PROVISION #7: Evaluation-Commercial Items
a. It is the Government’s intent to award one contract following an assessment of each proposal against the requirements described herein and the criteria set forth below. Contract award will be made using a Lowest Price
Technically Acceptable (LPTA) source selection process IAW FAR 15.101-2, which states award will be made on the basis of the lowest evaluated price of proposals meeting the acceptability standards for non-cost factors.
b. Proposals will be evaluated on an Acceptable/Not Acceptable basis. This assessment will be performed using the substantiating documentation/data submitted in support of answers on the Technical Information Questionnaire
(TIQ) (Attachment 5). Evaluators will review data required in the TIQ. An Acceptable proposal is a proposal which the proposed product will clearly meet each of the requirements, as evidenced by the Offeror's responses to
Attachment 5 (TIQ) and the Substantiating documentation/Data submitted in support thereof. No extra credit will be given for exceeding the Government’s requirement. In order to be considered for award, the Offeror's proposal must be rated Acceptable for 100 percent of the requirements. Any Offeror's proposal assessed as Not Acceptable for any requirement under the technical evaluation will be ineligible for award. An Offeror whose technical proposal is rated Not Acceptable will be notified that its proposal will no longer be considered for award.
PROVISION #8: TECHNICAL LITERATURE
a. Offerors shall clearly establish conformance with all of the RFQ's technical requirements, as prescribed in the solicitation, by submitting the following:
1. A completed Technical Information Questionnaire (TIQ).
2. Substantiating documentation/Data. The Offeror shall provide product information that substantiates every response to each question in the TIQ. The offeror must provide information that substantiates responses to each TIQ question, with documents such as commercial literature, specification sheets, detailed diagrams, or other supplemental data. The Offeror shall clearly identify the substantiating data provided in response to each TIQ question. Bidders who furnish a product catalog as documentation must indicate which item(s) are the subjects of the bid by highlighting, marking and/or citation of model numbers and page numbers from the catalog in the
Contract Line Item Numbers (CLINS) along with the bid price. Bids, which fail to clearly establish what item or items are bid, will be considered as nonresponsive. Unsubstantiated claims will make the offeror ineligible for award. All responses and substantiating data must be in the English language and in the US Customary System of
Units.
b. The failure of descriptive literature to show that the product offered conforms to the requirements of this solicitation will require rejection of the bid.
c. Descriptive literature furnished under this solicitation that contains statements similar to "specifications are subject to change without notice", "bid is subject to the following conditions", or "prices are subject to change without notice" shall not be considered for an award. These types of statements qualify the bid and the Government https://www.fbo.gov/downloads/FBO_Vendor_Guide.pdf has no assurance the products offered conforms to the specification; therefore, the bid is not considered a firm bid and will not be considered for an award.
ALL OR NONE. Offerors are encouraged to use extreme care to ensure that offers submitted in response to this
RFQ must be submitted for all the requirements identified in the RFQ. Offers submitted for less than all the requirements called for by this RFQ will not be considered for award.
REJECTION OF OFFERS
In accordance with FAR 52.212-1, the Government may reject any or all proposals if such action is in the
Government's interest. Examples include, but are not limited to, the following:
(a) The proposal fails to meaningfully respond to the Proposal Instructions specified in this solicitation. Examples of failure to meaningfully respond include:
(1) When an offeror's a proposal merely offers to perform work according to the RFQ terms or fails to present more than a statement indicating its capability to comply with the RFQ terms or does not provide support and detail as specified in this solicitation.
(2) When an offeror's proposal fails to provide any of the data and information required.
(3) When an offeror's proposal provides some data and information but omits significant material data and information required by this solicitation.
(4) When an offeror's proposal merely repeats the contract Scope of Work without elaboration.
(b) The Government may reject any Offeror's Proposal that offers a product or service that does not meet all stated material requirements of the solicitation.
(c) The Government may reject any Offeror's Proposal that takes Proposes exception(s) to the attachments, exhibits, enclosures, or other RFP terms and conditions; or
(d) The Government may reject any Offeror's Proposal that is unbalanced as to price. IAW FAR 15.404-1(g), an unbalanced offer is one which is based on prices significantly high or low for one given period versus another period. There must be a direct relationship between the effort expended and its price.
PROVISION #9 Past Performance Information: Past performance information will only be reviewed as part of the Determination of Responsibility, and will not be part of the Lowest Price Technically Acceptable (LPTA)
Source Selection Process.
PROVISION #10 Determination of Responsibility: Determination of Responsibility and Eligibility for Award:
Per FAR 9.103, a contract will be placed only with Offerors that the Contracting Officer determines to be responsible; that is, those who can satisfactorily perform the necessary tasks and deliver the required items on time.
