Section A - Solicitation/Contract Form
ADMINISTRATIVE SUMMARY
A.1 Administrative Summary
A.2 The Army Contracting Center (ACC) - Warren anticipates that it will award multiple contracts as a result of this solicitation. However, the Government reserves the right to make a single award within the best interest of the Government based on the lowest overall price and technical acceptability.
A.2.1 There are eight separate types of rubber material requirements listed in section B of this RFP. However, Ground Side Rubber and Wheel Side Rubber must be awarded together, no exceptions. This allows for a maximum of seven (7) requirements contracts that could be awarded under this solicitation. A contractor who is awarded a contract for one of these required materials will be the only manufacturer that the Army will purchase the material from and the Delivery Orders will not be competed.
A.2.2 Contract Line Item Numbers (CLIN) will be evaluated separately as follows and each could result in an award:
CLIN 0001 (all three ordering periods) - Strip Stock Rubber Material 0235
CLIN 0002 (all three ordering periods) - Strip Stock Rubber Material 0149
CLIN 0003 (all three ordering periods) - Strip Stock Rubber Material 0135
CLIN 0004 (all three ordering periods) - Strip Stock Rubber Material 0149 Master Batch
CLIN 0005 (for both ordering periods) - Strip Stock Rubber Material 0158 (option)*
CLIN 0006 (for both ordering periods) - Strip Stock Rubber Material RR-11 (option)*
CLINs 0007 and 0008 (all three ordering periods) - Ground Side Rubber and Wheel Side Rubber
*Exercising of these Options activates all Ordering Periods for these CLINs.
A.3 Evaluation will be based on a Lowest Price, Technically Acceptable basis. Technical acceptability will be established through the submission of bid samples. See the Instructions, Conditions, and Notices to Offerors as well as section M for details on the bid samples and the testing procedures. Please see the Section C for the Specs for Strip Stock Rubber Materials 0235, 0149, 0135, 0149 Master Batch, 0158, and RR-11; and for the Ground Side and Wheel Side Rubber Materials
A.3.1 Red River Army Depot owns the formulations on all of the materials. Any potential offeror who is interested in participating in this solicitation and obtaining these formulas to submit bid samples, must submit a Nondisclosure Agreement (NDA) to the Contract Specialist within 15 calandar days of the solicitation being posted, to ensure that Red River Army Depot has enough time to complete the testing in a timely matter. NDA's will NOT be sent out after the 15 calender days have expired.
IN ORDER TO OBTAIN AN NDA, AN OFFEROR MUST EMAIL THE CONTRACTING SPECIALIST AND
REQUEST THE FORM BE SENT TO THEM. REQUESTS MUST BE SENT TO RICHARD MORGAN AND
JEFFREY WEISS AT richard.d.morgan18.civ@mail.mil AND jeffrey.l.wiess10.civ@mail.mil. THE
CONTRACTING SPECIALIST WILL CONFIRM THE REQUEST VIA EMAIL AND WILL SEND OUT THE
FORM BEFORE CLOSE OF BUSINESS ON THE DAY THE CONTRACT SPECIALIST CONFIRMS THE NDA
REQUEST FROM THE POTENTIAL OFFEROR.
mailto:richard.d.morgan18.civ@mail.mil mailto:jeffrey.l.wiess10.civ@mail.mil
A.3.2 Ground Side and Wheel Side Rubber Material are being awarded together. In order for an offeror to be considered for contract award of these materials, they must submit samples that BOTH pass the testing parameters in section M. Failure to pass the testing on both will result in a unacceptable technical evaluation.
A.3.2.1 The Government reserves the right to allow an offeror to submit samples for a second attempt at passing the testing, based on their test result. The Government may allow a SINGLE (1) retest if the submitted bid sample is determined to be within 10% of the specifications listed in the Scope of Work. The decision to allow the retest is at the Government's sole discretion.
A.3.2.2 If the bid samples provided by the offeror conform to any of the material specifications, as applicable, but the other samples do not conform, the offeror will not be considered for award of the materials that are non-conforming, unless the non-conforming sample(s) is within the 10% of the specification. In this circumstance, the offeror will be provided the opportunity to resubmit the non-conforming sample(s) for one additional test. They may re-submit a modified sample of the material or submit a brand new sample that must conform to the requirements.
Only one additional test will be allowed and if after the second attempt, the sample(s) still fail testing, the offeror will not be considered for award. Only offerors who pass the testing on either the initial attempt or the second attempt will be considered for award.
A.3.2.3 Samples for the Ground Side and Wheel Side Rubber Materials must both conform to the testing parameters if an offeror is to be considered for award. If an offeror only submits one conforming sample, while the other is non-conforming, they will be removed from consideration for award of these materials.
A.3.3 An offeror may request a waiver from the Contracting Officer omitting them from the testing. In the request, an offeror must submit reasons as to why they should be exempt from submitting bid samples for the testing portion of the proposal. The Government will then review the request and inform the offeror if they have been approved or disapproved for the waiver.
Initial waiver request should be sent to the Contracting Specialist at richard.d.morgan18.civ@mail.mil
A.3.4 Bid Samples submitted by the Offeror must be shipped before the solicitation closes. The Offeror is to provide the Contract Specialist proof of shipment (Shipment invoice or reciept) before the solicitation closes to be considered for award.
A.4 Price Evaluation Sheet. When filling out section B with prices for each material, and offeror shall put the unit price per unit for the listed CLIN based on the estimated quantities listed.
A.4.1 For example, CLIN 0001, for Strip Stock Material 0235 has an estimated quantity of 250,000 lbs. An offeror shall put the price per lb. in the Unit Price column and the total price will be automatically calculated.
A.4.2 If an offeror submits a proposal for any of the materials, they must submit a proposal for ALL ordering periods associciated with each material. Proposals that do not support all ordering periods will not be considered for award. For example, for an offeror to be considered for award of Strip Stock Material 0235, they must submit pricing for all three ordering periods (along with a bid sample or waiver) to be considered for award. If an offeror only submitted pricing for two of the three ordering periods, that offeror would not be considered for award even if they submitted an acceptable bid sample or waiver and have the lowest price for the three periods they submitted a proposal for. All ordering periods for each material the offeror wished to propose on must be filled out.
A responsive proposal to this solicitation consists of:
1) Bid Samples stated in Section M (unless a waiver is granted, omitting the offeror from providing samples) for all CLINs the offeror wished to propose on.
2) A Price proposal (Pricing for ALL CLINs, for the material(s) that the offeror wishes to propose on) of all three ordering periods (CLIN 0005 for Strip Stock Material 0158 and CLIN 0006 for Strip Stock Material RR-11 only have two year order periods) for the CLINs/Materials the offeror is proposing on.
mailto:richard.d.morgan18.civ@mail.mil
Failure to submit these items before the solicitation closes, results in an incomplete proposal and it will not be considered for award.
