Solicitation Amendment No. 0001 For Solicitation No. W911XK21B0001 FY21 Detroit River and Pointe Mouillee CDF Maintenance Dredging
CHANGES TO SPECIFICATIONS
SECTION 35 20 23 – DREDGING
DELETE: The text for Section 1.13.3 Titled “Shoals” No shoaled material above the required pay prism line will be allowed for final acceptance.
ADD: The following text for Section 1.13.3 Titled “Shoals” No shoaled material above the required pay prism line will be allowed for final acceptance except at the discretion of the contracting officer. Refer to specification section 35 20 23 paragraph 3.7.1 titled “Examination” for description of shoals that can remain in place at the discretion of the contracting officer.
DELETE: The text for Section 3.7.1 Titled “Examination” As soon as practicable after the completion of the entire work or any section thereof (if the work is divided into sections) as in the opinion of the Contracting Officer will not be subject to damage by further operations under the contract, such work will be thoroughly examined at the cost and expense of the Government by sounding or by sweeping, or both, as determined by the Contracting Officer. Should any shoals, or other lack of contract depth be disclosed by this examination, the Contractor is required to remove same by dragging the bottom or by dredging at the contract rate for dredging, but if the bottom is soft and the shoal areas are small and form no material obstruction to navigation, the removal of such shoals may be waived at the discretion of the Contracting Officer. The Contractor or its authorized representative will be notified when soundings and/or sweepings are to be made and will be permitted to accompany the survey party. When the area is found to be in a satisfactory condition, it will be accepted finally. Should more than two
(2) sounding or sweeping operations by the Government over an area be necessary by reason of work for the removal of shoals disclosed at a prior sounding or sweeping, the cost of such third and any subsequent sounding or sweeping operations will be charged against the Contractor at the rate of $3,500 per calendar day in which the Government plant is engaged in sounding or sweeping and/or is enroute to or from the site or held at or near the said site for such operations.
ADD: The following text for Section 3.7.1 Titled “Examination” As soon as practicable after the completion of the entire work or any section thereof (if the work is divided into sections) as in the opinion of the Contracting Officer will not be subject to damage by further operations under the contract, such work will be thoroughly examined at the cost and expense of the Government by sounding or by sweeping, or both, as determined by the Contracting Officer. Shoals that are not in compliance with paragraph 1.13.3 titled “Shoals” but are not due to negligence of the contractors dredging operations but outside factors to include but not limited to clay, virgin material, cobbles, shoals forming from shipping traffic, from weather, currents, maybe we waived at the discretion of the Contracting Officer. Any shoals determined to be left above project depth due to negligence by the contractor during dredging operations, shall be removed by the contractor at no additional cost to the Government. The Contractor or its authorized representative will be notified when soundings and/or sweepings are to be made and will be permitted to accompany the surveyparty. When the area is found to be in a satisfactory condition, it will be accepted finally. Should more than two (2) sounding or sweeping operations by the Government over an area be necessary by reason of work for the removal of shoals disclosed at a prior sounding or sweeping, the cost of such third and any subsequent sounding or sweeping operations will be charged against the Contractor at the rate of $3,500 per calendar day in which the Government plant is engaged in sounding or sweeping and/or is enroute to or from the site or held at or near the said site for such operations.
DELETE: The text for Section 3.6 Titled “Measurement” The material removed will be measured by cubic yard in place, by means of soundings taken before and after dredging. Prior, after and check surveys will be made by sonic sounding methods. The Government will make prior and after surveys and may make check surveys. Measurements for final payment shall be based on Government surveys. Measurements for progress payment are based on contractors check surveys. The Contractor shall make check surveys. Once the Government completes after dredge surveys, any material determined to be left above project depth will be removed by the Contractor at no additional cost to the Government. Additional soundings will be taken as the Contracting Officer may deem necessary. Only one (1) prior survey will be made for work required under each contract, by the Government. If additional prior surveys are required, due to the Contractor's operations, the cost of such surveys shall be paid by the Contractor. The cost of such surveys shall be the same as specified in the Paragraph entitled, "FINAL EXAMINATION AND ACCEPTANCE."
