JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING ACTIVITY: Army Contracting Command-Aberdeen Proving Ground Edgewood Contracting Division Aberdeen Proving Ground, MD 21010

2. DESCRIPTION OF ACTION: The U.S. Army Research, Development and Engineering Command's (RDECOM) Field Assistance in Science and Technology-Center (RFAST-C) is the U.S. Army Materiel Command's contribution to the U.S. Special Operations Command Technology village concept. The overarching mission of the RFAST-C is to provide enhanced engineering capabilities in theater and synchronize forward rapid acquisition efforts. RDECOM Prototype Integration Facilities (PIF) are currently supporting the RFAST-C at Bagram Air Field in Afghanistan (BAF). Advanced Design and Manufacturing (ADM), the Edgewood Chemical Biological Center’s (ECBC) PIF, provides technical reachback and personnel support to RFAST- C. Approval is requested to award a new contract based on a Letter of Urgency dated 14 November 2012, in support of the RFAST-C Program, on the basis of other than full and open competition for an Energy Efficient Rigid Wall Shelter. An acquisition plan is not required because this is a one-time buy.

This action is for a firm-fixed-priced contract for the procurement of an Energy Efficient Rigid Wall Shelter to include delivery to and set up at Bagram Airfield, Afghanistan, in direct support of wartime initiatives. Fiscal Year 2013 Research, Development, Test and Evaluation (RDT&E) funds are being utilized for this effort.

TOTAL: $369,237.00

The energy efficient shelter consists of commercial off-the-shelf (COTS) components. The components will be shipped and assembled at BAF. Design, manufacture and fabrication of the shelter shall be no more than 60 days after contract award. Delivery by air, to include assembly and set up at BAF, shall be no more than 30 days, with a total period of performance of 90 days.

4. AUTHORITY CITED: The statutory authority permitting other than full and open competition is 10 USC 2304(c)(2), Unusual and compelling urgency as implemented by FAR 6.302-2.

5. REASON FOR AUTHORITY CITED: As authorized by FAR 6.302-2, the use of other than full and open competition for the procurement of the energy efficient shelter system is necessary for the following reasons:

(a) This procurement is in direct support of wartime initiatives based on a Letter of Urgency dated 14 November 2012, in support of the U.S. Army Research, Development and Engineering Command’s (RDECOM) Field Assistance in Science and Technology – Center (RFAST-C) program. This action is further supported by the revised Letter of Urgency dated 11 March 2013.

The Letters of Urgency were based upon an Operational Needs Statement (ONS) dated 18 July 2012. The ONS set forth the impact of the transition from a network of coalition bases to the establishment of relatively small Security Force Advisory Assistance teams (SFAAT) in Afghanistan. There will be two critical impacts on the units resulting from this transition which must be met or addressed in order to maintain an effective capability in Afghanistan. The new units will, in many cases, be established at the edge of routine logistics capacity, which will increase the operational cost of resupplying the units in remote locations. Also, the teams will be supported by fewer warfighters, and will occupy platoon and company size facilities, and will continue to rely on coalition resupply requirements which currently provide 57% of the supply demand. In order to effectively respond to the transition, the ONS was developed which specified the warfighter must be provided with a solution which meets the following requirements:

• Improves the range and endurance of the combat units through minimizing energy and water demands while maximizing energy generation and storage capabilities.

• Reduces the number of warfighters and resources needed to sustain combat operations

• Reduces the number of resupply convoys and aerial resupply operations across hostile battlespaces.

(b) The RDECOM ADM PIF and RFAST-C, in support of the 401st, developed requirements for a prototypical shelter that would be used as a test facility to ensure the requirements of the ONS would be met, and a supporting Letter of Urgency was prepared and signed. The identified test facility would be fielded as a Tactical Operations Center (TOC) for both soldiers and Department of the Army civilians and will enable the 401st Army Field Support Brigade (AFSB) at Bagram Air Field (BAF) to continue its mission as the transition continues. These shelter users will work in the structure 24/7 to enforce the AFSB’s directives and mission, supporting Operation Enduring Freedom. The construction and design of the shelter will be engineered to provide power back to the local grid, a net energy surplus, and will contribute to the new levels of efficiency, including advanced materials and the utilization of solar power. An environmental sensor suite will enable users to actively manage the internal environment of the shelter and collect energy usage data for analysis. The environmental sensor suite will provide critical information for establishing a baseline for future shelters and also to further define the requirements. Operational Energy Advisors will be required to provide technical and tactical operational energy expertise for training, set-up, and operations at the location.

