RFI RESPONSES
The following information is the FINAL REPLY to RFI's that have been submitted.
This information is current as of 1 June 2017 and where applicable may change a previous response and all answers that result in a change and or clarification have been updated into the PWS. If a response posted to a RFI is somehow not posted to the PWS then the RFI answer will be the final word in the event of an omission or disagreement between the RFI answers and or PWS.
1.
We believe this to be a proprietary specification that only one GSA schedule holder can provide. As an industry leader for environmental stewardship, our products are cradle to cradle Platinum certified. Our environmental initiatives go beyond just recycled content percentages, incorporating the values stressed in LEED v 4.0, Declare, NSF140, Green Label Plus and others. We request that West Point eliminate the 25% recycled content requirement, and evaluate companies on their overall environmental programs. We believe this will provide a tremendous advantage to West Point by driving greater competition, while expanding options to award winning products that still include principles of environmental leadership.
Suggested edit to: 5.5.1 New carpet face materials shall contain a minimum of 25-100 percent of total recovered material content. This allows for pre and post consumer, while still emphasizing environmental stewardship. For future reference, I can certainly help in providing language around this portion of your bid structure. We have documentation that we can provide to assist in this effort.
ANSWER: AGREE. SPEC MUST MEET: "NSF/ANSI 140 Sustainability Assessment for Carpet" GOLD STANDARD. AND ALSO FOLLOW THE REQUIREMENTS OF THE EPA AND USDA. PARA 5.5.1 has been updated in the PWS.
2. Line Item ‘0019’ (install reflective nosing) are we to assume that is for stairs only? And what is the purpose for the reflective nosing? IE, Safety or visually impaired or emergency? IE; NY State only requires a 2” color contrast for visually-impaired, whereas emergency nosing will illuminate when there is a loss of lighting.
ANSWER: NOSING IS FOR STAIRS ONLY .Abide by NYS standard . Federal guidelines may apply.
3. Please verify carpet dimensions per 5.6.2
This was changed to read 5.6.2 Minimum carpet thickness shall be .130 inches. See Para 5.6.2 for changes
4. Please confirm whether the broadloom is to be made from nylon fiber or whether it would be it acceptable to use alternate types? (Our understanding is that West Point prefers if not requires nylon, but our understanding of the spec as written would allow for alternate types to be furnished and installed.)
ANSWER: NYLON IS PREFERRED DUE TO ITS DURABILITY, HOWEVER, OTHER ALTERNATE MATERIAL TYPES MAY BE CONSIDERED AS LONG AS THEY MEET THE WARRANTY AND DURABILITY REQUIREMENTS.
5. Not knowing the type and amount of furniture in any of the buildings we are going to remove and replace flooring causes issues with the unit prices for carpet or VCT. This can create a situation where a small room needing carpet can have a higher labor cost for removing/reinstallation furniture than that of material/labor, as it will skew the SF/SY price. Suggest a flat labor rate line item for removal/reinstallation of furniture which will cover both secure and loose furniture. We respectfully request that the labor to remove/reinstall furniture be separated from ITEM 0014 and 0015
ANSWER: THE LABOR COSTS REQUIRED TO REMOVE , MOVE, REINSTALL ETC WILL NOT BE BROKEN OUT INTO A NEW CLIN FOR ANY CLIN(S).
6. Section 1.14.1 states that Government will verify if suspected floor needs abatement, we all know that the only way to properly check/inspect for asbestos is for it to be sent to a lab. If this is the case, is the Government responsible for the lab charge? Also, we will have a crew of (xxxxxx) men that will be responsible for removing the carpet, if they find the black mastic or tiles, they will not be able to do anymore work until the asbestos testing is done and the results are back- how do we get compensated for the personnel mobilized that suspects the floor needs abatement, while the Stop Work Order is implemented??
ANSWER: THIS HAS BEEN ADRESSED IN PREVIOUS RFI'S. IF THE CONTRACTOR SUSPECTS ASBESTOS IS PRESENT, CONTACT THE COR. THE CONTRACTOR DOES NOT TEST NOR REMEDIATE ASBESTOS . MICC WEST POINT WILL ADDRESS ANY AND ALL ISSUES ON A CASE BY CASE BASIS FOR WORK STOPPAGE AND OR HOW TO PROCEED. IN A BEST CASE SCENARIO , WE WILL ATTEMPT TO KEEP A CONTRACTOR BUSY BY ISSUING OTHER TASK ORDERS. SEE ALSO PWS PARAGRAPH 5.4.2
The following have been modified:
PARTIAL ANSWERS TO RFI'S
The flowing information is provided in response to RFI’s received to date. Further clarifications will be posted as soon as answers are finalized.
Questions to KO RE: Carpet re-compete.
Solicitation Number: W911SD-17-B-0003 General Questions:
1. Is there an USMA Material overlay that depicts buildings or areas of buildings where Asbestos Tile or older linoleum have been installed? Are we to assume every building could have asbestos and if so how long is the down time to have remediated if discovered?
