Justification and Approval (J&A) For Use of Other Than Full and Open Competition

Army Intelligence Campaign Initiatives Group (A!CIG), Security Business Transformation (SST)

Control No: 15-32

1. Contracting Activity: HQ USA INSCOM, IAPC-DOC, 8825 Beulah St., Fort Belvoir, VA 22060

2. Description of Action: The purpose of this J&A is for approval to award a sole-source contract to a small business, Berico Technologies, LLC, Nicholas Hallam, 11130 Sunrise Valley Drive, Suite 300, Reston, VA 20191-5476 to continue Security Business Transformation (SST) support of the Personnel Security Investigation Center of Excellence (PSl-CoE

The proposed contract will have an eight (8) month period of performance from 16 August 2015 to 15 April 2016 and FAR clause 52.217-8 Option to Extend Services. The expected value of this contract is . This contract will be funded with operations and maintenance (O&M}.

3. Description of Supplies/Services: This J&A authorizes the award of a contract to Berico Technologies in support of the Security Business Transformation effort at the Personnel Security Investigation Center of Excellence (PSl-CoE).

This effort will continue the O&M/Sustainment for the current Personnel Security Investigation Program (PSIP) and Remedy applications. Concurrently, the effort will also focus on the single web-based application (PSIP 2.0) that will replace the current PSIP/Remedy applications. Efforts include: process improvement and process optimization; evaluating new mission requirements and providing project schedule to incorporate required systems enhancements; and providing technology planning and analysis, including related support tasks. Awarding this COf1tract will ensure continuation of critical services and embedded contractor effort within the PSl-CoE, while satisfying their increasing tempo/volume of functional requirements related to the personnel security and suitability mission. The effort will provide project management support; Information Technology (IT) operation and maintenance (O&M) support for the current Army Investigative Enterprise Solution (AIES) supported activities including the front end portal and back end integration with other DOD and Federal systems of record. Support the PSl-CoE team in establishing and running its change control board (CCB) and process review board (PRB).

4. Authority Cited: 10 U.S.C. 2304(c)(1) as set forth in FAR 6.302-1 (a)(2),"when the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." FAR 6.302-1(a)(2)(iii)(A), " ... services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of high!y specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition, or unacceptable delays in fulfilling the agency's requirements.

5. Reason for Authority Cited: This effort focuses on the O&M/Sustainment for the current PSIP and Remedy applications and integration/transformation of Army security programs to a single web-based application (PSIP 2.0) in support of the Army Personnel Security and Suitability and Insider Threat mission. The web-based application is currently in a deployment and business

Control No: 15-32 integration state within the PSl-CoE servers. The system is waiting the final network connectivity

Recompeting the contract at this time, while this critical integration process is ongoing, would be unacceptably disruptive to completing the integration task and an extremely high risk to ensuring the successful completion of this task. The time it would take for a new vendor to both learn and understand the current process and systems involved would be crippling to the PSl-CoE's server integration, O&M, and sustainment efforts. The relationships built between the Serice Technologies team and the required subcontractors supporting the PSl-CoE would take months to replicate. Competing this requirement, with the potential for introducing a new contractor into this complex and sensitive process, would introduce unnecessary turbulence, disrupt ongoing time sensitive operations and likely delay completion of the integration effort. The PSl-CoE employees, customers, and stakeholders in the field would likely experience prolonged degraded services while a new vendor acclimated themselves to the system and the requirements that they would have to support.

Specifically, the PSl-CoE relies on a website, PSIP, which provides over 3,800 requesters in the field that ability to submit PSI requests to the PSJ-CoE. PSIP website feeds a back-end database which is the workflow program the PSl-CoE (Government) employees utilize daily to perform the tasks related to the PSI mission. The PSIP programs have been in use by the PSl-CoE since 2009. Serice Technologies is enhancing and bringing the PSIP programs into one, web-based program. Upon completion of this integration effort, the system will achieve PSIP 2.0 Full Operational Capability (FOC) and will provide significant efficiency gains to the current PSl-CoE capabilities. If the Serice Technologies Team were to be disconnected at this time in the process, it is highly probable that the government would experience failed operations and loss of system capability

Additionally, PSIP 2.0 is incorporating interfaces to eliminate some of the manual tasks associated with the PSI processing and provide near real-time updates to the database. This functionality will further streamline the PS1-CoE's processes allowing requesters in the field to view their cases statuses without having to make a phone call to the customer service center (CSC).

The web interfaces will eliminate manual steps in the process for the PSl-CoE employees by eliminating the need to manually download a Subject's background investigation form as the interface will perform the download automatically. Serice Technologies is in the middle of completing all the efforts associated with the functional enhancement of the system, web integration, operations and maintenance of these activities and finally, bringing PSIP 2.0 to FOC.

While the AICIG IDIQ effort involves three contractors working concurrently, Berico Technologies is the only contractor who has the requisite knowledge to address unique PSI program requirements during the proposed contract period (from 16 August 2015 to 15 April 2016) without a duplication of cost not expected to be recovered through competition, associated ramp up time and technical learning curve challenges. The other vendors do not have the requisite knowledge of the PSl CoE's mission and processes to efficiently and cost effectively transition in to provide the required support. Any new vendor would have the same learning curve and greatly increase the possibility of a system issue that could not be rectified in a timely manner.