Prospective Offerors, in order to qualify as sources for this acquisition, must be able to demonstrate that they meet the standards of responsibility set forth in FAR 9.104. In addition, the Government may assess the Offeror's financial ability to meet the RFQ requirements. The Government reserves the right to conduct a Pre-Award Survey on any or all Offerors (or its Subcontractors) to aid the Contracting Officer in the evaluation of each Offeror's proposal and ensure that a selected Offeror is responsible. No award can be made to an Offeror who has been determined not responsible by the Contracting Officer. To ensure that the Offeror meets the responsibility criteria of
FAR 9.104, the Government may:
a. Arrange a visit to the Offerors plant and perform a necessary Pre-Award Survey, or
b. The Offeror shall provide technical, production, quality, and financial information. If the Offeror does not provide the Government with the data as requested within 7 calendar days from receipt of the request, or if the
Offeror refuses to have the Government visit its facility, the Contracting Officer may determine the Offeror to be not responsible. If the Government visits the Offeror's facility, make sure that the Offeror has current data relevant to its proposal available for the Government team to review.
PROVISION #11: The Federal Government is required by law to purchase products and practices that promote recycling and other environmentally friendly practices. Consequently, use of items containing recovered materials is required as part of the performance of this contract. Specifically, the Environmental Protection Agency (EPA) has issued minimum recovered materials content levels for the products in the attached List of Designated Recovered
Materials Content Products. The Contractor shall obtain information on recovered material content levels used in performance of this contract from the vendor or manufacturer. Except as specifically waived in writing, for reasons of price, performance or availability, any products in the attached list provided by the contractor as part of the performance of the contract must meet the minimum percentage levels of recovered materials.
The Contractor is responsible for insuring that all sub-contractors comply with this order. The Contractor shall submit the attached “Contractor Request for Waiver for Non-EPA Comprehensive Guideline Items” as written documentation to support the decision not to acquire items meeting the minimum content levels, based on one of the three justifications below:
a. The product is not available from a sufficient number of sources to maintain a sufficient level of competition (i.
e., available from two or more sources) or is not available a reasonable price.
b. The product is not available within a reasonable period of time.
c. The product does not meet the performance standards in applicable specifications to fails to meet reasonable performance standards of the agency.
See FAR Clauses 52.223-4, and 52.223-9 for further guidance.

(4) One Year Options and the Government is not obligated to order against any line item.
PROVISION #13: AUTHORIZED BUYERS. Any warranted Contracting Officer at the Anniston Army Depot whose warrant authorizes purchases of this type and dollar magnitude is authorized to purchase under this Contract.
PROVISION #14: FUNDS. Funding is to be provided on each individual Delivery Order.

PROVISION #18: OPTION YEARS: Contractor shall be notified at least sixty (60) days prior to expiration date of the contract if the Government intends to exercise its option to extend the contract for an additional year. In the event the Government fails to notify the contractor within the said sixty (60) days, but at a time less than sixty (60) days prior to the expiration date does notify the contractor that it intends to exercise the option to extend the contract for an additional year, the contractor will have the right to waive the sixty (60) days notice requirement and to perform under the option year contract.
PROVISION #19: Prospective contractors may complete electronic annual representations and certifications at
System for Award Management (SAM) and accessible at www.sam.gov in conjunction with required registration in the SAM database (see FAR 4.1102). CLAUSES INCORPORATED BY FULL TEXT
52.0000-4000 DISCLOSURE OF UNIT PRICE INFORMATION
This constitutes notification pursuant to Executive Order 12600, Pre-Disclosure Notification Procedures for
Confidential Commercial Information (June 23, 1987), of our intention to release unit prices in response to any request under the Freedom of Information Act, 5 USC 552. Unit price is defined as the contract price per unit or item purchased. We consider any objection to be waived unless the contracting officer is notified of your objection to such posting prior to submission of initial proposals.
(End of clause)
52.0000-4408 INSTALLATION SECURITY
The Anniston Army Depot (ANAD) is currently operating on a heightened state of security awareness and enforcement due to possible terrorist threats. Due to this heightened state of security, it is imperative that no unauthorized materials of any type be brought onto or left unattended on the installation. For this reason the
Contractor must have a process in place to receive and store materials and have visibility of the location of those materials at all times while on ANAD. This includes construction materials, equipment, and miscellaneous items.
This visibility/accountability of materials applies to the Contractor, its subcontractors, and its material suppliers.
Further, all Contractor, subcontractor, and material supplier employees are prohibited from bringing personal belongings of any nature onto the installation if such items are to be left unattended at any time.
The Contractor is further required to have a plan of action for implementing these procedures and must submit it to the Contracting Officer upon request. This plan of action must include a provision for informing all employees and subcontractors of these procedures. The plan of action must also address monitoring and procedures the Contractor has in place to ensure compliance with this contractual provision.
Should the Contractor fail to comply with this mandatory contractual provision, the Contractor may be held responsible for all direct and indirect cost incurred by the Government in identifying, securing, segregating, removing, and otherwise properly disposing of improper or abandoned materials/equipment.
52.0000-4702 AMC-LEVEL PROTEST PROGRAM
If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters, AMC. The HQ, AMC-Level
Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an
Alternative Dispute Resolution forum, rather than filing a protest with the General Accounting Office or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103.
Complete AMC Protest Procedures can be found at: http://www.amc.army.mil/amc/commandcounsel.html
An agency protest may be filed with either the contracting officer or to HQAMC but not both following the procedures listed on the website above.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.
