INSTRUCTIONS TO OFFERORS
1. All offerors are reminded to complete the FAR Provision 52.212-3 Representations and Certifications—Commercial Items AND DFARS Provision 252.212-7000 Offeror representations and certifications—Commercial Items.
Also, offerors shall complete and submit any additional full text certifications that are included in the solicitation. An offeror may also register at https://orca.bpn.gov/ in lieu of completing the representations and certifications in this solicitation provided that all the FAR and DFARS Certifications have been completed on line.
2. All offerors must be registered at www.ccr.gov
3. All offerors’ registrations at www.ccr.gov must include the NAICS code that is shown on the front page of the SF1449 in Block 10.
4. Note that selection for award of this project will be made on a best value basis in accordance with FAR provision 52.212-2, Evaluation of Commercial Items. Refer to the text of this provision for details of the evaluation and further instruction for submission of offers. Failure to submit the required information may result in ineligibility for award.
5. In order to be evaluated, offerors must submit actual scheduled pricing under the Contract Line Item Number (CLIN) schedule provided below. This schedule pricing shall then be used to provide a sample quote for the two sample task orders that are also provided. The pricing for these two requirements will be totaled together to determine the offeror’s total price. Once the award is made to the successful offeror, all actual task orders will be priced using the established pricing schedule.
The sample task order will be evaluated under the base period pricing; the option year pricing will be checked to ensure balanced pricing in the out years.
The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise to option(s).

Description of services to be performed
To provide dive and inspection services as necessary for the Detroit District. Services will include video inspections, underwater surveys, debris removal, construction, and minor repairs of underwater structures.
Dive Objectives To provide dive and inspection services as necessary for the Detroit District. Services include video inspection minor repairs and installation or demolition, cleaning, and debris removal. Examples of minor repairs may involve welding, burning, concrete repair, bolt/cable replacement, crack repair, repair of existing underwater structures and mechanical equipment, boat inspections, installation of small components such as ADCP’s and AVM’s for research.
Dive Locations Potential locations for dives include public access facilities such as boat ramps and swim beaches as well as all federal harbors in the district boundaries, Soo Lock Complex and Fox River Dams. Note that these facilities are located in the states of Michigan, Indiana, Wisconsin, and Minnesota. All sites are adjacent to or are located in the Great Lakes, Fox River, and Connecting Channels.
Dive Schedule Schedule of dives will be coordinated through dive contractor and Detroit District Dive Coordinator (DDC) Phillip Ross, Detroit District, 477 Michigan Ave., Detroit, MI, 48226, phone
(313) 226-4761.
If possible, the Contractor will be notified 10 working days in advance of a desired dive date. In an emergency situation, only upon agreement of both the government and the contractor, will this contract be used to satisfy the requirement. Dives to be performed in the navigation channels, locks, service tunnels, head and tail races and will begin at 0700 and conclude at 1700 (this does not include travel time to the dam) Monday through Friday. COE personnel and topside equipment not directly associated with dive functions will be available to support operations.
A pre-work/pre-dive meeting will be held at each dam prior to the dive operation on the day of the dive.
Safety and Health
Once the District Dive Coordinator details the task, the Contractor shall submit a dive plan and an activity job hazard analysis to the District Dive Coordinator within 72 hours of receiving notification of a dive. The dive plan and activity job hazard analysis must be submitted a minimal 10 days for nonemergeny operations before a dive can commence. The dive plan and activity job hazard analysis must be submitted a minimal 24 hours for emergeny operations before a dive can commence.started Project and Contractor safety clearances will be in place (lockout/tagout). The Contractor’s personnel will be trained as to a Project’s safety clearance policies.
All dive team members and Corps of Engineers Diving Inspectors have the authority to stop the dive operation at any time due to unsafe work conditions or practices. The Dive Supervisor for the contractor has ultimate responsibility for the safety of the dive job.
Dive contractors must comply with the current U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1. The document can be viewed at:

Known Dive Hazards/Conditions It is anticipated that working depths will be from 20 to 100 feet beneath the surface.
• Water temperature varies between 33-75° F.
• Possible currents in area. Currents are generally expected to be less than one knot.
• Visibility varies between 6 inches and 6 feet.
• Debris around dive site (entanglement).
• Differential Pressures
• Surface Ice
Crew requirements The minimum dive crew shall include:
• 1 diver
• 1 standby diver
• 1 tender
• 1 Contractor Diving Supervisor (Master diver).
• (1 diver and 1 tender extra for penetration dives.)
