FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: ACC/APG Natick Contracting Division
2. Description of Action: Joint Project Manager for Protection requests a firm fixed price contract with Gerber Technology. The Government projects award for February 2017, and fiscal year 2016 DoD OMA funds will be used.
X An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

4. Authority Cited:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
The Gerber cutter is compatible with the existing line in Pine Bluff Arsenal and replicates the equipment on which the Patient Protective Wrap was designed. To change from Gerber to another cutting vendor would require significant rework of an existing operational textile manufacturing line at Pine Bluff Arsenal. An alternate cutter could cause significant redesign of the specifications and additional time in rework as the design is revamped. In addition to the changes required to the production line necessary if an alternate cutter were awarded, there would be additional operator training required as the team is familiar with Gerber products. The Gerber cutter uses their proprietary software and the templates created during the initial design phase at Natick Soldier Center can be easily replicated by using a Gerber cutter at Pine Bluff Arsenal.
The total cost to the Government in manufacturing line redesign and training by using an alternate cutter is estimated at $30,000, which includes $10,000 for software and up to $5,000 per quarter in maintenance kit purchases. This cost would be on top of a baseline cost for an alternate table, which starts at $215,000. Additionally, errors in the conversion process including distortion can occur which will further increase costs.
Cutting equipment is required to be compatible with equipment already in place at Pine Bluff Arsenal. This cutter, spreader and accessories are compatible with previously purchased equipment from Gerber Technology at a current investment cost of $32,000.
Alternate commercial cutters are available but would require additional training, would pose compatibility issues with the current production line and other Department of Defense locations, and would necessitate the development of new cutting templates.
The Gerber equipment and integrated Accumark software are crucial to reducing errors and rework on the Patient Protective Wrap production line.
The Patient Protective Wrap is designed to increase safety of troops and reworking the existing line in order to open this acquisition to competition would jeopardize the schedule for initial production by approximately 12 months.
6. Efforts to Obtain Competition: A Special Notice was filed on Fed Biz Opps on 12 January 2017 and as of 25 January no responses were received. As a commercial item, this is sufficient time for contractors interested in the acquisition to respond to the notice per FAR 5.203(a).
a. Effective Competition: Because this is a sole source action, effective competition is not applicable.
b. Subcontracting Competition: As a commercial item with a total acquisition value of $200,000, subcontracting opportunities are limited.
7. Actions to Increase Competition: As the government performs more cut and sew operations, opportunities to increase completion for both supplies and services will be expanded. Actions include industry days at Pine Bluff, user meetings, and continued research and development by the Natick textile team.
8. Market Research:
In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a Special Notice was posted on Fed Biz Opps on 12 January, 2017.
No responses were received as of 25 January 2017.
9. Interested Sources: To date, no other sources have written to express interest in the acquisition.
10. Other Facts:
Procurement History The Accumark software and a Gerber plotter were purchased in March of 2016 to begin design work on the Patient Protection Wrap. The Accumark software is a proprietary system in use in the US Army to design and program textile cutting patterns. It is approved the US Army network. These purchases were made using other than full and open competition and was supported by a properly executed J&A under the authority of 10 U.S.C. 2304(c)(1).
