The wage decision may not contain all positions that are applicable to the features of work in the contract; therefore for any work classifications or positions that are not included, the wage rates must NOT be lower than the lowest skilled rate that is included in the wage decision.

Under no circumstances will any resulting contract be modified to increase the contract price solely on adjustments or changes in any wage rates or due to any conformance action, to include a missing classification. The Davis-Bacon Wage Decision included in Exhibit B will be updated annually.

Bidders will use that amount as the total amount of the Contract in order to bid its Performance and Payment bonds Estimate. The TOTAL ESTIMATED PERFORMACE AND PAYMENT BONDS shall be added to Exhibit A, item T4. The Total Estimated Performance and Payment Bond will determine a bonding rate in percentage terms that will be used to calculate the task order bonds amount. 52.222-32 CONSTRUCTION WAGE RATE REQUIREMENTS--PRICE ADJUSTMENT (ACTUAL METHOD)

(AUG 2018)

(a) The wage determination issued under the Construction Wage Rate Requirements statute by the Administrator, Wage and Hour Division, U.S. Department of Labor, that is effective for an option to extend the term of the contract, will apply to that option period.

(b)(1) The Contractor states that if the prices in this contract contain an allowance for wage or benefit increases, such allowance will not be included in any request for contract price adjustment submitted under this clause.

(2) The Contractor shall provide with each request for contract price adjustment under this clause a statement that the prices in the contract do not include any allowance for any increased cost for which adjustment is being requested.

(c) The Contracting Officer will adjust the contract price or contract unit price labor rates to reflect the Contractor's actual increase or decrease in wages and fringe benefits to the extent that the increase is made to comply with, or the decrease is voluntarily made by the Contractor as a result of--

(1) Incorporation of the Department of Labor's Construction Wage Rate Requirements wage determination applicable at the exercise of an option to extend the term of the contract; or

(2) Incorporation of a Construction Wage Rate Requirements wage determination otherwise applied to the contract by operation of law.

(d) Any adjustment will be limited to increases or decreases in wages and fringe benefits as described in paragraph

(c) of this clause, and the accompanying increases or decreases in social security and unemployment taxes and workers' compensation insurance, but will not otherwise include any amount for general and administrative costs, overhead, or profit.

(e) The Contractor shall notify the Contracting Officer of any increase claimed under this clause within 30 days after receiving a revised wage determination unless this notification period is extended in writing by the Contracting Officer. The Contractor shall notify the Contracting Officer promptly of any decrease under this clause, but nothing in this clause precludes the Government from asserting a claim within the period permitted by law. The notice shall contain a statement of the amount claimed and any relevant supporting data, including payroll records that the Contracting Officer may reasonably require. Upon agreement of the parties, the Contracting Officer will modify the contract price or contract unit price in writing. The Contractor shall continue performance pending agreement on or determination of any such adjustment and its effective date.

(f) Contract price adjustment computations shall be computed as follows:

(1) Computation for contract unit price per single craft hour for schedule of indefinite-quantity work. For each labor classification, the difference between the actual wage and benefit rates (combined) paid and the wage and benefit rates (combined) required by the new wage determination shall be added to the original contract unit price if the difference results in a combined increase. If the difference computed results in a combined decrease, the contract unit price shall be decreased by that amount if the Contractor provides notification as provided in paragraph (e) of this clause.

(2) Computation for contract unit price containing multiple craft hours for schedule of indefinite-quantity work. For each labor classification, the difference between the actual wage and benefit rates (combined) paid and the wage and benefit rates (combined) required by the new wage determination shall be multiplied by the actual number of hours expended for each craft involved in accomplishing the unit-priced work item. The product of this computation will then be divided by the actual number of units ordered in the preceding contract period. The total of these computations for each craft will be added to the current contract unit price to obtain the new contract unit price. The extended amount for the line item will be obtained by multiplying the new unit price by the estimated quantity. If actual hours are not available from the preceding contract period for computation of the adjustment for a specific

W911S219B8001 contract unit of work, the Contractor, in agreement with the Contracting Officer, shall estimate the total hours per craft per contract unit of work.