Three members of the crew must be qualified divers and have the capability to switch to any of the positions noted above to allow for two working dives a day.
Equipment minimums Surface supplied air dives are required. Use of normal breathing air or Nitrox up to 40% oxygen is permissible.
The contractor shall have the capability to provide video inspection – and record the inspection on videotape.
The contractor will provide if required under the task order a workboat that is a minimum of 18 feet in length with a motor that has a minimum horsepower of 85 for all dives.
Contractor’s must obtain dive approval from the Detroit District Dive Coordinator listed under paragraph “Dive Schedule,” above. To be considered for approval, contractor’s must submit the following information.
a. A copy of the current insurance policy;
b. Dive Superintendent experience record;
c. Diver’s experience record;
d. Diver’s diving card or current dive physical;
e. Current certification cards for CPR, first aid, and O2.

DIVING
PART 1 GENERAL
1.1 GENERAL
This section covers the general requirements for contract diving operations to be performed as specified within this contract. Diving shall be performed in accordance with the latest edition of the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1 (September 2008), 6th Edition of the U.S. Navy Dive Manual (NAVSEA 0994-LP-001-0910 and
NAVSEA 0994-LP-001-0920),

1.3 SUBMITTALS
Government review and approval is required for submittals listed below for this SECTION and shall be furnished in accordance with SECTIONS 01 33 00 and 01 35 29.00 25.

1.4 ELIGIBILITY OF DIVE CONTRACTOR DIVE TEAM PERSONNEL
As a result, any domestic commercial dive contractor meeting the minimum standards set forth in the most recent edition of the USACE Safety and Health Requirements Manual, EM-385-1-1, will be eligible to compete for routine diving work. The Dive Contractor may be disqualified based on their previous accident experience record, significant dive related serious, willful, or repeat State or Federal OSHA safety citations within the 12 months preceding the due date of bid or proposal, poor performance on previous contacts, or their inability to obtain the necessary insurance. All Dive team member must be U.S. Citizens or have written Approval from the USACE HQ Provost Marshall. Request for a foreign national to work on site must be received 30 days in advance. Workers from China must submit paperwork 75 days in advance. A copy of the workers passport and work visa is applicable needs to be submitted to the District Security Office along with the request which will include the nature of the work, location and the duration.
Once awarded, contract performance is contingent upon the contractor's submission of an acceptable Dive Operations Plan, Activity Hazard Analysis, and Emergency Management Plan for the specific diving operation to be conducted. It is the contractor's responsibility to ensure that all diver credentials and equipment certifications meet the standards outlined in the most recent edition of EM-385-1-1.
1.5 DIVING ENVIRONMENT
The dive environment will vary upon location and time of year. Diving depth varies from work at the surface to approximately 100 ft. Water visibility may vary from 0 ft. to 10 ft. Work will generally not be done in currents exceeding 1 knot. Water temperature can vary from just above freezing in the winter to 72 degrees in the summer. The majority of diving work in Detroit District is performed between January 1 and March 31 due to winter work at the Soo Locks Complex. River and lake conditions will vary along with ambient air conditions. Generally, crane supported diving operations will shut down when wind conditions exceed 25-30 mph, depending the crane manufacturer recommended guidelines. Pressure differentials remain the divers greatest hazard when diving around hydroelectric plants, dams, and locks and a very strict Lockout/Tagout Program is in place to prevent the likelihood of pressure differentials from occurring. On rare occasions, diving operations may involve penetrations dives or dives into confined spaces. Work is generally performed in restricted access areas not open to commercial and private vessels.
1.6 DIVE PLAN AND SCHEDULE
When working around power units, no later the twenty-one (30) working days prior to the first planned diving operation, the Dive Plan and Schedule shall be submitted to coordinate unit outages at the project and other concurrent work. The Dive Plan and Schedule shall detail dive locations and shall be flexible enough to accommodate conflicts with allowable unit outages.
Personnel and equipment certification shall be included in the plan. A site specific Emergency Management Plan shall be included in the Dive Plan. A job specific Activity Hazard Analysis (AHA) shall be prepared in accordance EM 385-1-1 and shall be included in the Dive Plan.
Adjustments to the dive plan shall be coordinated with the COR and District Diving Coordinator.
All other dives will normally require submittal of a dive plan and schedule as outlined above within 10 days of a request for work.
