3. ESTIMATED TOTAL VALUE: [REDACTED]
4. STATUTORY AUTHORITY PERMITTING CONTRACTING WITHOUT PROVIDING FOR FULL
AND OPEN COMPETITION: The statutory authority permitting sole source is 41 USC 1901(e), implemented by FAR 13.106-1(b)(1)(i):
_X_ Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
___ Unusual and Compelling Urgency ___ Industrial Mobilization; Engineering, Developmental, or Research Capability; or Expert
Services ___ International Agreement ___ Authorized or Required by Statute ___ National Security ___ Public Interest
5. JUSTIFICATION FOR THE AUTHORITY CITED ABOVE:
The item(s) listed in section one above is available from only one source and competition is precluded for reasons indicated below. There are no substitutes available.
_X_ Compatibility: The item(s) must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system: See below.
___ Proprietary: A patent, copyright, or proprietary data limits competition. The proprietary data are described as follows:
_X__ Experimental Continuity: The item(s) must be consistent with prior materials in order to ensure experimental continuity. Describe the conditions that necessitate the use of experimental continuity: See below.
___ Warranty: Purchasing item(s) from another manufacturer/provider would void existing warranty. Provide a brief explanation for the use of this reason and the impact that would occur if the item was purchased from another manufacturer/provider:
___ Direct Replacement: These are “direct replacement” parts/components for existing equipment and no substitutes exist.
___ Other reasoning to support a sole-source buy:
In support of [REDACTED], the electroencephalography (EEG) systems proposed in this acquisition are necessary for the execution of the aims of the proposals titled [REDACTED].
[REDACTED], the Government must acquire (14) Advanced Brain Monitoring (ABM) B-Alert x24 EEG Systems due to the need for compatibility with existing infrastructure and experimental continuity. The required ABM B-Alertx24 EEG Systems will support work which [REDACTED] also used the Advanced Brain Monitoring B-Alert x24 system. [REDACTED].
The Army Research Laboratory (ARL) invested in an extensive engineering effort to develop [REDACTED] using the ABM B-Alert x24 [REDACTED]. The Government has made a considerable effort to [REDACTED]. Acquiring an EEG System other than the ABM B-Alert x24 would require additional costs to Government, in terms of a required number of man hours to integrate a new EEG System into the existing software architecture, and retest and revalidating the new system (estimated at a minimum value of [REDACTED]. Furthermore, the time to integrate a new system would delay the mission by at least [REDACTED], impeding the study and its plans to coincide with academic partners. Moreover, the Government has been working to integrate the ABM into [REDACTED].
These integrated systems have been used in multiple studies, each of which have built upon the previous study.
The [REDACTED] is highly integrated into the [REDACTED] program which has awarded several universities with external funding. These universities are also using B-Alert x24 systems which may be integrated into the [REDACTED] work, if concurrent data collection efforts are executed with the same EEG systems, acting as a multiplier for impact of our work. If the Government procures EEG Systems from a manufacturer other than Advanced Brain Monitoring, the Government and its mission partners will have reduced confidence when comparing results from previous and future experiments due to EEG Systems variability
Due to the aforementioned, Advanced Brain Monitoring is the only manufacturer who can meet the Government’s requirements. There are three (3) known authorized resellers of the required Advanced Brain Monitoring products: iMotions, Inc., Biopac Systems, Inc., and Neurons, Inc.
6. FAIR AND REASONABLE PRICE DETERMINATION:
It has been determined that the anticipated cost to the Government will be fair and reasonable and that approval of this recommendation is in the best interest of the government. This justification is accurate and complete to the best of my knowledge and belief.
