Performance Work Statement
FY20 Duluth Area Office Lawn Maintenance
1.0 PROJECT DESCRIPTION:
1.1 Description
This work includes lawn maintenance on the four quadrants of land located at the Army Corps of Engineers Duluth Area Office and Lake Superior Maritime Visitor Center. All work is located at 600 S. Lake Ave, Duluth, MN 55802.

1.1 Background
The Duluth Area Office and Lake Superior Maritime Visitor Center are located in the historic
Canal Park at the foot of the Aerial Lift Bridge. The USACE owns and maintains the 4 (four) quadrants of land that the Aerial Lift Bridge is located on. See attached Quadrant Map. The grounds per year can see upwards of 1 million visitors.

1.3 Contracting Officers Representative (COR)
An individual will be designated in writing by the Contracting Officer to act as an authorized representative within the scope and limitations authorized by the Contracting Officer. This appointment will be made prior to award of the contract.
2.0 PRODUCT: All equipment used shall be maintained according to the manufacturer’s requirements. The contractor shall submit product data before award of this contract.
2.1 Lawn Mowers: The contractor shall ensure use of commercial grade gas powered zero turn lawn mowers. The lawn mowers shall be equipped with lawn striping attachment.
2.2 Aerators: The contractor shall use commercial grade gas powered plug aerator
2.3 Sprayers: The contractor shall use commercial grade gas powered fertilizer sprayers.
2.4 Grass Trimmers: The contractor shall use commercial grade gas powered grass trimmers
2.5 Fertilizers: The contractor shall apply fertilizers listed below or approved equal. If any other fertilizers are used, they shall be approved by the Contracting officer’s
Representative (COR) before use.