1.7 RESOLUTION OF CONFLICT
EM 385-1-1 or supplemental waiver(s) or applicable Memorandum of Agreement(s) (MOA) shall be the controlling authority(s) for implementation of all contract diving policy. Members consisting of the Chief of Construction Branch, District Dive Coordinator, Contracting Division Chief, Operations Chief, and Legal Office Chief, and the Deputy District Engineer will be consulted on any issues such as disqualification of a Dive Contractor or other punitive measures that are recommended.
PART 2 PRODUCTS - NOT USED
PART 3 EXECUTION
3.1 DIVE TEAM COMPOSITION AND DIVE EQUIPMENT
Minimum dive team staffing shall, unless a waiver is approved by HQ Safety Office shall be in accordance with EM 385-1-1. The minimum dive crew of (4) is required for any diving operation. Penetation dives may require up to a 6 man crew. Any variation less than the prescribed crew size will need to receive a waiver, a request for a waiver or variance should take place 30 days prior to the expected dive date. SCUBA Diving is allowable only with prior permission obtained from the USACE Detroit District Dive Coordinator. If a crane is used, the certified crane operator shall not be considered part of the dive team. Surface-supplied air diving equipment with 2-way voice communication shall be used by divers and standby divers. An independent reserve air system (30 cubic foot/3000 PSI bailout bottle or larger) for all divers is required. At a minimum, all diver SCUBA and surface air supply compressors, tanks, helmets, and other related equipment must comply with the requirements of EM 385-1-1. All dive team members must meet the requirements as listed in EM 385-1-1.
3.2 CONTRACTOR-FURNISHED DIVING SUPPORT EQUIPMENT
Variable-volume dry suits with appropriate thermal protection, hot water suits or wet suits shall be utilized by divers at all times. A dive vessel or a floating or suspended dive platform shall be furnished when required from which diving operations will be staged and will contain an appropriately heated shelter for all dive team members when temperature and/or wind-chill factor is below 40 degrees-F. Man-basket(s) shall be provided for each working diver as needed.
All necessary top-side equipment such as welding and burning, lift bags, video, personnel vehicles, and appropriately-powered underwater hand and power tools shall be furnished by the contractor to enable accomplishment of all required dive work.
3.3 CONTRACTOR-PROVIDED SPECIAL UNDERWATER EQUIPMENT
The Contractor is expected to furnish all appropriate tools, equipment, and materials needed to accomplish the tasks as stated in paragraph 3.7.
3.4 SAFE CLEARANCE PROCEDURES
A safe clearance system is used by Detroit District project personnel to insure continuity of service and safety to personnel and equipment. Any work performed which requires taking project operating equipment out of service shall be done only after formal clearance is obtained through the Issuing Authority (Project Control Room Operator). The Government will furnish a master tag (checklist) of clearance lock-out/tag-out items implemented for each clearance action.
The contractor dive supervisor shall accompany Government personnel during the verification of the lock-out/tag-out process. The Government Diving Safety Inspector will keep the project control room informed of all diving activity underway. Clearances violated by Contractor personnel will be cause to immediately and permanently ban the person(s) from the project site.
Contractors will be required to hold a separate clearance for their personnel.
3.5 BOAT RESTRICTED ZONE
3.5.1 General
Each Detroit District Project requires compliance with its site-specific Boat Restricted Zone (BRZ) Policy, where any work on or over water near the dam structures will be planned and coordinated with Project Operations personnel before approaching the dam. The Contractor shall obtain and follow the latest site-specific edition of the appropriate project's BRZ Policy.
3.5.2 Permission
a. The applicant wishing to enter the BRZ must make a written request for access to the Operations Project Manager (OPM) two weeks in advance of the anticipated work date(s). The request must include a schedule and written work plan. The schedule and work plan must be approved by the OPM prior to any "work from the water" or "entry in the BRZ'. Coordination with the OPM shall include the COR, the Operations Project Manager (OPM) or their representative.
b. The applicant wishing to enter the BRZ must include a written job and activity hazard analysis. These analyses must be reviewed and approved by the OPM prior to any in-water work.
c. A pre-work safety meeting will be held at the Project prior to the anticipated work dates. The safety meeting must be attended by the Task/Work Leader or Supervisor of the work crew. In addition, evidence will be provided to the OPM that the applicant seeking access has all of the requirements listed on the attached boating safety equipment memorandum.
d. Immediately prior to engaging in the work within the BRZ boundaries, the applicant must call in and acquire Project Control Room approval to enter the BRZ. This will enable any real time event information to be passed to the BRZ entrants. The applicant must also call and advise the Project when leaving the BRZ.