Maintaining the Berico Technologies Team in place drastically reduces risk to successful completion of this project as the same contractor continues its ongoing efforts to integrate, operate, maintain and achieve a single, fully operational web based PSIP 2.0 system. Serice Technologies is the only contractor capable of performing this effort during the required timeframe and to standard.

Due to the criticality of Berico Technologies services to the HQ INSCOM and greater Army community it is absolutely essential to maintain the services without interruption while maximizing efficiencies. Failure to award this action will result in 1) Delays in O&M support to the PS1-CoE and its customers world-wide. A new contractor may not have the same understanding of the Government's needs or vision, understand the overall PSl-CoE process, and/or may not fully understand the technical or coding language of the PSIP applications. Any of these issues would increase the chance of system downtime or failure and lead to increased costs to the Government.;

2) Loss of (O&M) support for the current PSIP and Remedy systems; 3) Loss of process improvement support. A new contractor will require a transition period and learning curve. Even a 30 day transition period would potentially slow down the Government's ability to process PSl requests. lt may take longer than 30 days for a new contractor to get a really a good understanding of the overall PSI process with its legacy (PStP) system; 5) Unacceptable delays to the Army PSI process as a whole; and, 6) Inability to meet Presidential and OMS 14 day mandated submission timeline directive. The 14 day front-end mandate drives the PSl-CoE's business process to submit all Army PSI requests within that 14 day timeline. The current vendor possesses the technical capabilities and has established networking contacts with the stakeholders involved in the Army's PSI submission process.

Bringing another vendor on-board and trying to re-develop the personal contacts as well as learn the current PSIP applications while ensuring no degradation in service or capabilities would be

Upon completion of the tasks described above, it is the intent of PSl-CoE to seek a full and open competition under the GISS Contract Vehicle to serve as the O&M/Sustainment follow-on to this effort. Additionally, any new emerging mission requirements will be part of the follow-on competition effort as there is the potential that RDT&E funding may be required.

6. Efforts to Obtain Competition: This requirement was originally competed through full and open competition with a partial set-aside. The purpose of this J&A is to allow a continuance of existing integration and transformative operations and maintenance services in support of the PSl-CoE SST and process improvement functions.

7. Actions to Increase Competition: It is anticipated that the Global Intelligence contract vehicle will identify multiple awardees with the capability to perform this requirement. The proposed contract will allow FOG completion for positioning to compete the fo!low·on effort among the Global Intelligence Support Services (GISS) contractors. The market research and subsequent multiple awards made under GISS confirm competition among interested sources is expected for the follow on requirements once the SBT effort can be competed. The Government's intent is to continue transitioning this effort to allow the services to be competed under GlSS or under another competitive solicitation. There are twenty-four (24) GISS awardees, eleven (11) small businesses, and thirteen (13) large businesses.

8. Market Research: Informal market research was conducted in April 2015. Historical data from previous contracts was used to determine Serice Technologies' market rates. The market research utilized the GSA Website searching for comparable IT positions. Using similar companies that are currently providing lT services at Aberdeen Proving Ground (APG) to other organizations, the following companies rates were researched and costs compared to Berlco Technology's rates/costs:

llNCLASSJFIED

The market rates for the period of May 2015-April 2016 revealed the following cost comparisons for similar positions. See the IGCE and the market research report for a full breakout of labor categories and rates. The current labor hour mix can be found on the IGCE.

Company Cost o/o Above Berico Berico

As the chart above shows Berico Technologies' market rates are on the low end of the market.

The research found a cost range of to a difference of Berico Technologies' rates are °Ai below the next lowest contractor and /o be!ow the highest.

9. Interested Sources: The market research and subsequent multiple awards made under GlSS confirm competition among interested sources is expected for the follow-on requirements once the SBT effort can be competed. The Government's intent is to continue transitioning this effort to allow the services to be competed under GISS or under another competitive solicitation. As explained in paragraph 6, other sources were rejected because Berico T echno!ogies is the only contractor who has the requisite knowledge to address the legacy front end, Remedy back-end and bring the PSIP 2.0 up to FOC without a mission impact or duplication of cost. The Notice of Intent to Sole Source was posted to FedBizOpps through ASFI on 17 July 2015. The last day for responses was 30 July 2015. No objections were submitted.

10. Other Facts:

a. Procurement Historv: The task order was a result of a competitive multiple award 1010 request for task order proposal. Berico Technologies, a certified Small Business, was one of the AICIG IDIQ awardees. Task order W911W4-10-D-0002-0001 was signed 13 August 2010.

Total task order value was with a base period of 16 August 2010 to 15 August 2011. The task order included four (4) option years and expires on 15 August 2015. The contract type was a cost-plus fixed fee. No other AICIG task orders are included in this follow on.

b. Specific tasks include:

i. Accredit, integrate, and bring the PSlP 2.0 to FOC

ii. Continuous review and identification of processes to create efficiencies within the legacy front end

iii. Provide project management support and assistance with prioritization of efforts to ensure customer/stakeholder needs are supported

Berico Technologies is not responsible for or involved in performing the review, validation, and submission of the PSI requests. The PSJ-CoE has another contract vendor that is performing the PSI-related tasks and investigation submissions. Berico Technologies supports the O&M and sustainment of the current PSIP application and the required reaccreditation of the overall PSl-CoE PSIS System.