SEE 3.4 3.4 ASBESTOS REMOVAL: The Government will provide asbestos removal services as and when needed.
Prior to the contractor being issued a Task Order for carpeting, the government will survey the site and check for the existence of asbestos. If asbestos is known to be in the floor, a Task Order will not be issued. If after accepting Task Order for carpeting, asbestos is found see para 1.14.1 and 3.4.3.4
1.14.1 The Contractor shall be aware that asbestos floor tiles may be discovered during the performance of this contract. The Contractor will notify the COR that he or she suspects the floor tile to be asbestos and the Government will verify if the floor tile contains asbestos. Asbestos removal will be accomplished by the Government. (Historically, West Point has found that nine (9) and twelve (12) inch tiles contain asbestos material.) Completion schedules will be adjusted accordingly.
5.4.2 Preliminary Site Investigation: Prior to issuance of the task order, the Contracting Officer’s Representative (COR) shall schedule a preliminary site visit with the Contractor to determine and jointly agree on the following:
Field measurements: quantities of materials needed Quantities for all CLINS are estimated.
Existing layout of office furniture locations
Existing site conditions
Time required to complete each job
2. Section: 5.6.2 – please clarify thickness – may be a typo.
5.6.2 Minimum carpet thickness shall be .130 inches.
ITEM Number questions:
1. While we understand the RFQ for large quantities in order to reduce quotes for the RFQ (IE 15,000 SY, 30 door cuts, etc), most projects at USMA are not more than 1000 SY. Is It West Points plan to order a large quantity and inventory it (stock it) or have contractor stock material? And will these quoted amounts be final? As 30 door cuts is rare on any average flooring job project – would normally be 2-6 door cuts. If a bidder produces an ‘assembly line bid’ which would be abnormally low, it would be unrealistic to stick by that price when only performing 2 or 3 door bottom trims.
West Point will not supply a “bench stock”. All quantities are estimated- and as noted on each Contract Line Item (CLIN) Please review the PWS Paragraph #1 “The Contractor shall provide all personnel, management, materials, transportation, equipment and any other items and services necessary to remove and replace carpet, vinyl base and install new vinyl base in accordance with the specifications listed below and manufacturers recommendations in various public buildings at West Point, New York. “
Please keep in mind that for each clin and within each option year, Task Orders are issued against the quantity that has been estimated. There is no guarantee that subsequent Task Orders will exhaust the quantity. For example if the clin on the award shows 15,000 Yards, that 15,000 yards represents the ESTIMATED QUANTITY that may be used. While in the planning phase of the solicitation/award, the DPW personnel have anticipated a need for 15,000 yards to be used. In reality we may not have funding to use all that quantity and conversely, we may exceed that amount. How the prospective contractor determines their prices is entirely up to them. Once the contract is awarded, there is no going back because someone underbid the award. The prices that are submitted are the prices that the contractor is obligated to perform at for the life of the contract. Also reference PWS paragraphs 2.1.9.2, 2.1.9.3 and 2.1.9.4
2. Line Item ‘0009’ doesn’t have a secondary Line item that includes moving furniture as Line Item number 14 and 15 do (28/30OZ and move furniture). Will that be amended? Corrected
Clin #0009,1009, 2009 ,3009 and 4009 Extended Description Now reads “INSTALL MODULAR CARPET TILE 24 INCHES X 24 INCHES AND TO REMOVE AND REINSTSTALL FURNITURE "ALL QUANTITIES ARE ESTIMATED"IINSTALL MODULAR CARPET TILE 24 INCHES X 24 INCHES AND TO REMOVE AND REINSTSTALL FURNITURE” "ALL QUANTITIES ARE ESTIMATED"
3. Please define ‘Move Furniture’. In most cases, projects require: remove furniture to include disassembly thereof, relocate to acceptable area or store furniture, upon completion reassemble/reinstall furniture. Furniture attached to the building by any means, brackets or otherwise, is that furniture included? Please define furniture IE; Cubicals, temporary walls etc – what is expected under the term ‘move furniture’. How are Safes, water bubblers, oversized - delicate plants to be treated? Government responsibility or Contractor? SEE para 5.12.5 and 2.1.9.4. In short if it’s bolted to the floor or wall, don’t move it.
See customer walk thru issues
4. Line items ‘0004’, ‘0005’, ‘0006’ and ‘0009’ (install carpet, 28oz,30oz, staircase, modular) are we to assume that material is vendor provided material only? (IE Government is not requesting material in their inventory to be installed and warrantied). Carpet shall be provided by the contractor.
