Justification Review Document FAR Part 6 Justification and Approval for Other than Full and Open Competition
Program/Equipment: The Fort Bliss Directorate of Public Works (DPW) manages essential solid waste and refuse removal services through an external contract. This service ensures the installation remains compliant with relevant Army regulations (AR 200-1, CLS 403, ISR 403) and all applicable state and federal environmental laws for waste collection and disposal.
The current contract requires the service provider to supply all necessary personnel, materials, and equipment to operate these services across all Fort Bliss areas, including living quarters (cantonment areas), training grounds, and temporary base camps. The government provides the refuse dumpsters, which the contractor is then responsible for maintaining and repairing.
To ensure uninterrupted service, this initiative will acquire refuse removal services through a Firm-Fixed-Price modification, extending the current contract by an additional six months.
Authority: 10 U.S.C. 3204(a)(1) as implemented by FAR Part 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

c. Impact if justification is not approved: If the contract requirement is not approved for an extension, the consequences of service disruptions will be detrimental to the mission and operations of the Installation, and the safety and welfare of our civilians, military, and families. Approximately, 166,000 military, governmental civilians, contractor personnel and resident family members working and residing on Fort Bliss would be negatively impacted if the extension is not approved.
7. Efforts to Obtain Competition: The Contracting Officer issued the notices mandated by FAR 5.201. A Sources Sought notice was published on 12 December 2025.
a. Effective competition: This is a sole source action to extend an existing contract;
effective competition is not applicable.
b. Subcontracting competition: The incumbent contractor, GEO International Management, LLC is currently a small business for the assigned contract and therefore, is not required to have a small business subcontracting plan. The incumbent contractor will be required to obtain as much competition as possible for any part of the requirement that is subcontracted and gives maximum opportunity to small businesses.
8. Actions to Increase Competition: The Government intends to issue the follow-on contract as a competitive small business procurement as expeditiously as possible and fair competition is expected.
9. Market Research: Market Research for this requirement using NAICS code 562111 (Solid Waste Collection) was completed for the follow-on contract to determine the interest and capability of small business firms with the knowledge, experience and business acumen commensurate with the level of effort required. In accordance with DFARS PGI 206.302-4(d), the market research previously conducted, including the sources sought notice published on 12 December 2025, remains applicable as there have been no significant changes to the requirement or the market environment. The sources sought notice indicated that eight (8) potential vendors provided capability briefs; however, none of these vendors were able to meet the urgent mobilization timeline or phase into the contract requirement, which is set to commence on 03 January 2026.
10. Interested Sources: In accordance with DFARS 205.205-71, DFARS 206.302- 1(d),and PGI 206.302-1(d), MICC-Fort Bliss previously posted a source sought notice on SAM.Gov on 12 December 2005. Eight (8) responses were received to the sources sought notice, and the circumstances remain unchanged since the previous contract extension. These submissions were found to be insufficient in meeting the requirements specified in the notice, particularly regarding the mobilization timeline and the transition into the contract set to end on 03 January 2026. Based on this, the contracting officer has reaffirmed that awarding the extension to the incumbent contractor continues to be the lowest risk to mission failure and the only viable option to avoid a break in service.
