SCOPE OF WORK

C/B HARVEY LATTICE BOOM CRANE RENTAL

1. Requirements:

a. This contract is to provide rental crane services for a crane barge working on the St Marys River. The crane will be engaged almost entirely in logistical movements for overwater transportation in and around the Soo Locks facility. These logistical movements are considered lift crane work and not duty cycle work.

For emergency response reasons, the Government does need to retain duty cycle capabilities on the crane barge and rental crane services.

b. Services to be provided under this contract will be to provide a lattice boom crawler crane with all associated mobilization, demobilization, assembly, disassembly, training, and annual maintenance and inspection costs to the Boat Basin at the Soo Area Office, Sault Sainte Marie, MI 49783. The rental period shall be up to (5) months, in one (1) month increments. “One Month” shall be defined as no less than 28 calendar days. Each month of rental shall include no less than 176 operating hours. The contractor shall provide a serviceable unit in accordance with manufacture recommendations, as well as the most current OSHA and USACE EM 385-1-1 requirements.

c. The lattice boom crawler crane shall have the following characteristics:

i. Shall be provided with a complete set of list reduction instructions (List Charts, Barge Charts, etc.).

ii. Shall have the ability to operate at no less than 3 degrees list on a barge.

iii. Be provided and erected with boom configuration of not less than 95 feet and not more than 120 feet in length, hereafter referenced as the “short boom” configuration.

iv. Shall have an optional boom configuration of not less than 140 feet and not more than

160 feet in length, hereafter referenced as the “long boom” configuration.

v. Shall have a short boom configuration that allows for both clamshell work and lift crane work without the need for crane reconfiguration. No boom segment changes, wire rope change outs, etc. shall be needed to transition from lifting work to clamshell work. This does not include the requirement to reference a different load chart, addition and removal of counterweights, or change out of blocks and overhaul balls.

vi. Shall have an operational gross weight not exceeding 255,000 pounds when configured with the short boom for lifting work.

vii. Shall have an operational gross weight not exceeding 265,000 pounds when configured with the long boom for lifting work.

viii. Shall have the ability to lift no less than 115,000 pounds at a 20 feet radius and lift no less than 17,000 pounds at a 95 foot radius in the short boom configuration when working from a barge throughout the 360 degrees of swing.

ix. Shall have the ability to lift no less than 63,000 pounds at a 20 feet radius and lift no less than 8,500 pounds at a 140 foot radius in the long boom configuration when working from a barge throughout the 360 degrees of swing.

x. Shall have the ability in all boom configuration to operate in wind speeds of no less than

26.5 mph (12 m/s) with no reduction in capacity, from over 26.5 mph (12 m/s) to not less than 31 mph (14 m/s) with not more than 10 percent reduction in capacity, and from over 31 mph (14 m/s) to not less than 35.5 mph (16 m/s) with not more than 20 percent reduction in capacity when performing lifting operating from a barge on list charts.

xi. Shall be able to be equipped with an automatic tagline for clamshell work and shall be capable of handling standard 2 cubic yard clamshell buckets with two lines. Installation of automatic taglines, if needed in an emergency, shall be the responsibility of the Government.

xii. Shall have a width not greater than 19’8” with tracks fully extended.

xiii. Shall have a track length not exceeding 24’0” end to end.

xiv. Shall have a tailswing not greater than 17’1-1/4” with full counterweight installed and/or with variable position counterweights extended to the rear of the car body to the maximum extent possible in either the short or long boom configuration.

xv. Shall come equipped with a full drum of wire rope reeved as a single part auxiliary line with suitably weighted overhaul ball and swivel. This load line shall be a minimum of 1” diameter and capable of handling no less than a 20,000 pound capacity as allowed by the crane configuration, radius, and windspeed.

xvi. Shall come equipped with a full drum of wire rope reeved with four parts on the main line. The block utilized shall have two or three sheaves with a free rotating single or duplex hook and suitable cheekplates for up to five parts of line. This load line shall, at a minimum, be 1” diameter.

xvii. Additional lines and/or winch drums may be present on the crane but are not required.

These may include, but are not limited to, auxiliary drums in the boom foot, dragline taglines, etc.

xviii. Each lifting load line shall be equipped with a load weighting devise and an anti-two block device. Lines solely utilized for clamshell or duty cycle work may have these functions omitted.

d. To meet all list chart specific characteristics outlined in paragraph c. and subparagraphs, the contractor shall assume a barge of suitable stability will be provided through all ranges. The Government will be responsible for engineering and lowing the crane ratings if the barge does not provide the stability needed to maintain 3 degrees of list through the manufactures published radii at maximum load.

e. All loads indicated in paragraph c. and subparagraphs are gross loads. It is understood that deductions for load lines, blocks, balls, hooks, rigging, and other items will be subtracted from the gross load per manufactures load charts.

