Control No. 019-14

SOLE SOURCE JUSTIFICATION (Including Brand Name)

1. Agency/Contracting Activity: MICC- Fort Drum

2. Description of Action:

Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time & Materials Cost

Funds: OMA Other Funds:

3. Description of Services or Supplies:

The total estimated value of the proposed action is $

Procurement of Animal Control Services for the Directorate of Public Works (DPW), Municipal Services Division. It is anticipated that the need for these services will continue for the foreseeable future in order for DPW to effectively manage the stray pet population on Fort Drum. The anticipated Period Of Performance (POP) is a base, plus four option years beginning 1 October 2014. The estimated amount for the base plus four option years is $261,879.00.

4. Authority:

Action using simplified acquisition procedures (select one):

FAR 13.106-1(b)(1)(i): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization)

FAR 13.106-1(b)(1)(ii): Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring the brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand-name.

FAR 13.501(a)(1)(ii): For actions for commercial supplies or services greater than the SAT but not exceeding $6.5M, the correct citation is: Test Program for Commercial Items, Section 4202 of the Clinger-Cohen Act of 1996 as codified at 10 USC Sec. 2304(g)(1)(B), and amended by Section 807 of the Ronald Reagan National Defense Authorization Act of 2005.

5. Reasons for Authority Cited:

a. Only one source can meet the Governments needs. This requirement is restrictive to local Contractors in the communities where Fort Drum Soldiers live, due to the requirement that the Contractor shall be able to properly care for the animals while being able to advertise the recovered animals and return a lost pet to an owner within the Fort Drum community.

Additionally, the Government has to have the ability to drop the animals off at the shelter.

6. Actions to Increase Competition: A sources sought on FedBizOpps.gov and a Dynamic Small Business Search in the area surrounding Jefferson County showed that the market has not changed since the last single source solicitation and award for these services in September of 2010. The Jefferson County SPCA is still the only contractor with the interest and the capability of meeting the Governments needs for this service. IAW FAR 13.5 – Commercial Items Test Program, this procurement will be solicited and awarded on a single source basis.

7. Market Research: A sources sought notice was posted 6 February 2014 with a response date of 8 March 2014 for interested party submissions. No responses were received from the sources sought notice. A search of the SBA’s Dynamic Small Business Search site resulted in no small businesses in New York State under NAICS 812910 - Pet Care (except Veterinary) Services. There are no small businesses within the required area capable of providing this service. Previous procurement number W911S2-10-D-3002 was solicited from a single source when there were no responses to a sources sought notice, and only one quote received from an open market, unrestricted solicitation. Sources sought notice number W911S214B3001 was issued on 6 February 2014 with no responses to date. The Jefferson County Society for the Prevention of Cruelty to Animals (SPCA) has successfully preformed these services for Fort Drum under contract numbers W911S2-09-D-3001 and W911S2-10-D-3002. Market research has shown that there is only one source that can meet the Government’s needs; therefore this procurement will be solicited to the Jefferson County SPCA, a non-profit organization.

8. Procurement History:

Previous Purchase Order(s) or Contract(s): Yes No

If "Yes", for each purchase order or contract provide:

Purchase order or contract number: W911S1-09-D-3001 and W911S2-10-D-3002 Was action competed? Yes No If action was not competed, state the cited authority, summarize rationale, and describe the actions that were supposed to be taken to increase competition and the results thereof:

These procurements were solicited IAW FAR 13.5- Commercial Items Test Program, and awarded on a single source basis to The Jefferson County SPCA after market research determined that this Contractor was the only source that could meet the Governments needs.
