LOCAL INSTRUCTIONS
G1. POST AWARD ORIENTATION
A Post Award Orientation will be scheduled by the Contracting Officer after contract award and prior to commencement of work. The Contracting Officer will notify the Contractor of the time and date set for the meeting that will be held at Fort Leonard Wood, MO. At this meeting, the Contractor will be oriented with respect to Government procedures and line of authority, as well as contractual, administrative, and performance matters. The Contractor is required to furnish a Certificate of Insurance.
G2. RESPONSIBILITY FOR ADMINISTRATION OF CONTRACT
The Mission Installation Contracting Command, Fort Leonard Wood (MICC – FLW), MO is responsible for the administration of this contract. The Contracting Officer alone is authorized to take action on behalf of the Government, which results in changes in the terms of the contract, including deviations from specifications, details and delivery schedules.
G3. RESPONSIBILITY FOR ISSUANCE OF DELIVERY ORDERS AND FREQUENCY OF DELIVERY
ORDERS
All delivery orders will be issued monthly by the Contracting Officer, MICC – FLW, MO. 8112 Nebraska Avenue, Fort Leonard Wood, MO 65473. The delivery order serves as the contractors notice to proceed for the period of performance specified. The delivery order will provide estimated cost of supplies to be delivered by the Contractor during the time period specified in the order. COR will notify the contractor of the estimated quantities expected to be delivered each month. Such estimates are not firm commitments. The Government is not obligated to pay for any deliveries that are made without the contractual coverage of a valid delivery order.
G4. QUANTITY ESTIMATES
The quantities contained on the task list/bid schedule represent the Government’s best estimate of its requirements for the period of contract performance. The Contractor acknowledges that each CLIN quantity stated on a task orders an estimated quantity; and the Contractor will only be paid for actual quantities ordered, received and accepted by the designated Government inspector. The Government reserves the right to order quantities in excess of the stated estimated quantities on the Bid Schedule. However, such quantities shall not exceed 100% of the total estimated contract dollar amount. It is estimated that the Government’s requirements for any additional quantities of work for each task list item will be in approximately the same proportions that each item currently bears relative to the entire estimate; however, mathematical precision is not required. The Contractor shall perform work on these quantities at the same bid price. The Contractor’s lack of receipt of quantities shall not create an entitlement to an equitable adjustment from the Government.
G5. ORDERING PROCEDURES
The Contracting Officer shall issue a delivery order on a monthly basis using an estimated average price per gallon of propane and an estimated quantity of propane that it is anticipated will be needed for the tanks listed in TE-2 of the PWS found in Attachment III.
Quantity of Propane Delivered: The Contractor shall monitor tank levels and deliver fuel for tanks as per the procedures specified in paragraph 5.4 of the Performance Work Statement. The Contractor shall keep track of the total quantity of propane gas supplied during each month and notify the Contracting Officer when the total quantity supplied in a given month reaches 75% of the estimated quantity for which funds have been obligated on the corresponding delivery order. The Contractor shall not deliver propane in excess of the quantities specified on any monthly delivery order, until and unless given notification from the Contracting Officer that additional funds have been obligated to cover the remainder of the month.
Price per Gallon of Propane Delivered: The price charged for propane gas shall be subject to adjustment on a monthly basis. The initial bid price for SubCLINs 0001AA, 1001AA, 2001AA, 3001AA and 4001AA shall be the price proposed in the IFB. After the initial 30 day contract period the Contracting Officer shall adjust the commodity price for all propane delivered during each subsequent 30 day period on a monthly basis. Each monthly adjustment shall be based on the average pipeline price of propane gas during the previous month. The previous month average price (PMAP) shall be the benchmark price for all propane delivered during the following month.
The PMAP shall be utilized to make limited adjustments to the final contract price for the current month. At the end of each monthly period, the PMAP shall be used as the next month’s benchmark price. The final monthly price for propane delivered in a particular month will be calculated as provided for in the next paragraph.
A modification will be executed at the conclusion of every month to adjust the cost of propane. The Contractor shall obtain the unit price per gallon of propane from each pipeline on Tuesday and Thursday of each week. Quotes for the daily price per gallon shall be on the letterhead of the pipeline suppliers, and shall be provided to the Contracting Officer the day following the last Thursday of the each month. At no time will the monthly unit price adjustment be more than twenty percent (20%) of the previous month’s average unit price.
The Government's responsibility for making the end of the month price adjustments shall be contingent upon the availability of appropriated funds for which payment for such adjustments can be made. No legal liability on the part of the Government for any such unit price adjustment may arise until funds are made available to the Contracting Officer for payment of such unit price adjustments.
The regional pipelines whose pricing will be utilized in calculating any monthly price adjustments pursuant to this contract are: Enterprise Terminal & Storage in Moberly, MO, NGL Pipeline in Jefferson City, MO, and Conoco/Phillips Pipeline in Mt. Vernon, MO.
Evaluation of Extension: As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the offeror's final option period price to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the base period, first, second, third & fourth options and one-half of the fourth option. Offerors shall not submit a price for the potential one-half year extension of services period.
G6. DOCUMENTATION TO SUPPORT INVOICING
Monday through Friday of each week the Contractor shall provide the Contract Inspector a list of the previous day’s deliveries (Building Numbers and Gallons Per Tank). This list shall be provided no later than 12:00 PM daily. The Contractor’s list of deliveries for Friday of each week shall be delivered to the Inspector no later than 4:00 PM that same day. Daily delivery tickets shall include, at a minimum: date, gallons delivered, tank number for each delivery, meter number on the truck, and truck driver’s signature and clearly printed name. Likewise, any transfers shall be documented in a similar manner, providing gallons transferred and tank numbers identifying transfer from/to.
Delivery tickets should be in quadruplicate; the original and two (2) copies will be turned in to the Directorate of Public Works operations Branch.
