4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by the following:

FAR 8.405-6(a)(1)(i)(A). An urgent and compelling need exists, and following the procedures would result in unacceptable delays.

FAR 8.405-6(a)(1)(i)(B). Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

FAR 8.405-6(a)(1)(i)(C). In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with applicable Federal Supply Schedule ordering procedures. The original order or BPA was not previously issued under a sole-source or limited-sources procedures.

FAR 8.405-6(b)(1). Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

5. Reason for Authority Cited:

The original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. GS-35F-0465X.This requirement was competed via GSA-STARS II and as a Best Value to the Government evaluation process.

1. The work is logically grouped in sets. An example is scanning and patching network based computers. This process is accomplished through the use of any one or more of the Help Desk technicians to scan and patch the network in logical groups. The size of the team that will be used on any such scan-and-patch event is based upon the results of the initial scan.

Therefore the size and composition of the team will be event dependent and is likely to change often. The workload has increased significantly due

Version – September 2018 FOR OFFICIAL USE ONLY to emerging and unforeseen requirements, thus the size of the team must also increase.

Negative Effect: Having a primary contractor with 6 technicians and a secondary contractor with 1 technician will lead to difficulties due to 2 separate lines of supervision, 2 separate communications processes including possible proprietary methods, and delays in work being performed due to scheduling issues between the 2 companies.

Furthermore, contract oversight for 2 contractors rather than 1 will lead to difficulties in assigning ratings. Problems such as which company takes credit, conflict between contractors, companies conflicting time-off policies, etc., are unnecessary but inevitable and would lead to difficulties in establishing a cohesive team atmosphere and degrade the likelihood of accomplishing the tasks required. The same set of problems exists with the Network Engineer position due to the size of the team being dependent on event specific parameters.

2. The PWIDS software that is currently employed for weather data collection was developed over a decade ago. It was designed to be deployed on platforms using Windows XP. Evolving cyber security threats and the emergence of Windows 7 and 10 have forced Windows XP systems to be retired, and PWIDS does not run successfully on later Windows versions.

The MIST software which will replace PWIDS will be deployed using Windows 10.

If a traditional full and open procurement process is used to retain software development services, the time required to establish a new contract and then develop the software will exceed the time remaining that PWIDS can be used.

Without a weather data collection platform, Dugway Proving Ground will not be to conduct tests on a preponderance of equipment for which it is responsible.

This would severely impact the deployment time of vital materiel for the warfighter.

Cost Benefits: There is no expectation that competing this additional work would result in any significant cost savings. The overall increase of the contract is approximated to be 6%. Duplicating overhead costs of management, office space, general and administrative would add approx. 15% to estimated labor requirement over and above what would be absorbed in the current contract. A separate action would also incur cost to the government to include: Contracting for a new requirement, contracting officer representative oversite, duplicative budgeting/resource planning, etc.

Alternatives: The government has considered use of in-house personnel/expertise, however, such skill sets to not exist in any quantity or diversity. The existing work is not inherently governmental and this additional work within scope is no different.

Version – September 2018 FOR OFFICIAL USE ONLY

Impact if Modification Not Completed: Over the past year improvements in the technologies and methodologies employed in the conduct of testing for WDTC have necessitated additional IT resources. That, in turn, has increased the workload in preparing the IT assets for deployment, configurations, maintenance, updates, security scans, additional accounts, troubleshooting, repair, and/or replacements, etc. This increase in work is currently causing delays and scheduling issues as the customer (WDTC) must work around the now limited resources. The WDTC Customer states “Unpredictable and constant emerging requirements have arisen that require immediate additional personnel. This shortage of support is creating delays in testing, and ultimately the mission of DPG. All delays in testing result in higher monetary costs, conflicts in the test schedule, a ripple effect delaying further tests, and ultimately delay the deployment of equipment to DPG Customers”.

DPG WDTC supports itself with customer funding. Shortfall in the ability to conduct testing, which would be supported by this additional/supplemental work within scope, would directly impact the income of the WDTC. This lost amount of capability would result in a direct loss of potentially millions of dollars.

The government would not expect to offset the loss in potential revenue to the WDTC, with the cost savings potential should this amount of increase be separately competed.

6. Actions to Increase Competition: Any follow on contract for this requirement would include this additional workload. Since the current effort has been successful, FAR Part 8 and GSA would be considered again. A sources sought document would be posted on GFE and would include all potential work.

7. Market Research: N/A

8. Other Facts: DPG is a remote and isolated location. Staffing with most labor categories is difficult and more costly. DPG is located approximately 65 miles from a large technology center in Lehi/Alpine, Utah. Since this requirement is not contemplating this additional work through the end of the requirement (approx. 3 ½ years), the total dollar amount and magnitude of the contract does not lend itself to a re-compete. Also, the PWIDS work with the DPG MET may not continue for the duration of the contract.

This was a large factor in modifying the current contract VS pursuing a separate action.