3.0 EXECUTION:
3.1 Lawn Mowing

3.1.1 Lawn Mowing General: Lawn mowing will be once a week from May
15th through October 31st each year. The lawn will be mowed a maximum of 24 weeks but the number of mowing may be reduced based on weather conditions.
Before each mowing the Contractor shall pick up all litter, trash, limbs, rocks and other debris and remove it from the site at the contractor’s expense. Mowing in all areas shall be accomplished in a manner that will prevent tearing up or scalping the turf and the vegetation and protecting the general public. The grass shall be cut to a height of not more than three (3) nor less than two (2) inches above the ground. Vegetation shall be cut to a uniform height and each pass of the mower shall overlap the previous pass so that no strips of uncut vegetation will result. If for any reason, strips of uncut vegetation remain in the mowed area, the strips will be re-mowed, even though it may be several days before the strips are visible. Mower clippings shall not be allowed to pile up or windrow and shall be evenly or uniformly distributed throughout the mowing area. All areas that cannot be cut with mowers shall be hand cut, pulled or trimmed. Mowing and trimming shall be done at the same time or immediately after one or another.
3.1.2 Lawn Trimming: The contractor shall trim all edges of vertical structures after mowing. No line type trimmer shall be used to trim around unprotected small or young plants or trees.
3.1.3 Mowing Cleanup: Clippings and trimmings shall be cleaned off roadways, parking lots, sidewalks, entryway, etc., after each mowing. Additionally, with each mowing the exhibits and sidewalk along the beach in the NE Quadrant will be cleared of sand, gravel, and rocks.
3.2 Lawn Aeration: The contractor shall be required to aerate all lawns identified on the attached Quadrant Map. The aerations will be required once in the early spring and once in the fall.
3.3 Lawn Fertilizing/Pesticides: The contractor shall fertilize/pesticide all lawn areas when applicable, up to 4 times per year. The contractor shall target seasonal weed growth and pest causing damage to the lawn to best enhance the lawn. The contractor shall submit their Lawn Fertilizer/Pesticide License from the Minnesota Department of Agriculture. After each application, the contractor shall give the USACE representative the delivery ticket of what was applied to the lawns. The contractor shall place and remove flags on all 4 quadrants in accordance to with Minnesota
Department of Agriculture. The contractor shall be required to apply the fertilizer/pesticide between the hours of 5:00AM to 7:00AM local time on either
Tuesday or Wednesday. The contractor shall submit in writing 7 calendar days prior to spraying, on what date and time that the treatment will take place. All fertilizer and pesticide applications shall follow the Minnesota Department of Agriculture for their
Lawn Service Fertilizer/Pesticide License and the City of Duluth’s regulations.
**AMDT 0001** All fertilizer and pesticide treatments shall be a liquid based application.
3.4 Spring and Fall Cleanup: Prior to the first mowing of the season the Contractor shall be required to remove all leaves, trash, and debris from all federal grounds identified on the mowing map. This shall include but not be limited to lawns, flower beds, shrub areas, rock gardens, sidewalks, parking areas, entryways, etc. The spring cleanup shall include raking of the grounds to remove any sand, gravel, stone, etc that may have accumulated over the winter in the lawn areas. All debris shall be disposed of by the Contractor offsite at no additional cost to the contract. Once mowing is completed in late October the contractor shall remove all leaves, trash, and debris from all federal grounds identified on the Quadrant Map.
4.0 LIABILITY
4.1 Any damage to trees, lawns, flower, shrubbery and artifacts caused by the contractors operations shall be restored at the Contractors expense to prior conditions.
5.0 QUALITY CONTROL:
5.1 The Contractor is responsible for quality control and shall establish and maintain an effective quality control system. The quality control system shall consist of plans, procedures, and organization necessary to produce an end product which complies with the contract requirements, all applicable codes and all manufacturer requirements.
5.2 The contractor will be required to provide a Quality Control Plan for review by the
Government, no later than 10 days after receipt of notice to proceed. The Quality Control
Plan shall include the following to cover all operations:
5.2.1 General- The Contractor’s name, address, telephone numbers, and management staff both in the office and onsite.
5.2.2 Equipment- A current list of equipment planned for use on the jobsite.
5.2.3 Work Plan- Description of your quality control operations and how you will accomplish the requirements specified within the contract.
5.3 Quality Control Checklist will be required to be filled out by the contractor and signed by both the contractor’s representative and government representative. The Quality
Control checklists will be required to be completed with signatures prior to receiving payment. The contractor shall develop a Quality Control Checklist for Lawn Mowing and Fertilizing in coordination with the COR.
5.3.1 Quality Control- Lawn Mowing Checklist shall be filled out after every mowing.
5.3.2 Quality Control- Fertilizing Checklist shall be filled out after every fertilizing application.
6.0 CORRESPONDENCE: For ease and speed of communications, both Government and
Contractor will, to the maximum extent feasible, exchange correspondence and other documents in electronic format, as applicable. Correspondence, pay requests and other documents comprising the official contract record will also be provided in paper format, with signatures and dates where necessary. Paper documents will govern, in the event of discrepancy with the electronic version.
7.0 UTILITY SERVICES: The government will provide at no cost to the contractor all use of water, electrical and sanitary utilities needed to complete the tasks listed in the contract. The contractor will be responsible for disposing all waste off-site. Contractor is not required to meter their utility use.
8.0 SUBMITTALS: The Contractor must submit the following. Send all submittals to the COR.

9.0 SAFETY: The Contractor’s workmanship and quality of product shall comply with the most recent edition of EM 385-1-1, U.S. Army Corps of Engineers Safety and Health Requirements
Manual and all applicable OSHA regulations.
10.0 HOURS OF OPERATION: The contractor may work Wednesday or Thursday from
6:30AM to 11:00AM, local time, excluding all Federal Holidays. Requests for working outside of these times and days shall be made to the COR a minimum of one week prior to the scheduled work time.
11.0 PREWORK MEETING: Before the start of the work, the Contractor shall meet with the
Contracting Officer’s Representative or Authorized Representative and discuss the Contractor’s work plan and quality control system.
12.0 SECURITY REQUIREMENTS
All personnel employed by the contractor in the performance of the services specified in this contract or any representative of the Contractor entering the work area shall conform and comply with all applicable U.S. Army Corps of Engineers, facility access, security policies and procedures (provided by government representative).
Pre-screening of contractor candidates via E-verify Program: The Contractor must pre‐screen candidates using the E‐verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that all contractors working on the site have two valid forms of Government issued identification prior to entering the information in E-Verify. The vendor must ensure the correct information is entered into the E‐verify system. A verification sheet for each verified/eligible contractor candidate must be provided to the COR no later than 3 business days after the initial contract award. (The purpose of using E-Verify is to ensure all contractors are U.S. citizens or documented foreign citizens with authority to work in the United States of America). The
COR will forward the verification sheets to the USACE, Detroit District Security Office for validation.
Security Checks ‐ All contract employees must carry pictured identification at all times. They must show I.D. upon request by City/State/Government personnel. The Contractor's employee must carry a copy of the contract requirements with them during the implementation of this contract.