f. The contractor shall assume that the Government will provide a suitable crane and or forklift for erection and disassembly beyond the basic machine shipping configuration. This would include track assemblies, counterweights, boom sections, and other ancillary items. Specialized rigging for assembly and disassembly, to include the offloading and loading from delivery vehicles shall be the responsibility of the contractor.

g. The contractor shall provide one technician for a minimum of one work day (ten hours) for erection of the crane no later than the day following the delivery of all components. Following setup, the crane shall undergo a complete function and operations test as well as a load test. The contractor shall be responsible for providing weight for the load test. If water bags are utilized, the Government will provide non-potable water for the load test.

h. The contractor shall provide one technician or trainer to train three Government Employees in the proper and safe operations specific to the manufacture, make, and model provided. Government employees requiring training will be licensed through the National Commission for Certified Crane Operators (NCCCO) in lattice boom crawler cranes. Training shall not be less than 5 hours in duration, excluding a 30 minute lunch and two 15 minute breaks. Training shall be conducted the day immediately following erection, weather permitting.

i. The Government will be responsible for loading the crane onto the barge following the fulfillment of the delivery, erection services, and training. Offloading the crane shall also be the responsibility of the Government.

j. Delivery shall be within 5 days of the date of award. Deliveries shall be made Monday thru Friday between the hours of 7:30 a.m. and 3:00 p.m. EST, excluding Federal Holidays. Coordination with the POC for a firm delivery time shall be made at least 24 hours prior to delivery.

k. The rental period shall start on the first full day following the fulfillment of delivery, erection, and training, excluding Federal holidays and weekends.

l. The Government shall give the contractor a 5 day advance notice on completion of the crane rental to allow the contractor to make freight arrangements and schedule a technician to assist with disassembly.

Rent shall cease once the Government offloads the crane and the crane is prepared for disassembly following the minimum 5 day advanced notification. Disassembly and pickup of the crane and components shall be made Monday thru Friday between the hours of 7:30 a.m. and 3:00 p.m. EST, excluding Federal Holidays. Coordination with the POC for a firm pickup time shall be made at least 24 hours prior to arrival.

m. During the rental period the contractor shall be capable of providing maintenance and repair parts as well as on site support for equipment failure that is not related to improper use and/or accident, as needed, within 24 hours of notice. Under certain circumstances, and when approved by a Government Representative, the 24 hour response time may be waived. Failure to comply with this requirement may result in an extension of the rental period on a day-for-day basis. The designated Government Representative shall determine how the time lost on equipment that is not functioning for more than 24 hours will be credited to the Government, which will be either through extending the rental periods to allow for adequate make up time or requiring the contractor to adjust the invoices to not include this time.

Anything that makes the crane unusable per manufactures recommendations, OSHA regulations, or EM 385-1-1 requirements shall be defined as lost time.

n. The contractor shall be able to provide all past crane maintenance documents for OSHA requirements within 12 hour notification. Prior to delivery, the contractor shall provide a copy of the annual inspection.

The annual inspection shall be valid through no less than 1 month following the full contract rental period of 5 months.

2. Shipment Costs:

a. All shipment costs associated with parts and materials to the above address shall be paid by the awarded vendor.

3. Security Requirements:

a. Security requirements apply to service and maintenance personnel requiring access to controlled areas at the Soo Area Office. These requirements do not apply to delivery personnel mobilizing or demobilizing the crane. It is recommended that the contractor clear potential maintenance personnel prior to crane delivery to prevent delays in repairs. Delay to repairing rental equipment due to un-vetted maintenance personnel shall not be borne by the Government.

b. All personnel employed by the contractor in the performance of the services specified in this contract or any representative of the Contractor entering the work area shall conform and comply with all applicable U.S. Army Corps of Engineers, facility access, security policies and procedures. (Provided by government representative).

c. Pre-screening of contractor candidates via E-verify Program: The Contractor must pre‐screen candidates using the E‐verify Program (http://www.uscis.gov/e‐verify) website to meet the established employment eligibility requirements. The Vendor must ensure that all contractors working on the site have two valid forms of Government issued identification prior to entering the information in E-Verify. The vendor must ensure the correct information is entered into the E‐ verify system. A verification sheet for each verified/eligible contractor candidate must be provided to the COR no later than 3 business days after the initial contract award. (The purpose of using E- Verify is to ensure all contractors are U.S. citizens or documented foreign citizens with authority to work in the United States of America).

d. Security Checks – All contract employees must carry pictured identification at all times. They must show I.D. upon request by City/State/Government personnel. The Contractor must have a copy of the contract requirements with them at the work site during the implementation of this contract.

CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.

Additional copies will be issued for a fee.

(i) Using the ASSIST Shopping Wizard (https://assist.dla.mil/wizard/index.cfm);

(ii) Phoning the DoDSSP Customer Service Desk (215) 697-2179, Mon-Fri, 0730 to 1600 EST; or

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.

(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(End of provision)
