PERFORMANCE WORK STATEMENT (PWS)
FOR
REPAIR/TEST of PATRIOT ANTENNA MAST ASSEMBLY
AB-1294A/G
1.0 General:
1.1 Scope: The contractor shall provide all personnel, equipment, tools, materials, s u p e r v i s i o n , quality control and other items and non-personal services necessary to perform depot level diagnosis/repair and test of Patriot Antenna Mast Assemblies as provided by the Government as defined in this PWS, except as specified in Paragraph
3.0 as Government Furnished. The contractor shall perform to the standards in this contract
1.2 Background: Letterkenny Army Depot (LEAD) has been tasked to overhaul Antenna Mast Assemblies to include the pneumatic mast components. LEAD intends to competitively procure services to diagnosis/repair and test the pneumatic Antenna Mast Assemblies using performance specifications developed in this PWS.
1.3 Period of Performance (PoP): The Period of Performance shall be one Base Year of 12 months and four 12-month option years. The Period of Performance reads as follows:
1.3.1 Base Year: 03 JUN 2018 – 02 JUN 2019
1.3.2 Option Year One: 03 JUN 2019 – 02 JUN 2020
1.3.3 Option Year Two: 03 JUN 2020 – 02 JUN 2021
1.3.4 Option Year Three: 03 JUN 2021 – 02 JUN 2022
1.3.5 Option Year Four: 03 JUN 2022 – 02 JUN 2023
1.4 General Information:
1.4.1 Quality Control (QC): The contractor shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QC program is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the contractor shall develop QC procedures that address the areas identified in Appendix E, Performance Requirements Summary.
1.4.2 Quality Assurance (QA): The Government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) (defect rate(s)
1.4.3 Recognized Holidays: The following are recognized US holidays. The contractor shall not perform services on these days:

1.4.4 Place of Performance of Services: The contractor shall provide services between the hours of 6:30 am and 3:00 pm on Monday through Friday, except on recognized US holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings. The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential.
1.4.5 Security Requirements: Contractor and all associated sub-contractor’s employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Risk Management or Security Office.
Contractor workforce shall comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
1.4.5.1 Physical Security: The contractor shall safeguard all Government property provided for contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured.
1.4.5.2 iWATCH Training: The contractor and all associated sub-contractors with an area of performance within an Army-controlled installation, facilities or area shall brief all employees on the local iWATCH program. This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR or contracting officer. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance. The contractor shall report completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within 15 calendar days after completion of training. iWATCH training is available on the Letterkenny Army Depot homepage – www.lead.army.mil.
1.4.5.3 Installation access: The contractor and all associated subcontractor employees shall comply with adjudication standards and processes using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.4.6 Conservation of Utilities: The contractor shall instruct employees in utilities conservation practices. The contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.
1.4.7 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the KO in accordance with Federal Acquisition Regulations Subpart 42.5. The KO, Contracting Officer’s Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contactor’s performance. At these meetings, the Contacting Officer will apprise the contractor of how the Government views the contractor’s performance and the contractor shall apprise the Government of problems, if any, being experienced The contractor shall resolve outstanding issues raised by the Government. Contractor attendance at these meetings shall be at no additional cost to the Government.
1.4.8 Contract Manager (CM): The contactor shall provide a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the KO.
The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
1.4.9 Identification of Contractor Employees: All contact personnel attending meetings, answering Government telephones and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. The contractor shall also ensure that all documents or reports produced by contractor personnel are suitably marked as contractor products or that contractor participation is appropriately disclosed.
1.4.10 Organizational Conflicts of Interest (OCI): The contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in FAR Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.
2.0 Definitions and Acronyms:
2.1.1 Contractor. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.2.2 Contracting Officer (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.2.3 Contracting Officer’s Representative (COR). An employee of the U.S.
Government designated by the KO to monitor contractor performance. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.2.4 Defective Service. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.2.5 Deliverable. Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.
2.2.6 Key Personnel. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.2.7 Physical Security. Actions that prevent the loss or damage of Government property.
2.2.8 Quality Assurance. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.2.9 Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.2.10 Quality Control. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.2.11 Subcontractor. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.2.12 Work Day. The number of hours per day the Contractor provides services in accordance with the contract.
2.2.13 Work Week. Monday through Friday, unless specified otherwise.