(c) There is a significant risk to the Government and the warfighter should the fabrication and deployment of the shelter be delayed. The shelter, which includes the environmental suite, must be established in order to accurately collect data in Afghanistan to allow the U.S. Director, Joint Engineer Directorate, United States Forces-Afghanistan to make a decision and finalize the requirements to support the new mission. Based on the current timeline, each day the proposed procurement is delayed will affect the operational readiness of US Forces. It is noted the establishment of the SFAAT mission represents the approved response to the DoD mandated transition of the troop draw dawn and establishment of a forward operating base with limited resupply support. This shelter is urgently needed on the ground as soon as possible to collect data to establish the new requirement for future infrastructure in the draw down. The injury to the Government is hindered future infrastructure, including energy resources, telecommunications and force protection measures. Any delay in schedule intensifies the risk to the Brigade Operation Center (S-3), which in turn affects the risk level of other staff sections and the Brigade’s overall mission in theater.

(d) Due to the nature and urgency of the requirement, CASA Designs was considered to be the only contractor available capable of meeting the Government’s technical requirements as well as the expedited delivery requirements. To request other offers from those that proposed in the cancelled solicitation discussed in paragraph 8(c), Market Research and paragraph 9, Interested Sources, was not practicable under these circumstances.

6. EFFORTS TO OBTAIN COMPETITION: A combined synopsis/solicitation was issued 2 January 2013 for a period of fifteen (15) days. After receipt of responses, on 30 January 2013, the subject solicitation was cancelled. proposals were received prior to the submission deadline 17 January 2013.

CASA Designs was the only one that fulfilled all of the technical requirements of the RFQ.

7. ACTIONS TO INCREASE COMPETITION: This is a one-time buy. Future requirements may be part of a competitive acquisition strategy or executed through a Foreign Military Sales (FMS) agreement; but these actions will depend on the U.S. presence in Afghanistan and other factors.

8. MARKET RESEARCH: (a) Prior to the issue of the Request for Quote on 2 January 2013, market research was conducted, both by Edgewood Contracting Division and ECBC-ADM. A thorough search of the General Services Administration’s GSA Advantage! ® online product catalog did not reveal any products similar to the shelter in this requirement. There were no COTS products that could satisfy this requirement without substantial modification.

(b) Internet research identified the following firms as potential suppliers of the required shelter:

CASA Designs, Sustainable Building Innovations (SBI), Performance Contract Inc., Teton Buildings, BOXX Modular U.S., and Synovision. Emails and phone calls were made to these firms to survey the potential cost, schedule and past performance in fulfilling this requirement.

(c) Request for Quote (RFQ) W911SR-13-T-0002 was issued on 2 January 2013 for the Energy- Efficient, Rigid-Wall Shelter System – BAF, via a combined synopsis/solicitation for commercial items in accordance with FAR 12.6. proposals were received prior to the submission deadline 17 January 2013.

9. INTERESTED SOURCES: Request for Quote (RFQ) W911SR-13-T-0002 was issued on 2 January 2013 for the Energy-Efficient, Rigid-Wall Shelter System – BAF, via a combined synopsis/solicitation for commercial items in accordance with FAR 12.6. proposals were received prior to the submission deadline 17 January 2013.

firms expressed an interest in this procurement, including CASA Designs, which was the only one that fulfilled all of the technical requirements of the cancelled RFQ.

The notice required by FAR

5.201 was not posted for this procurement other than the canceled solicitation notice. The instant proposed contract action is made under the conditions described in FAR 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in

FAR 5.203.

10. OTHER FACTS: (a) Request for Quote (RFQ) W911SR-13-T-0002 was issued on 2 January 2013 for the Energy-Efficient, Rigid-Wall Shelter System – BAF, via a combined synopsis/solicitation for commercial items in accordance with FAR 12.6. proposals were received prior to the submission deadline 17 January 2013.

(b) On 30 January 2013, the solicitation was cancelled. It was determined that in order to meet the customer’s requirement, award would proceed to CASA in order to avoid a delay in meeting the warfighter’s needs. CASA’s proposal met all of the government’s technical and delivery requirements. Further, CASA provided documentation detailing successful past performance in completing similar requirements.

(c) Failure to execute this contract will result in the Government failing to collect critical data to accurately assess the environmental impact of the seasonal changes in Afghanistan in relationship to the ability of the shelter to maintain operations with the power constraints resulting from the ongoing military transition. The delay in award would seriously injure the government. The failure to timely collect this data and develop a timely more definitive path forward would drastically reduce the ability to accurately assess and provide future self sustaining units in remote locations or areas of limited support capacity following the projected troop draw down and unnecessarily place additional risk on the warfighter and the regional commanders.
