Contracting Officer’s Determination Memorandum for Sole Source (Including Brand Name) for less than SAT
In accordance with FAR 13.106-1 (b) (1), for purchases not exceeding the simplified acquisition threshold (SAT) contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). The determination must explain why the item or service provider is the only one that will meet the Government's requirement. Statements such as "only know source" or "only source which can meet the required delivery date" are unacceptable to support a sole source purchase.
PCF Cabinet PANRSA # ESTIMATED AMOUNT (over $2,500 for services and $10,000 for supplies, not to exceed SAT)
BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:
CHECK THE TYPE OF PURCHASE. Provide the unique characteristics that limit availability to only one source, including the reason(s) no other supplies or services can be used to meet the Government's needs. If you are stating the purchase is mandated by law, regulation, or policy, state the publication, date, and include a copy of the publication with the package. If the request is based on unusual or compelling urgency, describe the circumstances leading to the urgency, including when the requirement became known. (Urgency cannot be justified due to expiring funds or a lack of planning by the customer.)
This is a Brand Name Purchase Sole Source Purchase
DIRECTORATE
To the best of my knowledge at this point in time, the information stated above is both true
Letterkenny Army Depot requires procurement of Qty 2 PN 13695792 Universal Interconnect Device (UICD) and Qty 2 Universal Gold Dot Replacement Adapter (UGDRA) components to complete the Interchangeable Test Adapters (ITA) interface for the Next Generation Automated Test Station (NGATS).
The ITA components requested in Quote SO229796 and SO229797 are for interfacing the NGATS with the AVENGER Legacy program. AVENGER is currently tested using the Integrated Family of Test Equipment (IFTE), designed at REDSTONE, but IFTE is reaching end of service and the NGATS is set to replace it.
The Product Director Test, Measurement, and Diagnostic Equipment (TMDE) located at Redstone chose the IEEE-1505.1 Standard to be the NGATS and ITA Common Test Interface (CTI) connector configuration. The IEEE-1505.1 is a standardized pin map configuration for military and aerospace Automated Test Equipment (ATE). The Department of Defense (DoD) has adopted IEEE-1505.1 as the standard CTI to interface with Legacy programs and adapt to future programs. Currently, market research shows the only manufacturer building to the IEEE-1505.1 Standard is Mac-Panel.
An alternate procurement source is not recommended due to the cost of verifying IEEE-1505.1 compliance and the reverse engineering cost. Product Director TMDE is the owner of the Technical Data Package (TDP) and Test Program Set (TPS) for the NGATS and ITA and the sole authority for distribution. If Product Director TMDE does not provide the TDP or TPS to the alternate source, then extensive reverse engineering and documentation of the ITA specifications would need to be generated.
The requested ITA are designed to support up to 14 AVENGER assets. Design of an ITA to test just one asset with no supporting documentation would require reverse engineering the test requirements of each test asset (4 Months, $150,000 per asset), identifying the NGATS test capabilities (2 months, $100,000), documentation (3 Month, $60,000 per asset), fabrication of ITA (2 Month, $50,000 per asset), TPS development (6 Month, $80,000 per asset), and test an verification of ITA (2 Month, $30,000 per asset). The total development time and cost for one ITA from an alternate source would be approximately 19 Months at $470,000 for the first asset.
Product Director TMDE has already developed the TDP and TPS and shared the details with Mac-Panel, only requiring the fabrication and delivery of ITA and components. Mac-Panel is also a proven, reliable source for IEEE-1505.1 compliant products.
