Department of the Army Justification and Approval (J&A) for Other
Than Full and Open Competition
1. Contracting Activity: The United States Army Contracting Command (ACC) - Warren - Intelligence and Security Command (INSCOM) located at 8825 Beulah Street, Fort Belvoir, VA 22060 is the procuring activity for this requirement.
2. Description of Action: INSCOM G3 requests a modification to increase the value of a previously awarded hybrid (firm fixed price and cost reimbursement) sole source (bridge) contract W911W4-16-C-0002 in order to maintain services that support the Foundry Program while protest concerns are addressed through corrective action. The requirement was awarded on a sole-source basis to Lockheed Martin Services, Inc. (700 North Frederick Avenue, Gaithersburg Maryland 20879-3328) in January 2016. The contract is due to expire on 31 December 2016. All option periods, to include the full use of FAR 52.217-8, have been exhausted. The proposed action will provide continued support while the Government addresses the Government Accountability Office (GAO) Post Award Protest (B-413928) on the competitive task order under the Global Intelligence Support Services (GISS) IDIQ awarded in September 2016. The protest invoked an automatic Competition in Contracting Act (CICA) Stay in October 2016, directly impacting transition and performance on the Global Intelligence Support Service (GISS) Task Order (TO) W911W4-15-D- 0003-0002. This extension will ensure there are no unacceptable delays in fulfilling the Government’s requirement while corrective action is taken and the new effort is competed on the Global Intelligence Support Services Indefinite Delivery Indefinite Quantity (IDIQ) multiple-award contract. The anticipated period of performance of the option extension is for five months from 1 January 2017 to 31 May 2017 and two three-month option periods from 1 June 2017 through 30 November 2017. Operations and Maintenance funds FY17 will be utilized. The option periods will be exercised only to the extent required to award and transition the task order effort under the GI IDIQ. The estimated not-to-exceed ceiling for this effort is $23,968,927.
3. Description of Supplies/Services: AR 350-32 (Army Foundry Intelligence Training Program, (2 June 2015)) requires INSCOM, as the executive authority for the Department of the Army (DA) G2, to provide training to the Military Intelligence (MI) Force on the latest Tactics, Techniques and Procedures (TTP), emerging technologies and systems in all Military Intelligence (MI) disciplines.
The Foundry Program provides operationally-focused training for intelligence personnel and units who are deploying or preparing to deploy, and training Units/Soldiers assigned a Global Reaction Force (GRF) or Regionally Aligned Force (RAF) mission. This modification to the bridge contract will provide continued support to the Foundry Program Management Office, INSCOM Training and Readiness Support Services (ITRSS) management services, Command Language Program Managers (CLPMs), language instructors, All-Source/Distributed Common Ground System-Army (DCGS-A) Instructors, Interrogation/Collective Training Instructors, Geospatial Intelligence termination for convenience was issued to TASC. As a result of the award cancellation, a modification to the bridge contract is required to continue the same level of support beyond 31 December 2016 while the protest concerns are addressed via corrective action. The extension is requested for a maximum period of 11 months.
c. Lockheed Martin is currently performing Foundry Program services and is the only responsible source that can continue to provide the necessary labor skill sets and uninterrupted services, cost effectively and in a timely manner, until the corrective action is addressed and a task order under the GISS IDIQ is awarded. Soliciting this effort under full and open competition would take from six months to one year and result in unacceptable delays in fulfilling the agency’s requirements by negatively impacting INSCOM’s ability to provide the Army and other agencies with the intelligence training and readiness support required by deploying and Regionally Aligned Forces to accomplish their operational missions. The practical and prudent decision is to modify the previously awarded sole-source bridge contract and continue with the current service provider until the transition of Foundry Program services to a competitive task order under the GISS IDIQ contract. It is not realistic to expect another contractor to perform the intelligence support services for a short-term/interim period of performance at the same level of quality and at a competitive cost; nor is it in the best interest of the Government to compete this effort when an existing contractor performing this work has the past experience and existing resources to perform these services for this short interim period. The current efforts are in support of CONUS and OCONUS operations in over 21 locations worldwide. They are very complex requirements and require flexibility and fluidity to support both core and surge efforts. It is in the Government’s best interest to continue to execute all parts of this support using the existing contractor for the interim period versus another contract vehicle to satisfy INSCOM’s requirements. Attempting to attain services through another contractor would certainly cause a break in service jeopardizing INSCOM’s ability to meet current and evolving intelligence operational missions.
d. The issuance of this sole-source contract to the incumbent results in minimal logistical costs to the Government, as the incumbent’s resources are already in place. Additionally, the incumbent’s continued support will negate any learning curve costs, as no learning curve will exist.
e. Alternatives:
1) Suspension of Operation. The services being performed by Lockheed Martin in providing training and readiness support services to Army Units throughout CONUS and OCONUS are tied to HQ INSCOM’s mission per AR 350-32. This task order provides vital and critical services for the Department of Army. Suspension or disruption of services would jeopardize the Department of Army’s ability to have fully trained Soldiers and Units. This would result in a drastic decrease in the ability to deploy forces.
