REPLY TO

ATTENTION OF

11 January 2010 Contracts Branch

Ladies and Gentlemen:

In the past you have provided heating oil to one or more of our locations. The increased price of oil has forced most of our orders above the dollar amount allowed for most purchase card users. Therefore, we are required by Federal Acquisition Regulation to purchase the oil by contract.

Enclosed is a request for quote for heating oil. Please don't let the size of the package intimidate you! Below are explanations for the key items to guide you through the process to submit a quote.

1. Review the "Statement of Work", especially paragraph 5. We are providing a method to compensate you for the price of oil that provides us with the flexibility to increase or decrease the price depending on the market. If you have any questions about how the calculation will be performed when we receive your invoice, please call me at 412-395-7464.

2. Review 52.212-4, 52.212-5 and 252.212-7001.

3. Clause 52.216-2 explains the price adjustment in more detail. Please fill in "CLIN 0001" on the blank line in paragraph (a).

4. 52.217-8 and 52.217-9 are included to enable us to extend any awarded contract for up to five years.

5. 52.212-1, Instructions to Offerors: Please pay particular attention to the following (paragraph letters below correspond to those in the clause):

(a) This is a small business set-aside for NAICS Code 454311, "Fuel oil (i.e., heating) dealers, direct selling". That means you can only participate if your company employs 50 or fewer people.

(b) Block 30 of the cover page (SF 1449) should be completed, and two copies returned to us with your quote. Your quote should be provided on the Price Schedule which is also included. If you would like an electronic version of the Price Schedule, please send me an e-mail and one will be provided to you (pamela.broglio@usace.army.mil). Quotes are due 22 January 2010 by 11:00 a.m. They should be sent to the address in Block 9 of the cover page.

(c) You should also complete and submit a copy of the Representations and Certifications, 52.212-3 and 252.212-7000 (also included in the package) with your quote.

(g) We don't intend to negotiate so you should submit your best price.

(h) We do intend to make multiple awards, i.e., more than one vendor will be awarded a contract from this solicitation.

(k) You must be registered in the Central Contractor Registration database to receive a contract with the government. If you are not registered, you can do so via the Internet at http://www.ccr.gov or by calling 1-888-227-2423 or 269-961-5757.

If you have any questions or need assistance, please call me at 412-395-7464 or Terence James at 412-395-7551. .

I look forward to receiving your quote.

Sincerely, Pamela D. Broglio
