revise your quote/offer. Offerors may, at the discretion of the Government, be asked to provide more information and clarification regarding their quote/offer. Request for such information does not constitute discussions. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The Government intends evaluate quotations and make a single, or multiple Firm-Fixed Price awards. It is assumed, for the purpose of evaluating quotations, that $500 would be the administrative cost to the Government for issuing and administering each contract awarded under this solicitation, and individual awards will be for the items or combinations of items that result in the lowest aggregate cost to the Government, including the assumed administrative costs. Multiple awards. The Government may accept any item or group of items of a quotation, unless the offeror qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. In determining multiple awards, the government will not accept an item for PHA/Dental Evaluation without also accepting the corresponding item for Dental Treatment.

Contractor Responsibility

In accordance with FAR Subpart 9.104-1, to be determined responsible, a prospective contractor must –

(a) Have adequate financial resources to perform the contract, or the ability to obtain them (see 9.104-3(a));

(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

(c) Have a satisfactory performance record (see 9.104-3(b) and Subpart 42.15). A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history, except as provided in 9.104-2;

(d) Have a satisfactory record of integrity and business ethics (for example, see Subpart 42.15);

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors). (See 9.104-3 (a).)

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (see 9.104-3(a)); and

(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations (see also inverted domestic corporation prohibition at 9.108).

Before making a determination of responsibility, the contracting officer shall possess or obtain information sufficient to be satisfied that a prospective contractor currently meets the applicable standards in 9.104. The offeror must demonstrate responsibility.

(FAR 9.104-3(a)) Ability to obtain resources. Except to the extent that a prospective contractor has sufficient resources or proposes to perform the contract by subcontracting, the contracting officer shall require acceptable evidence of the prospective contractor’s ability to obtain required resources (see 9.104-1(a), (e), and (f)). Acceptable evidence normally consists of a commitment or explicit arrangement that will be in existence at the time of contract award, to rent, purchase, or otherwise acquire the needed facilities, equipment, other resources, or personnel. Consideration of a prime contractor’s compliance with limitations on subcontracting shall take into account the time period covered by the contract base period or quantities plus option periods or quantities, if such options are considered when evaluating offers for award.

(FAR 9.104-3(b)) Satisfactory performance record. A prospective contractor that is or recently has been seriously deficient in contract performance shall be presumed to be nonresponsible, unless the contracting officer determines that the circumstances were properly beyond the contractor’s control, or that the contractor has taken appropriate corrective action. Past failure to apply sufficient tenacity and perseverance to perform acceptably is strong evidence of nonresponsibility. Failure to meet the quality requirements of the contract is a significant factor to consider in determining satisfactory performance. The contracting officer shall consider the number of contracts involved and the extent of deficient performance in each contract when making this determination. If the pending contract requires a subcontracting plan pursuant to Subpart 19.7, The Small Business Subcontracting Program, the contracting officer shall also consider the prospective contractor’s compliance with subcontracting plans under recent contracts.

(9.104-3(c)) Affiliated concerns. Affiliated concerns (see “Concern” in 19.001 and “Affiliates” in 19.101) are normally considered separate entities in determining whether the concern that is to perform the contract meets the applicable standards for responsibility. However, the contracting officer shall consider the affiliate’s past performance and integrity when they may adversely affect the prospective contractor’s responsibility.

9.104-3(d)) Small business concerns. Upon making a determination of nonresponsibility with regard to a small business concern, the contracting officer shall refer the matter to the Small Business Administration, which will decide whether to issue a Certificate of Competency (see Subpart 19.6). A small business that is unable to comply with the limitations on subcontracting at 52.219-14 may be considered nonresponsible.

Federal Awardee Performance and Integrity Information System

Before awarding a contract in excess of the simplified acquisition threshold, the contracting officer shall review the performance and integrity information available in the Federal Awardee Performance and Integrity Information System (FAPIIS), (available at www.ppirs.gov, then select FAPIIS), including FAPIIS information from the System for Award Management (SAM) Exclusions and the Past Performance Information Retrieval System (PPIRS). When making a responsibility determination, the contracting officer shall consider all the information available through FAPIIS with regard to the offeror and any immediate owner, predecessor, or subsidiary identified for that offeror in FAPIIS, as well as other past performance information on the offeror (see subpart 42.15).

Quotations

Any response to this synopsis/solicitation will be considered a “quotation”. Any reference to “offer”, “bid” or similar in this solicitation shall be taken to mean “quotation”. Any reference to “offeror, “bidder” or similar in this solicitation shall be taken to mean a company submitting a “quotation”.

“Offer” means a response to a solicitation that, if accepted, would bind the offeror to perform the resultant contract. Responses to invitations for bids (sealed bidding) are offers called “bids” or “sealed bids”; responses to requests for proposals (negotiation) are offers called “proposals”; however, responses to requests for quotations (simplified acquisition) are “quotations,” not offers.

FAR 13.004 -- Legal Effect of Quotations.

(a) A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.

(b) When appropriate, the contracting officer may ask the supplier to indicate acceptance of an order by notification to the Government, preferably in writing, as defined at 2.101. In other circumstances, the supplier may indicate acceptance by furnishing the supplies or services ordered or by proceeding with the work to the point where substantial performance has occurred.

(c) If the Government issues an order resulting from a quotation, the Government may (by written notice to the supplier, at any time before acceptance occurs) withdraw, amend, or cancel its offer. (See 13.302-4 for procedures on termination or cancellation of purchase orders.)

(c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(End of provision) Be Prepared to submit information related to the below areas prior to award of a contract to establish responsibility:

Information pertaining to Responsibility in accordance with FAR Part 9.
