ACC-Warren (WVA) Controf 16-03

Justification and Approval for Other and Full and Open Competition Justification

.'L Contracting Activity: Army Contracting Command -Warren (VVVA), 1 Buffington Street, Watervliet, NY 12189-4000

2. Description of Action: This action will result in a new firm fixed priced contract with Hudson Valley Community College (HVCC) for the Machinist Apprenticeship Program course work. Award is projected in fourth quarter FY16. Army Working Capital Funds (AWCF) will be used for this procurement.

3. Description .of Supplies/Services: This requirement is for the Machinist Apprenticeship Program course work. The Arsenal has historically partnered with a local regionally accredited institution of Higher Education to provide the classroom instruction to ensure maximum validity and efficiency. The core subjects taught are based on an Advanced Manufacturing Technology degree totaling 66 semester hours, which after successful completion of the program Apprentices are awarded an Associate's Degree and become Journeyman Machinists. The 12 Watervliet Arsenal (VVVA) employees entered into the program shall attend Fall/Spring/Summer semesters over 4 years at the contractor's own facilities until all requirements of the Degree have been satisfactorily met.

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1), as implemented in Federal Acquisition Regulation (FAR) 6.302-1 (a)(2)(iii) s; only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: As described in FAR 6.302-1, procurement by other than full and open competition is necessary because this college uses this curriculum to train entry level employees with local area companies in apprenticeships. This curriculum contains the exact subjects required by our program, including hands-on lab courses to further acquaint and train apprentices with state-of-the-art machinery

Therefore, the courses offered by this college (singly and/or combined into a curriculum) are unique and not found in any other college, training institution, qr other source in our local commuting area. While there are of a vocational nature, they are considered to be a logical training transition for a typical high school graduate and represent the same

Control 16-03 level, caliber and progression over a part-time four year period, as we designed within our apprenticeship.

Apprentices enrolled in our program and taking classes at HVCC will be working during the day at the Arsenal and attending classes during the evening (2 or 3 nights per week). HVCC is within very close proximity/commuting distance from Watervliet Arsenal

As indicated by market research in paragraph 8, the closest institute with a like course offering is Alfred St~te College SUNY College of Technology, more ltlan 300 miles from \/NA, obviously not within commuting distance to \/NA.

6. Efforts to Obtain Competition: While HVCC is the only known source for the required Machinist Curriculum. Contract Specialist, Maria DeCrescenzo, posted a Sources Sought on FedBizOps on 23 May. No responses were received from Sought Source posting ..

7. Action to Increase Competition: Market Research will be conducted with each future procurement to identify accredited institutions. Until more institutions provide this training program within commutable distance to \/NA, no further action can be taken to increase competition. However, any future requirements over $150,000 will be synopsized on FedBizOpps.

8. Market Research: Market Research was conducted by manufacturing personnel

· whom surveyed and reviewed the local colleges to determine if there were any programs that would match the offerings of HVCC and found none. The closest similar program was at Alfred State College SUNY College of Technology, more than 300 miles from \/NA.

9. Interested Sources: A Sources Sought was posted through FedBizOps; however, no responses were received, to date, no other sources have written to express interest. The notices required by FAR 5.201 shall be. published and any bids or proposals received shall be considered.
