JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

Logistics Readiness Center - Bliss (LRC-BLISS) BASOPS Services

1. CONTRACTING AGENCY: MICC – FORT BLISS, TX

2. DESCRIPTION OF ACTION:

Request approval to award a sole source Cost Plus Fixed Fee (CPFF) interim contract to AC First for continued provision of Logistics Readiness Center (LRC) Base Operations (BASOPS) support services at Fort Bliss, TX. The contract will be funded with FY 15 Operations and Maintenance, Army (OMA) and Overseas Contingency Operations (OCO) funds.

3. DESCRIPTION OF SUPPLIES/SERVICES:

LRC BASOPS requirement includes Transportation Services (TMP, Personal Property, Freight and Unit Movements operations), Installation Supply Services (ASP, SSA, Property Book CRP, and PDO) and Materiel Maintenance. The Period of Performance (POP) will be for seven months which includes a three-month Base period and four one-month option periods. The estimate cost for interim contract is $9.3M.

4. AUTHORITY CITED: This action is authorized under the provisions of 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1, Only One Or a Limited Number of Responsible Sources, and No Other Type of Supplies or Services Will Satisfy Agency Requirements.

5. REASON FOR AUTHORITY CITED: : IAW FAR 6.302-1(a)2(iii)(B), this will be a follow-on contracts for the continued provision of highly specialized services and award to any other source would result in Unacceptable delays in fulfilling the agency’s requirements. Due to delay in award of the follow-on task order under the US Army Enhanced Army Global Logistics Enterprise (EAGLE) contract, an interim contract is required to prevent a break in critical BASOPS services at Fort Bliss, TX. AC First, the incumbent contractor, is the only source that can satisfy the Army’s requirement without disrupting services. This short-term contract is necessary to bridge gap in services until competitive acquisition can be completed under

EAGLE.

a. Background: The current contract, W911SE-07-D-0004 was awarded to AC First with a POP from 1 April 2013 to 31 March 2014, this contract was extended for six months, from 1 April 14 to 31 October 14, IAW FAR 52.217-8, Option to Extend Services. The current contract was awarded to provide time for the LRC base operations services & Central Issue Facility (CIF) services to be combined as a single requirement for synopsis/solicitation and award under the US Army Enhanced Army Global Logistics Enterprise (EAGLE) multiple award contract. The EAGLE award was protested a the GAO level as a result of the protest the

EAGLE contract has been delayed and therefore use of the EAGLE contract in lieu of the current contract has also been delayed due to circumstances beyond the control of the contracting office as outlined in FAR 37.111.

b. Alternatives:

(1) Use in-house Resources: Fort Bliss does not have the existing personnel to perform the required services. Acquiring them is a lengthy process and will not meet the time period contemplated in this extension effort. This is not a viable alternative.

(2) Establishment of a new contract thru competition: If another contractor won, they would require at least a two-month phase-in period to include equipment and property inventory and security background checks. This is not a viable alternative as the transitions time and associated cost would be duplicated once EAGLE task order is awarded.

(3) Suspension of Services. LRC provides essential services that support critical logistical requirements for the 1st Armored Division and Fort Bliss, TX. All of the maintenance, supply, and transportation functions are crucial for the 1st Armored Division to conduct their training mission successfully and for Fort Bliss to remain a power projection platform for the 1st Armored Division and the CRC mission. If services were allowed to lapse then currently planned 1st Armored Division rotations would have to be cancelled until the Fort Bliss EAGLE Task Order were awarded and phased in. Foregoing services would also impact the ability of Fort Bliss tenant units to perform their individual missions successfully.

This is not a viable option.

(4) Award an interim bridge effort to the incumbent: As discussed above, this is the optimal way to proceed. The 1st Armored Division rotations and CRC mission support the premier contingency response forces in the Southwest Asia Theatre of Operations.

Support is literally a national security issue. The short duration, the lengthy transition needed, the complexity of the mission, and cost consciousness make this the only viable alternative.

c. Justification: The services being acquired under this proposed interim contract effort provides vital services to the 1st Armored Division and Fort Bliss, TX. Additionally the interim contract is the only viable option to maintain the level of services required without a break in service while ASC solicits the LRC BASOPS support services contract and make award under the EAGLE program

d. Prior Acquisitions: Prior to the incumbent contract with AC First, an unrestricted solicitation resulted in the competitive award of contract W911SE-07-D-0004, also to AC First.

e. Impact: Without award of this bridge contract, the LRC cannot perform its mission to provide support to rotational training units, deploying units, and other tenant activities o n the installation. Additionally, the incumbent contractor AC First is the only logical source to perform the BASOPS services as they have the labor force in place to continue to provide continued critical base mission support without disruption or delay of services. Suspension of work or bringing in a new contractor at this time will have a detrimental effect on the LRC, creating mission failure and jeopardizing the troops and civilians on Fort Bliss, TX.

6. EFFORTS TO OBTAIN COMPETITION: Based on the information stated above the government will not seek competition for this bridge contract action. Award of a short term bridge to the incumbent, AC First is the best solution to meet the government’s requirements

The bridge award is restricted for the minimum time required for award of the EAGLE contract which is scheduled for award on or around 31 October 2014
