(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Price

2. Technical capability of the item to meet Government’s requirement

3. Past Performance

Factor 1: Price

The Government will award a contract resulting from this solicitation to the lowest priced proposal that is technically acceptable and that is fair and reasonable to the Government within the competitive range. Prices will be evaluated for fairness and reasonableness through a price analysis that compares the offered prices against each other and against an independent government estimate.

Factor 2: Technical

Technical capability will be assessed against the contractor’s ability to deliver the requested items, in the correct quantities, and at a reasonable date and time from contract award, and to provide any maintenance required in the Performance Work Statement. Offerors will demonstrate technical ability by: Submitting pictures of their requested equipment per the PWS.

Factor 3: Past Performance

For an offer to be eligible for award, it must have either a satisfactory or neutral past performance in Federal Awardee Performance and Integrity Information System (FAPIIS). This database provides past performance results. Results will be considered for within the 3 years limit (48 C.F.R §42.1503). If an action was terminated for default or cause; offerors will be given a negative rating. Offerors with a negative rating are encouraged to provide information on problems encountered on the identified contracts and the offeror’s corrective actions. The government will consider this information, as well as information obtained from any other sources, when evaluating the offeror’s past performance. Offerors with no negative actions in their history will be given a satisfactory rating. Offerors with no relevant performance history will be given a neutral rating.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines…
