JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
(Actions NTE $650K for other than Simplified Acquisition Procedures)
1. Agency/Contracting Activity: Directorate of Public Works/MICC Stewart
2. Description of Action: Fort Stewart Portable Latrines
Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number: W911SE-08-D-0009
Pricing: Firm-Fixed Price Time & Materials Cost
Funds: OMA Other Funds:
Name of Proposed Contractor(s): Major Contracting Services, Inc.
Street Address: 3129 Delta Drive City, State, Zip: Colorado Springs, CO 80910-1027 Phone: (719) 391-0176
3. Description of Services or Supplies:
The total estimated value of the proposed action is $ 151,458.75; funds will be provided on individual task orders as needed
Contract W911SE-08-D-0009 was awarded on 12 December 2007 by Ft. McPherson. The contract was subsequently tranferred to and administered by MICC – Ft. Stewart. The contract consists of providing all labor, personnel, equipment, materials, supplies, supervision and other items and services necessary to provide the Rental and Service of Portable Chemical Latrines on Fort Stewart, Georgia. The contract was issued for a base period with four, one year options, and included clause 52.217-8, Option to Extend Service. This request for approval is for the modification of contract W911SE-08-D-0009 extending the period of performance for up to 6 months, 1 October 2012 through 31 March 2013, utilizing clause 52.217-8. The extension is necessary to allow sufficient time to compete a follow-on requirement. The follow-on solicitation will be posted on the Federal Business Opportunities website. .
4. Authority:
Actions other than simplified acquisition procedures (select one):
FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 USC 2304(c)(1)
FAR 6.302-2: Unusual and compelling urgency, 10 USC 2304(c)(2)
FAR 6.302-5: Authorized or Required by Statute, 10 USC 2304(c)(5)
Other: __<insert appropriate authority here

5. Reasons for Authority Cited:
The current contract expires on 30 September 2012. There are significant changes in funding that have resulted in changes to the requirement. Time is needed to finalize the requirement based on projected Garrison funding. The extension will allow sufficient time to review changes and revise the requirements of the follow-on contract.
The government does not have the in-house resources necessary to provide the services during the extension period. Many of the latrines are located in training areas and a failure to provide a continuity of service would greatly impact the 3d Infantry Divisions training missions.
The current contractor has the equipment and work force in place that will ensure continuity of the portable latrine service until the follow-on requirement is finalized and a contract is awarded. Due to the extent of equipment required and the set up time to perform the requirements of the current contract, it would not be cost effective to the Government or prospective contractor to compete and award a short term contract before the current expiration date will be reached on the current contract. There are a significant amount of permanent latrines located throughout Ft. Stewart, and the current contractor already has equipment in place to service the latrines as required.
6. Actions to Increase Competition:
MICC – Fort Stewart will pursue a competitive acquisition with an anticipated period of performance to start on 1 April 2013. The follow-on requirement will be posted on the Federal Business Opportunities website, www.fbo.gov, and all interested firms who meet the set-aside requirements will have the opportunity to compete. The anticipated follow-on contract will include a base period of up to one year and two, one year option periods. The current contract was awarded competitively and received sufficient competition. The contract clause 52.217-8, Option to Extend Services, was included in the solicitation for contract W911SE-08-D-0009.
7. Market Research:
Previous market research and competition demonstrates more than one firm available to provide the services required. The contracting office is currently performing market research for the follow-on requirement. However, the scope of follow-on requirement, once finalized, may have an impact on the overall acquisition strategy.
