1. CONTRACTING AGENCY: Mission and Installation Contracting Command (MICC) Center, Fort Eustis, VA.
2. DESCRIPTION OF ACTION: Approval is requested to modify the existing firm-fixed-price (FFP) Sustainable Range Program (SRP) task orders to extend the period of performance as stated below:
a. Pursuant to the provisions of FAR 16.505(b)(2)(iii), this is a limited source justification (LSJ) with CALIBRE Systems Inc. and Parsons Infrastructure and Technology Group, the incumbents, as the only sources that can immediately perform the highly technical and critical contract requirement in support of the Army’s SRP program.
b. This proposed action is an interim effort to continue mission critical services to the Sustainment Range Program until a competitive multiple-award Indefinite Delivery/Indefinite Quantity (ID/IQ) Contract can be awarded. The proposed bi-lateral modifications to Task Orders W911S0-04-D-0002-00171, 0173, 0175, 0176, 0177, 0179, 0183, 0184, 0187 and 0190; W911S0-04-D0003-0093, 0094, 0095, 0096, 0098, and 0102 Sustainable Range Program services will be firm fixed price. The period of performance for these task orders is as follows: W911S0-04-D-0002-0171– 28 May 2011 thru 27 November 2011; 04-D-0002-0173- 1 June 2011 thru 30 November 2011; 04-D-0002-0175– 26 June 2011 thru 25 September 2011; 04-D-0002-0176- 17 June 2011 thru 16 September 2011; 04-D-0002-0177– 7 May 2011 thru 6 November 2011; 04-D-0002-0179- 1 August 2011 thru 31 October 2011; 04-D-0002-0183– 26 July 2011 thru 25 October 2011; 04-D-0002-0184– 1 August 2011 thru 31 October 2011; 04-D-0002-0187- 1 August 2011 thru 31 October 2011; 04-D-0002-0190- 18 June 2011 thru 17 September 2011; 04-D-0003-0093– 23 March 2011 thru 22 September 2011; 04-D-0003-0094– 1 June 2011 thru 30 November 2011; 04-D-0003-0095– 5 July 2011 thru 4 October 2011; 04-D-0003-0096- 18 June 2011 thru 17 September 2011; 04-D-0003-0098- 1 July 2011 thru 30 September 2011 and 04-D-0003-0102- 1 August 2011 thru 31 October 2011. The total estimated value of these actions is $5,960,411.68, which will be funded with FY11 OMA funds. The performance period will commence upon the expiration of the current contract/task order to avoid a lapse in the performance of these critical support services until a Task Order against the newly established Training Support System (TSS) multiple-award ID/IQ contracts are in-place on or about September 2011. The extension of the task orders will allow for any unforeseen circumstances that may arise which could delay the award of the TSS contract.
3. DESCRIPTION OF SERVICES:
a. The proposed modifications to the task orders will allow continuation of non-personal services to provide Military Installations, Army Commands (ACOMs), the Installation Management Command (IMCOM) and IMCOM Regions, Army Training Support Center (ATSC), Army Environmental Center (AEC), and Headquarters, Department of the Army (HQDA) with program support for Sustainable Range Program (SRP) implementation and operations in the 50 United States and its territories. SRP, governed by Army Regulation 350-19 effectively supports the management of Army ranges and land assets by:
(1) Supplying a contractual framework to support the linkages that must be in place to have an effective, integrated approach for ensuring the long term capability, availability, and accessibility of ranges and lands that support the Army’s training and testing missions.
(2) Integrating and standardizing contractor support for the Ranges and Training Land Program (RTLP) and the Integrated Training Area Management (ITAM) program.
(3) Integrating contract support with the facilities management, environmental management, munitions management, and safety program to ensure sustained availability and accessibility of the Army’s live-fire training ranges and maneuver training lands.
(4) Providing contract support to effectively identify and mitigate encroachment challenges at all levels.
