ADDENDUM TO FAR 52.212-2

ADDENDUM TO FAR 52.212-2

EVALUATION FACTORS FOR AWARD

This acquisition will be utilizing Lowest Price Technically Acceptable source selection procedures. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability.

Award will be made to the Offeror who is rated “acceptable” in Factor 1 Technical and has the lowest evaluated price, and whose quote conforms to the solicitation requirements (to include all stated terms, conditions, representations, certification, and all other information required by FAR 52.212-2 and its addendum of this solicitation. The Government reserves to the right to award without discussions. Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

The Government intends to select one contractor for this acquisition. However, the Government reserves the right not to award a purchse order at all, depending on the quality of the quotes, prices submitted, and the availability of funds. The Government may reject any quote that is evaluated to be unreasonable in terms of program commitments, contract terms and conditions, or unreasonable cost when compared to Government estimates, such that the quote is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.

Evaluation Factors:

Evaluation factors used to evaluate each quote. Award will be made to the Offeror offering the combination most advantageous to the Government based upon an integrated assessment of the evaluation factors described below:

Factor 1: Technical Acceptability Factor 2: Cost/Price

Factor 1 – Technical Acceptability Each quote will be evaluated for technical acceptability. Failure to meet any terms and conditions will result in an unacceptable technical rating. Each technical rating will be graded as either acceptable or unacceptable.

Rating Description Acceptable -Offeror submitted complete schedule B on a SF 1449 prior to the date/time listed in block 8 of the RFQ -Acknowledge amendment 01 -Offeror has submitted documents required in 52.212-1 and addendum -Offeror has demonstrated undstanding of the requirement in the PWS and has a logical approach to meet the requirement of each of the Line Items.

Not Acceptable -Offeror did not submit complete schedule B on a SF 1449 prior to the date/time listed in block 8 of the RFQ -Offeror did not acknowledge amendment 01 -Offeror has not submitted documents required in 52.212-1 and addendum -Offeror clearly does not understand the requirement of the PWS/does not have a logical approach to meet the requirement of each line item

Factor 2 – Price The offeror’s price quote will be evaluated for award purposes calculating the offeror’s quote for 12 months of service.

(a) Total Evaluated Price. Price analysis will be performed to determine the reasonableness of the Offeror’s price quote. Reasonableness will be based on the total evaluated price. The total evaluated price will be calculated as the sum of the Total Price for all the Contract Line Item numbers (CLINs).

(b) Reasonableness. Price analysis will be performed to determine the reasonableness of the Offeror’s price quote.

Reasonableness will be based on the total evaluated price. The total evaluated price will be calculated as the sum of the Total Price for all Contract Line Item numbers (CLINs).

(c) Unreasonable costs or prices. Unreasonable quoted costs or prices, initially or subsequently, may be grounds for eliminating a quote from competition, either on the basis that the Offeror does not understand the requirement, or the Offeror has made an unreasonable quote.

(d) Unbalanced Pricing. Offeror’s are cautioned against submitting an offer that contains unbalanced pricing.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items. Offers that are determined to be unbalanced may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

Discussions The Government intends to award without discussions, but reserves the right to conduct discussions if necessary.

Therefore, it is imperative that Offerors submit their best terms initially.

Solicitation Requirements – Terms and Conditions Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certification, and mission requirements, in addition to those identified as factors. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide a complete supporting rationale. In the case that a discrepancy exists in the solicitation terms and conditions and the Evaluation Factors for Award, the evaluation criteria in Addendum to FAR 52.212-2 will take precedence.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Technical Acceptability and,

(2) Price.

All offerors will be evaluated and the contract will be awarded to the technically acceptable offeror with the lowest price.

(b) As part of the price evaluation, the government will evaluate its option to extend services (See FAR Clause 52.217-8). Offerors are required to price for one year of service. The Government will administratively price ½ of the offeror’s price and add that amount to the offeror’s quoted price, for a total evaluated price that includes the additional six months.

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