ADD: The following text for Section 3.6 Titled “Measurement” The material removed will be measured by cubic yard in place, by means of soundings taken before and after dredging. RFI Questions W911XK21B0001 FY21 Detroit River and Pointe Mouillee CDF Maintenance Dredging:
1. There is a discrepancy in the dredging acceptance criteria, in section 35 20 23 3.7.1 it states the contracting officer will have discretion on acceptance of shoal areas within dredged areas. While in section 35 20 23 1.10 it states that all areas examined in accordance with paragraph 1.13.3 Shoals criteria and will be required to be removed at no additional cost to the government. Which statement is the controlling statement for contract acceptance?
Response: In section 1.13.3: No shoaled material above the required pay prism line will be allowed for final acceptance except at the discretion of the contracting officer. Refer to specification section 35 20 23 paragraph
3.7.1 titled” Examination” for description of shoals that can remain in place at the discretion of the contracting officer. See changes to the Specifications in Amendment 0001 attached.
Then in section 3.7.1 Add: Shoals that are not in compliance with paragraph 1.13.3 titled “Shoals” but are not due to negligence of the contractors dredging operations but outside factors to include but not limited to clay, virgin material, cobbles, shoals forming from shipping traffic, from weather, currents, maybe we waived at the discretion of the COR. Any shoals determined to be left above project depth due to negligence by the contractor during dredging operations, shall be removed by the contractor at no additional cost to the Government”. See changes to the Specifications in Amendment 0001 attached.
2. After the contractor reaches contract volume in the final section of the contract, leaving that section of work only partial complete. Will the contractor be required to remove any material flagged in accordance with 30 20 23 1.10 Contract Compliance within the area partial dredged at the contractor’s expense?
Response: The contractor is required to dredge in a fashion that the channel is clear down to project depth with no shoals remaining in accordance with specification section 35 30 23 paragraph 3.7.1 and 1.13.3. If the contractor reaches the final stations of dredging and all areas from the upstream limit to downstream limit or vice versa are clear but the contractor reaches contract volume and cannot travel any further or remove material down to project depth then the contractor will not be required to remove shoaling at his own expense. A modification will be issued to remove the remaining material down to project depth if funding allows or it will be noted on the final cut sheets, daily reports, and final surveys of the ending cross sections of the contract.
3. Due to the requirements in 30 20 23 1.10 Contract Compliance- Are full coverage multibeam survey required for any and/or all progress payments?
Response: The contractor can use single beam or multibeam for progress payments, the final payment is based off government prior and after surveys and the 100% of the AB items on the contract will not be paid until the government completes their after surveys and agrees on the final quantity removed and visually inspects for channel clearance and that no shoals remain above project depth that are not in accordance with 35 30 23 paragraphs 1.13.3 and 3.7.1
4. Will QC contractor’s surveys showing completion of a section prior to infill events from natural causes including shipping traffic be required to be full coverage multibeam surveys? What order of hydrographic survey will be required for final acceptance?
Response: We amended the text in section 35 20 23 Paragraph 3.6 titled “Measurement” to read that “Once the Government completes after surveys, any material determined to be left above project depth on the government after surveys will be removed by the contractor at no additional cost to the Government. Refer to section 35 30 23 paragraph 1.10 that contract compliance is based off the Government after surveys. See changes to the Specifications in Amendment 0001 attached.
(End of Summary of Changes)
5. Will USACE identify all areas within the contract that have material above project grade that are not materials removed in maintenance dredging contracts, for example undisturbed lake bed sediments like rock or clays? If not by what method will such areas be identified to be exempt from 30 20 23 1.10 Contract Compliance and requiring re-dredging with equipment not required for standard maintenance dredging operations?
Response: Refer to sections 35 20 23 paragraph 3.1.2 titled “Obstructions” and specification section 01 22 00.00 paragraphs titled “payments”
6. The Range Light Specification (35 20 23, 3.3.6.6.1.4.a) say "Red/Green/Amber/Clear" instead of specifying one color. The light comes in any of these colors, but a color must be specified. For each of the two range lights, what color is required?
Response: The range lights color should be amber.
