SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $150K

1. Agency/Contracting Activity: Mission and Installation Contracting Command- Fort Benning

2. Description of Action:

Nature: New Requirement Follow-On Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time and Materials

Funds: OMA Other Funds:_________

3. Description of Supplies/Services:

a. The total estimated dollar value of the proposed action is $24,864.88

b. 513 95 Gallon Refuse Container, Model USD95M, with 10” plastic snap-on wheels.

4. Authority: This action is authorized under provisions of FAR 13.106-1(b) (1) (Simplified Acquisition Procedures)

Action using Simplified Acquisition Procedures:

FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reason for Authority Cited: The cost of this acquisition is less than the Simplified Acquisition Procedures maximum cost limit. Fort Benning is working to comply with a Presidential Executive Order to recycle at least 50% of our waste products NLT the end of FY 15. We currently do not have a recycling program for our Family Housing. The city of Columbus has agreed to expand their existing recycling program into our Family Housing areas but cannot fund the cost of recycling containers. Starting recycling in Family Housing will greatly assist us in attainment of our 50% recycling goal. The city requires the use of 95 gallon containers specifically designed to be used with their collection equipment/trucks and to display on the container a listing of the materials that can be recycled.

The selected vendor has worked with the city to develop the required container and offers it to us at the same discounted price the vendor charges the City. The price is less than half the current market rate as determined by our market survey. We must start our Family Housing recycling program as soon as possible in order to meet the mandated 50% goal by the end of FY 15- the longer we delay lessens our chance of meeting the goal. The City cannot start collecting recyclables until the required containers are available at each set of quarters. In order to start the program as soon as possible it is in the best interest of the Government to procure the containers at a reasonable price through the fastest means available which is to purchase from the requested source without competition.

6. Actions to Increase Competition: We will continue to conduct on-going research of the industry market place to determine if there are new entrants into this product arena. Should there be a need for future procurement we will make every effort to solicit as a full and open solicitation.

7. Market Research: Previous buys market survey resulted in only one offer.

9. Additional information to support the justification: Schaefer SI is also the sole supplier of the City of Columbus Recycling Program. Based on our Market research, the sole source option was selected to acquire the containers from the Schaefer SI as this is the quickest and least expensive means of obtaining containers that meet the City's specific requirements and will allow the Family Housing recycling program to begin contributing to our overall recycling goal (50% by the end of FY

15) as soon as possible.
