Period of Performance: 23 October 2018 to 22 December 2018 Total Value: (Estimated value)
4. Authority Cited: 10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1 – “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”
5. Reason for Authority Cited:
As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
K Clean/ Swipe Rite is performing under the current contract, W9124J-17-C-0031 which expires on 22 Oct 2018. The follow on contract, solicitation W911S8-18-R-0004, is expected to be awarded . Only K Clean/Swipe Rite is capable of full performance with no phase in and providing a seamless transition, phase out, with the new contractor in a two month period.
Alternatives:
(1) Suspension of services: Fort Bliss has approximately 380 buildings (3.6 million sq ft) that require routine cleaning and custodial services to maintain sanitary levels of cleanliness. Contracted services ensures restrooms are clean, and stocked and ensures Soldiers, employees and visitors of Fort Bliss live and operate in a healthy
Version – February 2017 FOR OFFICIAL USE ONLY 4 o f 8 environment. Temporarily suspending contracting services, an alternative that does not ensure sanitary and healthy living conditions, is not a viable alternative. OPORD 15-089.
(2) Use in-house resources: The Government has historically relied on contract support to provide custodial functions. DPW does not have the personnel authorizations to perform the work and military personnel are dedicated to Army Mission directives and are not available to perform custodial duties.
(3) Competitively award a separate contract: Attempting to award a competitive requirement is not a viable alternative. Market research demonstrates that 16 companies showed interest in an award, however, none of the 16 companies demonstrated historical or current capability to ramp up to full performance by 22 Oct. 18. This increases the risk of failure beyond a limit that can be mitigated, and is not acceptable to the Contracting Officer or the Customer.
6. Efforts to Obtain Competition: IAW PGI 206.302-1(d) a Request for Information (RFI) to inform potential offers of this contract action was posted on FedBizzOps for a period of 15 days;
20 Sept to 5 Oct 2018. Amendment 01, posted 25 Sept 2018, changed the Full Performance date from 22 Nov 2018 to 22 Oct 2018. The chart below shows the vendors that responded to both the original RFI and to the amendment.
Version – February 2017 FOR OFFICIAL USE ONLY 5 o f 8
Version – February 2017 FOR OFFICIAL USE ONLY 6 o f 8
The Request for Information stated two requirements
1. Interested companies who have extensive, proven experience in providing custodial services. Supporting information must be recent, within 5 years, and relevant, no less than half of building and square feet quantity. (This must be supported as part of the response).
2. The ability to propose, mobilize, and reach full performance capacity by 22 Oct 2018. Any extension may cause a break in service and will not be considered. (This must be supported as part of the response).
One vendor, , provided past performance that indicated the performance of at least
1.8 million sq. ft (at least half of this requirement) of custodial services in the past 5 years. All other vendors failed to indicate the appropriate past performance.
None of the vendors provided information that would demonstrate to the Government that it had successful, or any, experience and capability to reach full performance of this or any contract in the advertised limited time: Full performance by 22 October 2018 (17 days after FBO close). The Ft. Bliss mission will be put at risk if a different vendor was awarded this 2 month extension.
7. Actions to Increase Competition: This is a bridging action to allow for completion of a solicitation that has closed and is being evaluated. Vendors proposed on the new award, and competition has been met.
8. Market Research: Market Research for this requirement using NAICS Code 561720 (Janitorial Services) was completed for the follow on contract to determine the interest and capability of small business firms with the knowledge, experience and business acumen commensurate with the level of effort required.
The Government has determined that only the incumbent can perform the requirements of this acquisition at a fair and reasonable price and without a break in service.
9. Interested Sources: In accordance with (IAW) the DFARS 205.205-71, DFARS 206.302-1(d) and PGI 206.302-1(d), MICC-JBLM posted a sources sought notice to FedBizOpps on 20 September 2018 for 15 days. The sources sought notice specifically asked respondents to address their ability to mobilize after award and be at full performance in accordance with the requirements described in the PWS by 22 October 2018 (17 days after FBO posting close).
Additionally, the sources sought asked respondents to provide proven experience in providing custodial services that be recent, within 5 years, and relevant, no less than half of building and square feet quantity. MICC-JBLM received timely responses to the sources sought notice. None of the respondents provide information that demonstrated any historical or current capability to meet this requirement. The contracting officer has determined that awarding the extension to the incumbent is the lowest risk to mission failure, and the only viable option to avoid a break in service.