Example: Asphalt Paving--Current Price $3.38 per Square Yard Hourly Increase/DBA craft New WD rate paid Diff. Actual hrs. Actual units (sq. yard) sq. yard Equip. Opr.... $18.50 - $18.00 = $.50 x 600 hrs./ 3,000 sq. yrd. = $.10

Truck Driver. $19.00 - $18.25 = $.75 x 525 hrs./ 3,000 sq. yrd. = $.13

Laborer......... $11.50 - $11.25 = $.25 x 750 hrs./ 3,000 sq. yrd. = $.06

Total increase per square yard.......................................................................................................... * $.29

* Note: Adjustment for labor rate increases or decreases may be accompanied by social security and unemployment taxes and workers' compensation insurance.

Current unit price (per square yard) $3.38 Add DBA price adj................... +.29 New unit price (per square yard).... $3.67

SECTION 00800 - SPECIAL CONTRACT REQUIREMENTS

The following have been added by full text:

RFI QUESTIONS AND RESPONSES

RFI Responses: W911S2-19-B-8001 Traffic Control Painting, Cantonment Area Ft Drum.

1. In the SOW, Para SW-4 states “…….Although the contract does not explicitly identify roads, lanes, or parking areas, or other areas to be painted or repainted, the Contract bid schedule is structured to order quantities of materials sufficient to accomplish all work required to provide a completed project……” It appears CLINs 0001AA & 0001AB explicitly identify roads, etc.

• Will CLINs 0001AA & 0001AB be accomplished on a yearly basis as a lump sum? If not a yearly basis what is the anticipated frequency for these CLINS?

Response: Historically a single order has been placed on annual basis.

• Will CLIN 0002 (sub CLINS) be ordered in conjunction with 0001AA & AB or could they be used as a standalone task order?

Response: CLIN 0001AA & AB will be ordered separate from CLIN 0002. CLIN 0002 is anticipated to be ordered on separate task orders.

2. What is the anticipated number of Task Orders issued per year (or mobilizations)?

Response: Historically one task order per year has been issued.

3. The solicitation states a $2000.00 minimum order, the mobilization cost could easily exceed that amount due to the equipment involved. With this in mind, If multiple mobilizations are anticipated per year, will the Government consider adding a Mobilization CLIN?

Response: Historically one mobilization per year has been utilized. A mobilization CLIN will not be added.

4. Is there a specification for the paint and reflective beads (i.e. TT-P-1952E)?

Response: No, contractor will have to submit the material they plan to use for review and approval.

5. The solicitation attachments has (2) .mxd extension files and (2) .dgn extensions files. It appears these files can only be opened with the associated program (no viewer available) Can the Gov please furnish these file in a PDF or similar format?

Response: All files included in the .mxd and .dgn formats are already available in PDF.

6. Exhibit A - Detailed Pricing Schedule. In cell B5 it stated - " As shown in attachments 1 thru 37" - Where are attachments 1-37? They are not on the FOB

Response: Please reference the attachment table of contents located on page 44 of the solicitation for drawing references.

7. Exhibit A- Detailed Price Schedule. Estimating quantity in cell C5 - Does the 5 represent 5 years?

Response: This represents an estimated quantity of 5 each over the lifetime of the order period which is five years.

8. Item 0001A - Lines 6-27 - Is this the area in total based on the quantities represented times 5 years?

Response: Quantities of lines 6-27 under CLIN 0001A represent a single unit of work, of which a summation will be entered as the unit price in cell F5. The estimate quantity for that unit of work is noted as 5.

9. 0001B - All the same questions as above?

W911S219B8001

Response: Quantities of lines 29-41 under CLIN 0001B represent a single unit of work, of which a summation will be entered as the unit price in cell F28. The estimate quantity for that unit of work is noted as 5.

10. Where are attachments 38 & 39?

Response: Attachments 38 & 39 are located on the FBO posting for this solicitation under Drawing CP 135 and CP 136.

11. Can you provide clarification on the wage classification (rate and fringe) to use for the application/removal of road marking/striping? The provided Exhibit B Wage Determination Heavy Highway Jefferson County NY does not specifically note a classification for the work to be performed. The Painter and Laborer classifications in the wage determination do not speak definitively to road marking/striping. Given the large difference in rates and fringe values, using the wrong classification could either severely overstate or understate our bid.

Response: The specific wage rate selected must fit the local area practice for the work being performed by that individual. Wage rates must be found within Exhibit B. The Laborer classification is appropriate for road marking and striping.

The following have been modified:
