16.1 Adjustments will be made to the unit price and extended to the total price paid to the Contractor for Tasks 1, 2, 3, 4, 5, 6, 7, 19, 29, 30 and 44 if the latest Monthly Fuel Index and/or Asphalt Price Index, as posted on the MODOT website, on the date a Delivery Order is issued, has fluctuated from the indexes posted on said website on the date of the bid opening for this contract. The MODOT website to be used is found at http://modot.org/business/contractor_resources/bidOpenIndex.shtml. Select the latest Bid Letting Date that has posted indexes and then select the links “Asphalt Price Index” and “Monthly Fuel Index”. The price adjustments will be calculated as described in Paragraphs 16.2 and 16.3. The price adjustments for fuel and asphalt will then be added to the Unit Price for the Tasks listed above in this paragraph that are used in the issued Delivery Order for the work being performed. The price adjustments may result in an increase or decrease in the unit price of the Tasks
01010-6 depending on the change in the indexes.
16.1.1 Price Adjustment for Fuel: The price adjustment for fuel used in application of asphalt will be based on a Fuel Usage Factor for Production of 2.65 gal/ton of Total Mix and a Fuel Usage Factor for On-Road Hauling of 0.67 gal/ton of Total Mix for a total Fuel Usage Factor of 3.32 gal/ton. This factor will be divided by 9 (nine) to give a factor of 0.37 gal/sq. yd. for a 2” asphalt course. A factor of 0.74 gal/sq. yd. will be used for a 4” asphalt course. The Fuel Usage Factor in gal/sq. yd. will be multiplied by the change in the Monthly Fuel Index as described in Paragraph 16.1. The resulting price adjustment will then be applied to the Unit Price for the appropriate Tasks.
A = B X (C – D)
Where: A = Adjustment for fuel used in application of asphalt
B = Fuel Usage Factor (0.37 for 2” course of asphalt, 0.74 for 4” course of asphalt)
C = Monthly Fuel Index on the date of commencement of work
D = Monthly Fuel Index on the date of bid opening for this contract.
16.1.2 Price Adjustment for Asphalt: The price adjustment for asphalt will be applied to the actual amount of asphalt binder used by the Contractor for the Tasks listed in Paragraph 16.1. The change in the Asphalt Price Index, as described in Paragraph 16.1, will be divided by 9 (nine) to obtain a price/sq. yd. for a 2” asphalt course. The adjustment factor for a 4” asphalt course shall be twice this amount. The percentage of virgin asphalt as shown in the job mix formula submitted by the Contractor, in accordance with SEC 403 (2004) Missouri Standard Specifications for Highway Construction - Asphaltic Concrete Pavement, will be the basis for adjustments for any asphalt mix type placed. The effective asphalt obtained from the use of recycled asphalt pavement (RAP) will not be eligible for adjustment. To determine the adjustment for asphalt the following formula will be used. The resulting price adjustment will then be applied to the Unit Price for the appropriate Tasks.
A = B X (C – D) / 9; for a 2” asphalt course
A = B X (C – D) / 4.5; for a 4” asphalt course
Where: A = Adjustment for asphalt
B = % of virgin asphalt binder as listed in the job mix formula in use
C = Asphalt Price Index on the date of commencement of work
D = Asphalt Price Index on the date of bid opening for this contract.
16.2 Price Adjustment Modifications: In the event there is a delay of at least 30 days between the date the Delivery Order is issued and the work starts either the Contractor or the Government may request a modification based on changes in the Monthly Fuel Index and/or Asphalt Price Index, as posted on the MODOT website, since the Delivery Order was issued. No work will proceed until the modification has been issued by the Contracting Officer. The price adjustments will be made as described in Paragraphs 16.1.1 and 16.1.2 except the indexes on the date the Delivery Order was issued will be substituted for the indexes on the date of the bid opening for this contract
01010-7 as illustrated in Paragraphs 16.2.1 and 16.2.2.
16.2.1 Price Adjustment for Fuel:
A = B X (C – D)
Where: A = Adjustment for fuel used in application of asphalt
B = Fuel Usage Factor (0.37 for 2” course of asphalt, 0.74 for 4” course of asphalt)
C = Monthly Fuel Index on the date of commencement of work
D = Monthly Fuel Index on the date the Delivery Order was issued.
16.2.2 Price Adjustment for Asphalt:
A = B X (C – D) / 9; for a 2” asphalt course
A = B X (C – D) / 4.5; for a 4” asphalt course
Where: A = Adjustment for asphalt
B = % of virgin asphalt binder as listed in the job mix formula in use
C = Asphalt Price Index on the date of commencement of work
D = Asphalt Price Index on the date the Delivery Order was issued.