3.5.3 Flows and Site Conditions
a. Should the applicant wish to enter within 700 feet of the powerhouse or spillway, Project equipment will be positioned so that flows are eliminated or reduced to acceptable levels for the boats being used in the BRZ and for the safety of personnel should they fall overboard. This equipment will be placed under the appropriate clearance so that it cannot be operated while boats are in the inner BRZ. No boat shall enter the area until the clearances are issued and approval has been granted from the Project control room.
b. Permission to enter the BRZ may be withdrawn due to operational concerns at a moments notice by the Project Manager or his/her representative.
3.5.4 Safety Requirements with the BRZ
a. In addition to the requirements of EM 385-1-1, the following safety items must be met prior to entry into the BRZ.
b. As a minimum, each vessel must meet Coast Guard safety standards for boat day and night operation. Included are fire extinguishing capability, personal safety devices, running and anchor lights and audible warning device capable of being heard anywhere within the BRZ. In addition, each boat wishing to enter the BRZ shall display a current State inspection sticker on the boat demonstrating the equipment meets current state safety standards.
c. A marine band radio capable of communication with the control room on channel 14 must be available to the boat operator. Failure to maintain communication with the control room during the period boats are operating within the BRZ is cause for removal from the BRZ and for future BRZ access denial.
d. The boat operator shall remain at the boat controls and have no other duties while inside the
BRZ.
e. A rescue line shall be available in a throw bag. The rescue line length shall be of sufficient length to reach personnel which have gone overboard. A minimum length of 90' is recommended. Line which is constructed of a buoyant material is also recommended.
f. A spotlight which can be easily operated by the boat operator must be available.
g. A second boat of sufficient size, capable of safely removing "ALL" personnel from the work zone, must be standing by for rescue purposes. Both boats must remain in radio contact with each other and the Project control room. The rescue boat is not to perform any work. It is to be manned by a boat operator and at least one rescue individual.
h. Both boats must be powered by engines capable of motoring upstream at twice the speed of the quickest flow that will be encountered inside the BRZ while fully loaded and operational.
i. Each boat must have two motors, & be of sufficient size to safely remove "ALL" personnel from the work zone.
j. Each motor must have a separate fuel system to isolate any fuel contamination problems.
k. Each boat shall have an adequate size tow line capable of towing a disabled boat to safety.
l. The Project will issue identification flags for all vessels that are granted permission to enter the BRZ. These flags shall be displayed clearly and prominently at all times the boat is in the BRZ.
If diving, a 1-meter square Code Alpha Flag as well as a "Diver Down" flag must be flown a minimum of five feet above the vessel's highest point.
m. All boat operators must present their credentials prior to initiation of work. This will include all licenses, certifications and a resume of appropriate experience. Each operator must be approved by the Operations Project Manager (or their Representative) prior to beginning work.
n. Boat operators shall have and review latest river charts in the BRZ area.
3.6 DIVING WORK DESCRIPTION
Diving shall be as required to support the following underwater tasks:
(Insert Specific Diving Scope of Work here) Include proposed type of diving operation, nature of work, depth of dive, water conditions, proposed duration of dive if know, any project support such as cranes, manbaskets, etc. Any particular guidance on Hazardous Energy Control, any unique hazards, other directions to the contractor as required.
TASK ORDERS
The following two task orders must be priced out using rates provided in the offeror’s schedule in proposal.

DIVE OPERATION SPECIFICATIONS for Poe Lock Dewater Dive Support
Jan 17-21, 2011
1. General. All diving activities will be accomplished in accordance with USACE, Safety and Health Requirements Manual, EM 385-1-1 and EM 385-1-86. If for any reason the dive plan, as approved, is altered in mission, depth, personnel or equipment, the District Diving Coordinator (DDC) shall be contacted in order that he may review any revisions prior to actual operations.
2. DIVE TEAM: The Dive Team shall consist of a minimum 4-person crew for all dives. The crew shall comprise of at least a dive supervisor, diver, stand-by diver and one (1) dive tenders.
