JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

FOR LETTERKENNY ARMY DEPOT FOR

SENTINEL ELECTRONIC TEST EQUIPMENT

1. Contracting Activity. U.S. Department of the Anny, Directorate of Contracting, Letterkenny Army Depot (LEAD), ATTN: CCAM-DPD, Chambersburg, PA 17201-4150.

2. Description of Action. The Government intends to award a Firm-Fixed Price contract for the procurement of Original Equipment Manufacturer (OEM) parts for the Sentinel Radar System. The estimated dollar value is $287,950.00. Funding Type: Anny Working capital Funds (97X4930AAPL).

3. Description of Supplies/Services.

a. This proposed contract action is for the procurement of Original Equipment Manufacture (OEM) parts for the Sentinel Radar System, located in Buildings 370 and 377, within the facilities of Letterkenny Anny Depot (LEAD). Specifically, the government seeks to procure the following equipment inclusive of certificates of compliance, calibration, associated technical manuals and/or test sheets.

4. Authority Cited. 10 U.S.C. 2304(c)(l), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited.

a. The Government intends to compete and award this requirement within the manufacture and its approved distributors. However, as described at FAR 6.302-1( c )(ii), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited.

b. The Keysight Technologies equipment is the only manufactured product recommended by the Depot Maintenance Work Requirements (DMWR) for the Sentinel Program. The Keysight Technologies equipment is the only manufactured product recommended by the Sentinel Technical Manual. No other brand-name is available that can offer the mechanical and electrical specifications in support of the Sentinel overhaul. Portions of the Technical Data (TD) requirements are proprietary and not otherwise available from another manufacture.

c. The planning and execution of another brand name or equal who could then compete with Keysight Technologies, Inc. could not be orchestrated in the timeframe necessary to satisfy program production needs. Keysight Technologies, Inc., is the only brand called out in the technical manual (which is used to refurbish Sentinel items on Depot). Developing additional sources would cause unacceptable delays in fulfilling LEAD requirements and would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

6. Efforts to Obtain Competition.

Sentinel Test Equipment

a. This requirement will be synopsized in the Federal Business Opportunities (FBO) as required by FAR 5.201. The synopsis and solicitation for this requirement will be posted via the GPE, www.FBO.gov and all interested contractors will be encouraged to submit proposals. Additionally, all appropriate subcontracting clauses will be incorporated in the solicitation to allow for maximum opportunities to small business concerns.

b. However, it is not practicable for another manufacturer other than Keysight Technologies, Inc. and its approved distributors to provide the required services. Furthermore, as described at FAR 6.302-1( c )(ii), an acquisition or portion of an acquisition that uses a brand-name description to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited.

7. Actions to Increase Competition.

Per the justification stated on paragraphs 4 and 5, at this time, it is not feasible to compete this requirement. The synopsis and solicitation for this requirement will be posted via the GPE, www.FBO.gov and all interested contractors will be encouraged to provide a proposal. The Directorate of Contracting at LEAD seeks to provide all necessary information to assist interested contractors to bid on any upcoming requirement of the same nature. Any responses received, as a result of the synopsis, from contractors, will be reviewed and evaluated for potential competitive opportunities prior to contract award.

8. Market Research.

A Sources Sought Notice was disseminated to industry via the Government Point of Entry (GPE), www.FBO.gov, on 11July2016 with a closing date of 15 July 2016. At closing, six responses were received but only one capable contractor was identified (small business). Market research was conducted on 13 July 2016, via GSA Advantage, and two capable contractors were identified (one large business and one small business). Additionally, the Technical Point of Contact (TPOC) conducted market research (MMR-CD#l60937) and the manufacture (large business) and one contractor (small business) were identified as capable of supplying the requested parts. All identified contractors are approved distributors ofKeysight Technologies, Inc.

9. Interested Sources - No other sources have expressed an interest in writing.

10. Other Factors.

a. Procurement History. There is no history for the procurement of Sentinel Radar System.

b. Unusual and Compelling Urgency. Not applicable.

c. Other Factors Supporting the Use of OTFOC: Not applicable.