(5) Working with and supporting HQDA, ACOMS, and IMCOM to support an Army-wide uniform SRP.
b. Currently, there is adequate procurement history available from previous contracts to show a reasonable expectation of cost and hours. Federal Acquisition Regulation (FAR) Clause 52.237-3, Continuity of Services, shall be included in this task order to ensure that services are properly continued without disruption in the event the new task order is awarded to another contractor thus requiring additional phase in/transition time.
4. AUTHORITY CITED: The statutory authority permitting an exception to fair opportunity is Section 803 of the National Defense Authorization Act of 2002 (PL 107-107), FAR 16.505(b)(2) and DFARS 216.505-70(b), Exceptions to Fair Opportunity Process. The modifications are required in the interest of economy and efficiency because it is a logical follow-on to an order that was originally competed between the two awardees of the Sustainment Range Program contract.
5. REASON FOR AUTHORITY CITED: Pursuant to the provisions of FAR 16.505(b)(2)(iii), CALIBRE Systems Inc. and Parsons Infrastructure and Technology Group, the incumbents, are the only sources that can immediately perform the highly technical and critical contract requirement in support of the Army’s SRP program, as discussed in the justification for the proposed extension periods. An award to any other source would result in an unacceptable delay in fulfilling this requirement. Duplication of cost is not expected to be recovered through competition, and would negatively impact the Army’s critical SRP mission. The SRP provides the Army an overarching approach to the design, management, and long-term sustainability of the Army’s training lands and firing ranges. If the SRP program lapses, mission critical training for military personnel lapses, and such a degradation and/or lapse in training is not an acceptable option at a time when Soldiers are required to support Overseas Contingency Operations “on-time” and “fully-trained”. CALIBRE Systems and Parsons Infrastructure and Technology Group are uniquely positioned to immediately provide a workforce with the capability to perform the required services without a break in performance, thereby avoiding any lapse or degradation in a critical Army mission.
The review/approval process of the follow-on TSS contract(s) has caused major delays. As a result, SRP Task Order Performance Periods expiring before award of the TSS will require extensions to allow for continued support. Originally, the Acquisition Strategy Plan for TSS was submitted for review/approval in January 2010; it was approved on 1 July 2010. The Source Selection Plan was approved by the Source Selection Authority (and this is a formal source selection) on 5 November 2010. The solicitation was issued 16 December 2010 and extended twice with a final closing date of 9 February 2011. The Source Selection Evaluation Board convened on 14 February 2011; adjourned 24 February 2011. The Source Selection process is almost complete; however, there are several reviews remaining with an estimated completion/award date on or about September 2011. Since following the normal competitive procedures would not allow for timely award of a bridge contract, this action will allow for continued service with no disruption to SRP support/missions across various installations throughout the United States in order to maintain the availability and accessibility of the training ranges until the TSS contract is awarded.
a. Background: The SRP multiple-award contract suite was solicited unrestricted under NAICS code 541990, Other Professional, Scientific, and Technical Services, with a size standard of $6 Million. Four (4) offers were received resulting in the award of two Indefinite-Delivery Indefinite-Quantity (IDIQ) contracts, with Firm Fixed Price (FFP) task orders, on 16 April 2004, under contract number W911S0-04-D-0002 with CALIBRE Systems and contract number W911S0-04-D-0003 with Parsons Infrastructure and Technology Group, Inc. The suite was awarded for a base year and four (4) one-year option periods, covering the period of 16 April 2004 through 15 April 2009, and included Federal Acquisition Regulation (FAR) Clause 52.217-8, Option to Extend Services. The government exercised its option to extend the suite covering the period of 16 April 2001 through 15 October 2009. No increase to the ceiling of $200M occurred as a result of the extension.
b. A Justification and Approval was accomplished in July 2009 extending the Sustainable Range Program (SRP) multiple award contract from 15 October 2009 through 15 May 2010 with three (3) one month options to continue performance through 15 August 2010, if needed. The option periods would only be used in the event the competitive process for the TSS contract was delayed. The Justification and Approval was approved by the Head of the Contracting Activity, Mission and Installation Contracting Command, 18 September 2009.