All members of this team shall be pre-qualified with the USACE Detroit District to perform underwater work. Divers must not have been exposed to hyperbaric conditions within 12 hours of the first and all subsequent planned dives. Each dive team member shall have training and experience consistent with the performance requirements of the scope of work. As a minimum, each team member shall have at least 1 year of military and/or commercial experience in the applicable position; divers shall have completed at least four (4) working dives with similar decompression techniques as in the contract, using the particular diving techniques and equipment to be used under the contract. Divers shall demonstrate that at least one (1) of the four
(4) qualification dives was performed in the last 6 months prior to the contract award date. As stated in EM 385-1-1, Section 30.A.08. Note: Military Divers are exempt from specific dive experience relating to Dams, but must be cognizant of pressure differential hazards and aware of the basic underwater structure. All members must be per EM385-1-1 trained in CPR, First Aid, and have up to date medical clearance to dive.
3. Operations.
A1 – Poe Lock (Lock 2) Dewatering. Date and location of proposed dives: On the dates of January 17-21, 2010, Diver(s) will assist in the dewatering of the Poe Lock. Diver(s) will not inspect the stop log sills to insure the sills free clear of debris. The District’s ROV will conduct inspections of the upper sills and of the lower guard gates including the swing radii to ensure that there are no obstructions. If debris is encountered, diver(s) will be deployed to remove the debris from the sill. The diver(s) will enter the water from the lock wall. Final decision on the staging area will be determined at the Pre-Dive meeting. A ladder will be secured at the lock wall for entry and exit. Specific attention to extracting an unconscious diver will be made at Pre-Dive meeting. The Soo Area Safety Officer will provide the Dive Supervisor with a signed safe clearance procedure check list and the lockout keys as part of the lock down procedures. When the dive team is ready to proceed, the Dive Supervisor will notify the Lockmaster. The Lockmaster will notify ship traffic that divers are in the water.
When the work is complete and divers have been removed from the water and the dive operation has secured, the Dive Supervisor will notify the Lockmaster that the dive operation has been secured. The Dive Supervisor will provide the Soo Area Safety Officer with the safe clearance procedure checklist and the Lockdown keys.
A2. Poe Lock (Lock 2) Dewatering. Purpose of dives / Work to be accomplished: The purpose of the dives is as follows; 1) Remove debris as needed based on ROV inspection of the upper sills and lower guard gates prior to placement of the stop logs. If small debris is encountered the diver will remove. If larger debris is encountered, the diver will inform topside, a crane will be used to tie off to the object, and the diver will take all necessary safety steps during removal. If there are any uncertainties, the diver will be removed from the water and a plan will be developed to address any issues. 2) Divers will remove valve plate from upper end of lock. This may require removal of debris. ¾ in nuts will be removed, steel bar removed and plate removed. 3) Divers will be used to chink the 7 stop logs after dewatering. Divers will start from the top and work their way down. The stop log ends will be done last. 4) Divers will chink the downstream gates. This entails chinking the ends of the gate, the middle, and the bottom of the gates (Note: substantial debris was encountered at the north gate on the Lake Huron side of Lock 2. There may be need for the diver to remove some debris to allow the gates to close.)
4. Nature of Work Performed by Divers: Moderate work in cold conditions in a semi-controlled environment.
5. Maximum allowable bottom time at planned depth: (Decompression Limits will not be reached during this operation.) Maximum allowable time is 200 minutes. No diver should be in the water for more than 90 minutes due to thermal exposure

B1 – SSP Seawall Inspection: The mission is to inspect 1000 lf of SSP and document any holes or rips, compromises in the locking or other issues in the steel. Stations will be established every 10 feet on the top side and marked. A ladder will be secured at the wall for entry and exit if no such ladder feature is present in the wall itself. Prior to the dive, a pre dive meeting will be held each day. A diver will enter the water at one end of the SSP and proceed to the other end. The Diver will start 5’ from the bottom and swim horizontally inspecting the SSP from his position down. Once the diver reaches the end of the SSP, the diver will rise 5’ and repeat. This will continue until the diver swims the surface. Top side personnel will document what the diver reports.
1. Dive Durations: Dive depths will not be deeper than 25’ which corresponds to a maximum bottom time of 310 minutes. No diver will be in the water longer than 180 minutes.
2. Location: South Wall of Confined Disposal Facility at Milwaukee, WI.
B2 – Repair Hole in Seawall: The mission is to remove a 10” diameter iron pipe that extrudes from the SSP wall at a depth of approximately 10 feet and patch the existing hole with a ¼” steel plate by welding. A ladder will be secured at the wall for entry and exit if no such ladder feature is present in the wall itself. Prior to the dive, a pre dive meeting will be held each day. .
1. Dive Durations: Dive depths will not be deeper than 25’ which corresponds to a maximum bottom time of 310 minutes. No diver will be in the water longer than 180 minutes.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2008)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent…