Abide by NYS standard
6. Line item ‘0011’ (Multi seat removal). Is the estimate supposed to portray cost per hour for moving 100 seats? (document says “HOURS” under unit qualifier, should this be per hour?) NEED to verify prior
The proper unit of measure is represented in HOURS. For any clin the quantity and unit of issue/measure are linked. This clin reads a quantity of 100 and a unit of measure in hours. We have a maximum qty of 100 hours and that is for the entire base period. As explained earlier this is a requirements contract and all quantities are not known but rather estimated. The contractor shall submit a price based upon hours. For example if the contractor bid price submitted was $1 , then for each hour of work you could invoice $1. If a Task Order was issued and you agreed that the work could be done in 5 hours, then you’d be held to that rate of 1 dollar an hour. This is not for a set number of seats. See also para “2.1.9.5 The CLINS #0011, 1011, 2011, 3011 and 4011“Remove and Replace multi-seating arrangements” will be based on an hourly rate. This clin applies to auditoriums, chapels, and lecture rooms with multi-seating.” SEE ALSO PARA “5.4.2 Preliminary Site Investigation: Prior to issuance of the task order, the Contracting Officer’s Representative shall schedule a preliminary site visit with the Contractor to determine and jointly agree on the following:
Field measurements: quantities of materials needed Quantities for all CLINS are estimated.
Existing layout of office furniture locations
Existing site conditions
Time required to complete each job”
7. Is there a scheduled site visit? A site visit was held on Tuesday 16 May and was posted on FBO.GOV in advance of the RFI being properly answered.
8. Is it the contractor’s responsibility to provide on-site storage space for furniture and other items?
Yes the contractor is responsible yet prior coordination with the COR should resolve the issue. While each situation is different, I’d be willing to be that we could find a spot or perhaps allow ½ of room/area to be completed at a given time. This can be coordinated in advance when the contractor performs a walk through with the activity and the COR.
9. If West Point provides storage space, is it going to be adjacent to each task order location or central to the campus (will there be significant transport distance to the storage space)?
See above. It is not anticipated that furniture would need to be moved a long distance or across post.
10. Item 5.1 states. "Work is to be performed at various locations throughout West Point including public buildings consisting of administrative, academic, support offices, hallways, lecture rooms, auditoriums and chapels. Lecture rooms, auditoriums and chapels generally have multiple seating arrangements." Are the seating arrangements permanently/semi-permanently fixed to the floor?
Yes in lecture halls and auditoriums etc, chairs are attached to the floor with screw or bolts that can easily be removed.
11. Item 5.3 states that the contractor is responsible for the removal of furniture. Is the contractor also responsible for reinstalling all furniture?
Yes the contractor shall remove and reinstall all furniture removed for the performance of the designated work. See also para 2.1.9.4 It shall be understood for each Contract Line Item (CLIN), the Contractor shall be required to do all necessary removals, reinstallation of same and preparatory work and furnish all labor, material, equipment, moving office furniture, etc. which shall be included in the unit price item. (This has been changed to show reinstallation as part of the requirement.)
12. Will there be designated space for dumpster and material storage?
Yes prior coordination with the COR is required and all your requirements will be satisfied. Keep in mind that material storage is limited to the work being performed and is not a long term storage option.
13. 5.5 Face Carpet Materials:
5.5.1 New carpet face materials shall contain a minimum of 25-100 percent of post-consumer content and a total recovered material content of 25-100 percent.
Answer: This will be further researched and a proper reply posted prior to closing of the bid. If anyone believes this is too restrictive, please contact me ( Dave Ariosto-MICC-West Point) and submit another RFI with better guidance and or suggested language.
14. Please verify carpet dimensions per 5.6.2
This was changed to read 5.6.2 Minimum carpet thickness shall be .130 inches.
15. Please confirm that the Federally required wage rate for carpet installers is listed under the Wage Determination that begins on page 66 and that the rates provided under 52.222-42 on page 121 are to be disregarded for this purpose.
(Our understanding is that either the Carpenter, Maintenance or Carpet Layer wage rates will be the required wage rates along with the additional Health & Welfare, Vacation, and Holiday fringe benefits. If another contractor bids using the 52.222-42 wage rates, their labor would start off 30-50% lower than those using the Wage Determination.)
The information listed in FAR Clause 52.222-42 is not a Wage Determination
52.222-42 STATEMENT OF EQUIVALENT RATES FOR FEDERAL HIRES (MAY 2014)
In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor (29 CFR part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.
"THIS STATEMENT IS FOR INFORMATION ONLY: IT IS NOT A WAGE DETERMINATION"
The contract to be awarded as a result of the solicitation W911SD-17-B-0003 will be a service contract award and the most current version of the US DOL Wage Determination in Effect will be applicable. The McNamara–O'Hara Service Contract Act of 1965 (SCA)( or as revised) applies and this will not be awarded using the Davis Bacon Act. In simplified terms, this is a Service and is not Construction. Wages are required to be paid IAW the SCA.
16. ) Please confirm whether the broadloom is to be made from nylon fiber or whether it would be it acceptable to use alternate types? (Our understanding is that West Point prefers if not requires nylon, but our understanding of the spec as written would allow for alternate types to be furnished and installed.)
Follow the spec as written and I’ll seek further clarification.