c. The original base contracts (W911S0-04-D-0002 and W911S0-04-D-0003), that these task orders were awarded from, have expired and no extensions are possible from these contracts. CALIBRE Systems Inc. and Parsons Infrastructure and Technology Group have been performing work under the Sustainment Range Base Contract from April 2004 through August 2010. The follow-on contract to the Sustainment Range Contract, TSS, has an anticipated award date of September 2011, thus requiring period of performance extensions on current task orders expiring between January 2011 and September 2011. Since following the normal competitive procedures would not allow for timely award of this bridge contract without a lapse or degradation in mission critical services, this Justification and Approval is required to continue services to meet the SRP mission.
d. Alternatives: It is neither cost effective nor realistic to expect another contractor to perform interim support services covered under these task orders to contracts W911S0-04-D-0002 and W911S0-04-D-0003 until the Training Support Services contract is awarded. Based on the dollar value and complexity of the requirement, to competitively solicit and award an interim bridge contract would take additional time and would result in disruption of support from the completion dates, creating an unacceptable mission delay and duplication of cost that is not expected to be recovered through competition.
e. Justification: The incumbent contractors, CALIBRE Systems, 6354 Walker Lane Metro Park, Alexandria, VA 22310 and Parsons Infrastructure and Technology Group, 100 W. Walnut Street, Pasadena, CA 91124 are the only logical sources that can immediately perform contracts of this magnitude and complexity for the extended period without unacceptable mission delays and duplication of costs not expected to be recovered through competition. The requested extensions are the only feasible alternative to obtain the required services until the competitive follow-on TSS contract is awarded. CALIBRE Systems and Parsons Infrastructure and Technology Group have the necessary management and labor structure in place that will ensure continuity of services through the extension period.
f. Impact: Failure to issue the proposed modification extensions will result in mission failure of range operations and total operational forces. Specifically, training services will be interrupted or degraded to the degree that Soldiers will not have the quality training and certifications necessary to complete their mission in the operational Army and in combat. This would put the Army’s overall mission, as well as the individual Soldier’s lives, at risk. If the J&A is not approved, then the Army’s ability to train its soldiers and units is significantly degraded. This contract provides for the management of training lands & ranges and the operation & maintenance of those training lands & ranges. The Integrated Training Area Management (ITAM) Program in the contract provides the Army with the means to meet regulatory compliance as enacted in the National Environmental Policy Act of 1969 (NEPA). The law establishes the national environmental policy including a multidisciplinary approach to considering environmental effects in federal government agency decision making. The ITAM Program operates on all major Army installations enabling Army units to conduct training to meet wartime requirements. The work required under the task orders continue to conduct the business of managing the Army’s 12 million acres of training lands & ranges on 102 installations in order to meet go-to-war mission requirements.
6. MARKET RESEARCH: Market research was not accomplished due to the highly technical and critical requirement and award to any other source would result in an unacceptable delay in fulfilling this requirement. Duplication of cost is not expected to be recovered through competition, and would negatively impact the Army’s critical SRP mission. Consequently, there is not enough time to fairly compete this requirement. This interim modification is only a bridge until the competitive contract is awarded. Extensive market research was conducted for solicitation of the follow on multiple award contract.
7. ACTIONS TO INCREASE COMPETITION: Although this interim bridge modification will not be competed, future acquisitions will be synopsized in FedBizOpps.
8. INTERESTED SOURCES: CALIBRE and Parsons Infrastructure and Technology Group, the incumbent contractors, are the only known sources positioned to immediately provide the required support without disrupting the Sustainment Range Program mission.
9. OTHER FACTORS:
a. Task Orders listed above were awarded to CALIBRE Systems and Parsons Infrastructure and Technology Group with a Period of Performance of 12 months. Modifications to extend the Period of Performance range from two months to six months. An Independent Government Cost Estimate will be provided for each modification and can include Other Direct Costs for Material and Travel. The task orders were competed between the CALIBRE Systems and Parsons Infrastructure and Technology Group of the Sustainment Range Program contract.
b. Subcontracting: A subcontracting plan was required for the contracts. Subcontracting achievement is evaluated on a semi-annual and annual basis.