3.0 Government Furnished Property, Material, Equipment and Services (GFP/M/E/S): The Government will provide the equipment listed below:
3.1 Reusable crate/box for shipping mast assemblies from LEAD to contractor and back.
4.0 Contractor Furnished Property, Materials, Equipment (CFP/M/E):
Except for those items specifically stated to be Government-Furnished in Paragraph 3.0, the contractor shall furnish everything required to perform these services as indicated.
5.0 Requirements:
5.1 General: The depot level diagnosis/repair and test of Patriot Antenna Mast Assemblies as provided by the Government as defined in this PWS, except as specified in Paragraph 3.0 as Government Furnished. LEAD will remove mast assembly from the AMG structure.
5.2 Details: Except as noted in Paragraph 4.0, the Contractor must produce a mast assembly that meets the performance, dimension, material, and finish requirements detailed on the drawings listed in Appendix A.
5.2.1.1 The Contractor must apply all Engineering Change Proposals (ECPs), Modification Work Orders (MWOs), and other modifications listed in Appendix B that have not previously been applied to the supplied mast assembly.
5.2.1.2 The Contractor must remove all foreign matter, active corrosion, functionally significant scars and scratches, and replace all lubricants.
5.2.1.3 The Contractor must restore all damaged or deteriorated material surface treatments, wear material and plating to drawing specifications.
5.2.1.4 The Contractor must replace all mandatory replacement items listed in Appendix C.
5.2.2 The Government will include any required high dollar repairs that it is aware of in the initial delivery order.
5.2.2.1 The Contractor will request a modification to the delivery order to incorporate any of these high-dollar repairs it determines are necessary during its inspection and repair process.
5.2.2.2 Pricing: The Contractor shall provide a fixed price for all of the specified repairs with the exception of the replacement of the low-failure rate, high dollar items listed.
5.2.2.2.1 The Contractor shall provide a separate fixed price for the replacement of the following items when performed concurrent with the repair priced above:

5.2.3 Work to be Performed by the Government:
The Government will clean and de-paint and protect the exterior of the mast assembly prior to boxing it for Contractor pick up, and will repaint the assembly upon its return.
The Government will remove the tube collars, perform NDT on them, identify defective collars by tagging with S/N to be replaced, and loosely reinstall the collars prior to sending the assembly to the Contractor.
The Government will install the mast restraint blocks, restraint cables, and related hardware upon the assembly’s return for inspection/testing.
5.2.3.1 Repair Parts Support: The Contractor shall procure, fabricate or otherwise acquire all repair parts required to accomplish the specified work. If the Contractor determines that a required part is obsolete or otherwise cannot be acquired in time to meet the completion date, the Contractor must contact the Government immediately and a mutually agreed upon resolution developed. This resolution shall be finalized in writing and appended to the delivery order.
5.2.3.2 Quality Control Provisions:
The Contractor must be an Antenna Mast Assembly original equipment manufacturer that has demonstrated the required experience in each of the processes involved in the repair of these assemblies, and that has not been disqualified from manufacturing these items due to quality control or other contract performance problems.
The Contractor shall incorporate all the applicable quality control procedures and records used for its original manufacture of antenna mast assemblies to the repairs conducted under this contract. A copy of contractors quality program will be provided for review for to include, NDT, welding calibrations, parts control etc..
Repaired mast assemblies shall be physically and operationally interchangeable with new items and shall have, as nearly as possible, the service life equivalency of new items.
Mast assemblies shall be restored to a “like new” condition in terms of appearance and marking following repair action.
The Government will visually inspect the repaired mast assembly upon its return from the Contractor, install it in the production of an Antenna Mast Group, and subject it to the performance test described in Appendix E. The Contractor shall be responsible for correcting any deficiencies revealed by these inspections and tests.

5.2.3.3 Inspection and Acceptance:
The Contractor shall provide DD Form 250, Material Inspection and Receiving Report with blocks 1 thru 20 filled in with each repaired Antenna Mast Assembly.
Initial acceptance of the repaired mast assemblies will be based on a visual inspection and review of repair/modification information provided by the Contractor.
Initial acceptance will be completed within ten working days of the Government’s receipt of the repaired mast assembly.
The Government will complete the DD Form 250 based on its initial acceptance inspection.
Final acceptance will be based upon successful performance of the repaired assembly during the operational test. Final acceptance will be completed within 90 calendar days of either the receipt of the repaired mast assembly or correction of any deficiencies found during the initial acceptance inspection.
5.2.3.4 Transportation:
The contractor is responsible for pickup and delivery of the assemblies to and from Letterkenny Army Depot. The contractor must pickup assemblies NLT 7 working days after notification from Letterkenny Army Depot assets are ready for pickup.
The Contractor shall return the repaired assemblies in the reusable box, supplied by Letterkenny Army Depot. Assemblies must be received by Letterkenny Army Depot NLT 7 working days after 30 day repair cycle of contractor.
The Contractor is also responsible for all transportation costs related to rework of assemblies that fail initial or final acceptance inspection.
5.2.3.5 Government Furnished Property:
The Government, at the Contractor’s request but at its discretion, may furnish additional property needed for the performance of the described work. Any property provided to the Contractor under this provision must be returned to the Government upon completion of this contract.
The Government will not furnish nor reimburse the Contractor for the purchase of any capital-type equipment for use in performance of this contract.

