4. Authority:

Action using simplified acquisition procedures (select one):

☒ FAR 8.405-6(a)(1)(i)(B) and 8.405-6(b)(1) Brand Name

For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization).

This is intended to be a Brand N J&A for a specific manufacturer’s equipment. To the best of the government knowledge, these items are manufactured by Schneider Electric, and are only available and installed through Schneider Electric’s authorized vendors.

5. Reasons for Authority Cited: The Underwriters Laboratories (UL) listing for Dugway NECs existing

APC system defines what equipment can and cannot be utilized within the current system in order to maintain its required rating.

-4-

This is a requirement based on UL's published and nationally recognized standards for electrical safety. These safety standards must be maintained and only Schneider equipment is acceptable in the Governments data center and associated operating procedures and certifications. Additionally, only an authorized Schneider Electric APC vendor may install equipment to the existing APC or they will not be allowed to access the firmware.

Schneider Electric APC is Dugway’s existing power management solution for its data center at the NEC. The Department of Public Works (DPW) Subject Matter Experts (SMEs) for power generation and management as well as the current base operations support electricians have determined that utilizing other than Schneider Electric APC replacement parts on its equipment would void current operational and safety SOPs (Standard Operating Procedures) . The government has evaluated the data center for compliance and accreditation standards and identify APC as the only brand name that meets the UL Listing specification requirements to be attached to Schneider Electric equipment.

6. Actions to Increase Competition: Describe efforts made to compete the action, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies. State what actions will be taken to increase competition before subsequent acquisition of the supplies or services is required.

A Sources Sought Announcement will be published in Federal Business Opportunities (FEDBIZOPS), for up to 10 days to gage interest in this requirement. DPG NEC will consider any technically feasible solution offered by any one of the many Schneider Electric authorized vendors, and distributors.

7. Market Research: NEC has contacted the electricians from Tobyhanna Army Depot that evaluated the data center for compliance with data center accreditation standards and identified APC as the only brand name that meets the UL Listing specification requirements to be attached to Schneider Electric equipment.

8. Procurement History:

Previous Purchase Order or Contract: Yes No If Yes:

Was action competed? Yes No If action was not competed, summarize rationale:

9. Additional Information to support the justification. A sources Sought will be posted on FBO. A market research report will be completed with pertinent information about capabilities, socio-economic categories, business size, etc. to determine potential vendors.

10. Technical / Requirements Certification: I certify that the supporting data under my cognizance which is included in this abbreviated J&A is accurate and complete to the best of my knowledge and belief.

11. Fair and Reasonable Price Determination: As contracting officer, I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on price realism for labor, parts, travel, profit and G&A. Should there be competition, price reasonableness and or competition will be analyzed. In accordance with 15.403-4, certified cost and pricing data is not required for this requirement since the estimated monetary value is below the $700,000 regulatory threshold.

12. Reviews: I have reviewed this justification and find it adequate to support other than full and open competition.

13. Contracting Officer’s Approval: I hereby certify that this justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition.
