3. Description of Services or Supplies:

The Ft Hood NEC requires the GENBAND (formerly Avaya) Modularized Extended Support Plan

(MESP) for SL100/CS2100 LTLCS contract to support the telecommunications architecture. This contract is used for technical support for issues beyond the capabilities of Black Box Network Services. NextiraOne Federal, LLC d/b/a Black Box Network Services provides life cycle support for the Nortel/Avaya (now GENBAND) switching systems worldwide under the US Army Long Term Life Cycle Support Contract. GENBAND has changed its Commercial Technical Support Policy and programs. GENBAND will no longer provide technical support on an hourly basis.

GENBAND has instituted a new program entitled Modularized Extended Support Plan (MESP) for SL100/CS2100. TheMESP program offers options for GENBAND end users to acquire the support they need in a modularized fashion. Under LTLCS, our site may have a requirement to access GENBAND remote technical assistance. Based upon the new commercial practices of GENBAND we must pay an annual fee for accessing GENBAND technical support. In order to access GENBAND Technical support, we must still go through Black Box Remote Engineering Support, the same way LTLCS we do today. We will continue to pay for Black Box Technical support in the same hourly manner as we have done in the past. However, in the event that Black Box Engineers are unable to resolve the issue, and Black Box need to escalate to GENBAND Technical Support, MESP must be in place for the system.

Currently, the Ft Hood telecommunications architecture main point of presence is located at building 13, room 127 and building 422, server farm with are eight (8) other locations on the

-2-installations. This support also is used for the power rectifiers and SONET architecture which connects each switch locations.

Support needs to cover:

• 8 x remote switching centers

• 16 x DDM 2000 (SONET)

• 170 x different type of circuit cards

• 8 x different type re-certifiers

• 8 x different type invertors

• 3 x different type muxes

• Switch Expert

• Call Pilot

• ADAS AMCOM

• SL-100 Switch

• CS-2100 Switch

• Batteries

Services Included The following support services will be provided under this Maintenance and Support agreement:

The total estimated value of the proposed action is $213,095.31

4. Authority:

Actions other than simplified acquisition procedures (select one):

FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 USC 2304(c) (1)

-3-

FAR 6.302-2: Unusual and compelling urgency, 10 USC 2304(c) (2)

FAR 6.302-5: Authorized or Required by Statute, 10 USC 2304(c) (5)

Other:

5. Reasons for Authority Cited:

(b) Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw material; or similar circumstances, make the supplies and services available from only one source.

(1) Alternatives: Forgoing the maintenance is the only alternative to already stated maintenance plan. This alternative is not viable because forgoing the maintenance would mean that any issue/outage/equipment degrade that is beyond the capabilities Fort Hood NEC technician potentially not be addressed/nor repaired, which would significantly degrade telecommunications support for Fort Hood, Texas and supported community.

(2) Justification: Without this new support agreement and direct support from the GENBAND Modularized Extended Support Plan (MESP) support for the SL100/CS2100LTLCS, the Ft Hood NEC would assume the risk that Black Box will not need to escalate to resolve switch issues and we would not have an avenue to escalate the trouble issue to GENBAND or any other third party vendor. This means that any issue/outage/equipment degrade that is beyond the capabilities of Black Box could potentially not be addressed/nor repaired, which would significantly degrade telecommunications support for the community.

(3) Impact:

If Black Box does not receive the award, no other vendor will be able to provide the required support to allow for seamless integration of the various platforms that make the SL-100/CS-2100.

Therefore, if another vendor supplied the equipment or third party components, extensive government resources would be required to integrate the unapproved accessories. In addition, the existing telephone system would not perform to specifications, since the system(s) require ready knowledge and strong and varied support network that Black Box has already in place.

6. Actions to Increase Competition:

The LTLCS existing support that this would be a part of has been established for over five years and no other known company has the experience/knowledge of our installed equipment line. In addition, with the vast knowledge and experience that Black Box with the U.S. Army and especially Fort Hood, we would be back to the starting gate if another party was selected to assume the current and future requirements.

7. Market Research:

The LTLCS program was not setup by Fort Hood NEC staff. This is driven from Army as a support mechanism for telecommunications platforms