APPENDIX D
Non-Destructive Testing Requirements
Standard: Dye Penetrant inspections shall be conducted IAW ASTM E1417, by certified NDT personal.
Disassemble & clean all components of the antenna mast assembly to the extent needed to ensure a thorough examination of the defined areas to include all threaded holes and other stress points.
Visually inspect all mast sections and collars for missing, damaged or worn components such as cracked, chipped or distorted bearing strips.
Conduct a dye penetrant inspection of the first 6” of the collar ends of mast tube sections 2, 3, 4, 5 to include the guides. The anodize finish need not be removed to perform the dye penetrant inspection; but the inspections must be conducted before the existing finish is restored/replaced. Acceptance criteria are no cracks allowed.
5.3 Contractor Manpower Reporting (CMR): The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the Contractor shall report ALL Contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor shall completely fill in all the information in the format using the following web address https://Contractormanpower.army.pentagon.mil. The required information includes: (1) Contracting Office, KO, Contracting Officer’s Technical Representative (COTR) or also known as the Contracting Officer’s Representative (COR); (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor's name, address, phone number, e-mail address, identity of Contractor employee entering data; (5) Estimated direct labor hours (including sub-Contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-Contractors); (7) Total payments (including sub-Contractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by Contractor (and separate predominant FSC for each sub-Contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the Contractor with its UIC for the purposes of reporting this information); (11) Locations where Contractor and sub-Contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of Contractor and sub-Contractor employees deployed in theater this reporting period (by country). As part of its submission, the Contractor shall provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period shall be the period of performance not to exceed 12 months ending September 30 of each government fiscal year and must be reported by 31 October of each calendar year.
Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a Contractor’s system to the secure website without the need for separate data entries for each required data element at the website. The specific formats for the XML direct transfer may be downloaded from the website
5.4 Evaluation of Contractor Offer:
Firms capable of supplying this product shall indicate their interest by providing the Government a brief summary of their company. The request shall include cage code, company name, address, phone number, email address.
Each Offeror shall complete the Statement of Compliance Technical Exhibit 3. The Statement of Compliance is required to assure LEAD that the offeror can perform the required services and to aid LEAD personnel in evaluating the services being offered. Failure of the offeror to complete the Statement of Compliance can result in the offeror not being considered for award of this project.
In addition to the Statement of Compliance, the offeror shall provide LEAD with at least two customers or previous Government contracts as reference for which they have provided power train components similar to those required by this PWS. Each reference shall include the name of the customer, address, and type of business, a knowledgeable point of contact, and the telephone number of the point of contact.
5.5 Offeror’s Statement of Compliance: The offeror’s proposal shall be in sufficient technical detail that its key design and operation features can be compared & contrasted with those of comparison component.
Offerors shall indicate, on a paragraph-by-paragraph basis, whether or not they can comply with LEAD requirements as given in the PWS. A prepared form entitled, "Offeror's Statement of Compliance" is provided. The left hand column of the form lists the paragraph that shall be addressed by the offeror.
Two blocked spaces in columns headed "comply" and "non-comply" are to the immediate right of each paragraph designated. The entry of an "X" is required in one of these two blocks, along with a written response in the Method of Compliance/Reason for Non-Compliance column. The response shall explain how the offeror will comply with the specific requirement or explain the degree and reason for non-compliance. Offerors are advised that checking “non-comply" for any paragraph can result in rejection of the offer unless the reason for non-compliance is acceptable with the Government. If additional space for explanation is required, a separate sheet may be used to continue the explanation. If such a continuation sheet is used, it shall refer to the paragraph title being referenced.
Offerors are reminded that requirements specified in the PWS stem from performance needs at LEAD. When an offeror must take an exception to a specified requirement, they are advised to provide as much information as possible about what is being offered in order that LEAD personnel can assess whether or not the exception is acceptable to the Government and evaluate the impact upon LEAD's performance needs.
Indicating “Comply” means that the offeror understands and intends to comply with that paragraph and its sub-paragraphs. If the offeror feels that any paragraph in the specification is unclear or needs to be revised, this needs to be covered with the contracting officer and resolved prior to submitting the statement of compliance (see Notes Section for additional information on submission of questions to the contracting officer). Any revisions to this purchase description or statement of compliance will be coordinated through the contracting officer so that all interested parties are properly notified.
Omission of certain paragraphs or sub-paragraphs from this statement does not mean that compliance with the requirement in that paragraph is optional.
Spaces for signature, title, and date are provided at the bottom of the form. The completed form and each continuation sheet, if included, shall be signed and dated by the offeror or an authorized representative.

The contractor shall be responsible for obtaining the technical manuals, specifications and other data that is required to conform to the inspection, repair and test requirements that are set forth in this PWS. All technical data will be available in electronic form from LEAD, along with the solicitation.