2) Use of In-House Resources. Neither INSCOM nor the Department of Army have sufficient personnel resources to cover these services for 5 months or up to 11 months.
3) Award to another Contractor. The intended source for the extension in requirement is the current contract holder, Lockheed Martin Services, Inc. A sole-source effort was awarded to Lockheed Martin, on 1 January 2016. Lockheed Martin has provided exceptional service throughout the life of the W911W4-16-C-0002 and is a responsible vendor that can continue to fulfill this requirement in the time required. It would not be cost effective nor realistic to expect another Contractor to perform during the interim protest period. Furthermore, any contractor other than the incumbent would experience transition costs, as well as staffing problems to include recruitment and associated relocation fees.
f. Justification. Approval of this J&A will ensure uninterrupted pre-deployment training support to deploying Forces Command (FORSCOM), United States Army Europe (USAREUR), United States Army Pacific (USARPAC), and Reserve Component intelligence Soldiers and units from 1 January 2017 to 31 May 2017 (and potentially through 30 November 2017 if both options are exercised) by the incumbent contractor which has been providing these specialized and advanced intelligence skills training services for more than five years. The incumbent is the only source with the complex management plan, knowledge, and expertise to provide the continued requirements without great risks to the Government.
g. Impact. Failure to approve this J&A could result in an unacceptable interruption of critical services and/or disruption of critical services that directly support warfighter efforts throughout the world; A potential break in service would have a detrimental effect on the Army's intelligence readiness and subsequently on Army readiness. Any loss of intelligence readiness may cause multiple intelligence mission failures and have the potential for loss of life. Furthermore, second and third order impacts of a break in service are:
6. Efforts to Obtain Competition: This requirement was competed under fair opportunity under INSCOM GISS Multiple award IDIQ contract in December 2015. A task order award was awarded in September 2016. In October 2016, a protest was received causing an immediate stop-work order to be issued. In November 2016, a corrective action decision was made to cancel the task order and re-compete the effort. The proposed modification to the sole source bridge contract will allow for a five-month option extension modification for continuance of services under the current bridge contract, with an additional two three-month option periods. The corrective action taken by the agency will require the task order to be re-competed among the GISS contractors. The competitive task order is expected to be awarded no later than 1 March 2017, which will allow fair opportunity for other contract holders to fulfill the Government’s requirement for G-3 Training Services and eliminate the need to sole-source. No efforts to obtain competition outside the IDIQ contract holders will be taken.
7. Actions to Increase Competition: The GISS IDIQ provides a versatile pool of contractors determined at IDIQ award to be technically capable of performing intelligence and intelligence-related support services, financially responsible, and with satisfactory past performance. The follow-on requirement will continue to be competed in the Unrestricted Pool (other than small businesses), which consists of 13 vendors. The request for task order proposals was solicited in December 2016 with 9 contract holders submitting proposals. Therefore, there is a reasonable expectation that multiple offers will be received under fair opportunity.
8. Market Research: At this time, Lockheed Martin, as the incumbent vendor, is the only source to possess the unique skills, the technical capabilities and the personnel already positioned to immediately perform the services required, and any attempts to secure another source will result in unacceptable delays and create high risks of failure to training and readiness support services, as well as pose a significant risk to pre-deployment training support.
Market Research was conducted in September 2015 to determine the range of vendors capable of supporting INSCOM’s requirement for Subject Matter Experts/Instructors in each MI discipline, Command Language Program Managers, and Language Instructors for inclusion in the G-3 Training effort. Research showed that Small Business was not capable of supporting this wide range of services. This research concluded that a competitive action for the Foundry Program services requirement for a short period of performance bridge contract is not in the Government and warfighters’ best interest.
No additional market research was conducted. The market research conducted in September 2015 is within 18 months and the information is still current, accurate and relevant.
9. Interested Sources: A notice of intent to sole-source was posted to FedBizOpps on 17 November 2016 for a period of 15 days in accordance with FAR 5.201. Two companies submitted information in response to the synopsis. Of the two companies submitting capability statements in response to the solicitation, one was determined not to be technically capable and one was determined capable of meeting the requirements. Company 1, Radamanthyus Training and Intelligence, stated in its capability statement it currently has only one member, the chief instructor.
Company 2, is the incumbent. The Government’s intent is to continue the Foundry Program support services under the current vendor in order to allow the time necessary for corrective action and services to be competed under the GISS IDIQ. The approved J&A for the sole-source shall be published in FedBizOpps to meet the stated posting requirements in FAR 5.201.
