Changes to Section M

2.1 VOLUME 1, Factor 1 –Building Demolition

2.1.2. VOLUME 1 – Factor 1: Building Demolition

2.1.2.1. Submission Requirements:

Provide up to three projects that demonstrate experience in demolishing buildings totaling 15,000 square feet. AM01# Only experience of the offeror or designated subcontractor will be considered.

Offerors may submit experience information of a parent, sister, predecessor, subcontractor or other affiliated company. The Offeror must describe what involvement such company will have on the project. The proposal should clearly indicate how the resources of the parent, sister, predecessor, subcontractor or other affiliated company – its workforce, management, facilities, or other resources – will be provided or relied upon for construction performance. #AM01 The square footage of the three projects may be combined to meet the minimum 15,000 square foot requirement. If using subcontractor experience a letter of commitment must be included.

2.2 VOLUME 1, Factor 2 – Asbestos Abatement

2.2.1 Submission Requirements:

Provide up to three projects showing experience in asbestos abatement totally at least five cubic yards of asbestos contaminated debris. AM01# Only experience of the offeror or designated subcontractor will be considered. Offerors may submit experience information of a parent, sister, predecessor, subcontractor or other affiliated company. The Offeror must describe what involvement such company will have on the project. The proposal should clearly indicate how the resources of the parent, sister, predecessor, subcontractor or other affiliated company – its workforce, management, facilities, or other resources – will be provided or relied upon for construction performance. #AM01 The asbestos contaminated debris of the three projects may be combined to meet the minimum requirement. If using subcontractor experience a letter of commitment must be included.

3. Past Performance The government will evaluate at the offeror’s past performance from the Contractor Performance Assessment Report System (CPAR). AM01# If specialized experience of a parent, sister, predecessor, subcontractor or other affiliated company was used, their past performance will be evaluated. #AM01 Only completed evaluations within the last five years will be evaluated. The Past Performance will be considered technically acceptable if the contractor receives a rating of “Substantial Confidence”, “Satisfactory Confidence” or “Unknown Confidence (Neutral)” using the criteria below:

a . The Government will first assess and rate the relevancy of recent projects accomplished by the offeror to the scope of this contract for overall application to the performance confidence assessment ratings described hereinafter. This rating is not a separate proposal rating but is only used in developing overall past performance confidence assessment rating assigned to the Past Performance Factor. The past performance relevancy ratings are described below:

b . The Government will next consider how well the offeror performed on the contracts.

The Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor performance. With respect to relevancy, past performance on projects with more relevance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment rating than past performance on projects of lesser relevance. AM01# Past performance of a parent or affiliate will not be considered relevant. #AM01 Past performance under a previous business arrangement will not be considered relevant if the offeror’s role on the past project is not considered relevant. The Government will target areas covered in the requirements of this proposal including records of conforming to quality, schedule, cost control, customer satisfaction, problem resolution for construction errors, and safety. The Government places a higher value on projects, which provided particularly difficult or unique challenges and the innovative methods the contractor used to resolve problems successfully. The rating for this factor will be expressed as a degree of confidence in the offeror’s ability to successfully accomplish the contract requirements. The rating system used for the performance confidence assessment is described below.

The government may salvage the following items from the buildings before turning over the buildings to the offeror for demolition. Any of the items listed below that are not removed by the government shall be demolished by the contractor at no extra cost.

SPECIAL CONTRACT

REQUIREMENTS

PART 1 GENERAL

1.1 REFERENCES

The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

1.2 GENERAL SCR'S

1.2.1 SCR-GE010 Insurance - Work On A Government Installation:

In accordance with SECTION 00 72 00, 52.228-5, the Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the following kinds and minimum amounts of insurance:

1. Workman's Compensation and Employers' Liability Insurance:

$100,000.00.

2. General Liability Insurance: A Bodily Injury, Comprehensive policy which provides $500,000.00 per occurrence.

3. Automobile Liability Insurance: A comprehensive policy which provides $200,000.00 per person and $500,000.00 per occurrence for bodily injury and $20,000.00 per occurrence for property damage, covering the operation of its automobiles used in connection with the performance of the contract.

4. Aircraft Public and Passenger Liability Insurance: Where aircraft are used in connection with the performance of the contract; $200,000.00 per person, $500,000.00 per occurrence for bodily injury, other than passenger liability, and $200,000.00 per occurrence for property damage; $200,000.00 per person for passenger liability bodily injury aggregate equal to the total number of seats or number of passengers, whichever is greater.

5. Vessel Collision Liability and Protection and Indemnity Liability Insurance:

Where vessels are used in connection with the performance of the contract.

1.2.2 SCR-GE020 Supplemental Price Breakdown Information:

After contract award, the Government will require the Contractor to provide a cost breakdown of each facility by square foot (square meter), including major building systems to the five-foot (1.5 meter) line, for programming validation purposes. There will be no separate payment for this

DOCUMENT 00 73 00.00 29 Page 6 information and the Contractor shall include it in the contract price. The Government will provide a format with the directive.

1.2.3 SCR-GE030 Certificates Of Compliance And Lab Test Report:

SEE SECTION 01 33 00: SUBMITTAL PROCEDURES. Any certificates required for demonstrating proof of compliance of materials with specification requirements shall be executed in 3 copies. Each certificate shall be signed by an official authorized to certify in behalf of the manufacturing company and shall contain the name and address of the Contractor, the project name and location, and the quantity and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates shall contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification shall not be construed as relieving the Contractor from furnishing satisfactory material, if, after tests are performed on selected samples, the material is found not to meet the specific requirements.

1.2.4 SCR-GE040 Self Performance Of Work By The Contractor:

A. The following describes the applicable clause or requirement for self- performance of work by the Contractor, depending upon the type of solicitation (e.g., unrestricted or full or partial set-aside) and/or whether or not a price evaluation preference was provided for in the source selection evaluation.

B. Contract clause 52.236-1, PERFORMANCE OF WORK BY THE CONTRACTOR, is applicable to unrestricted procurement contract awards to any business except as explained in paragraphs C. and E., below.

C. In lieu of the above clause, contract clause 52.219-4, NOTICE OF PRICE EVALUATION PREFERENCE FOR HUBZONE SMALL BUSINESS CONCERNS is applicable for award to a HUBZone small business concern on an unrestricted solicitation when the awardee is a HUBZone small business concern or joint venture and claimed a price evaluation preference in accordance with the clause. For purposes of this clause, "cost of the contract" includes all direct and indirect costs, excluding profit or fees. "Cost of contract performance incurred for personnel" means direct labor costs and any overhead which has only direct labor as its base, plus the concern's general and administrative overhead rate multiplied by the labor cost.

D. Contract clause 52.219-3 NOTICE OF TOTAL HUBZONE SET-ASIDE is applicable to awards made under a partial or total HubZone set-aside. For purposes of this clause, "cost of the contract" includes all direct and indirect costs, excluding profit or fees. "Cost of contract performance incurred for personnel" means direct labor costs and any overhead which has only direct labor as its base, plus the concern's general and administrative overhead rate multiplied by the labor cost.

E. Contract Clause 52.219-14, LIMITATIONS ON SUBCONTRACTING, is the applicable requirement for awards to small business concerns for solicitations that were fully or partially set-aside for Small Business, 8(a), or award to a small disadvantaged business (SDB) concern on an unrestricted procurement where an SDB concern has claimed a price evaluation preference (but see next paragraph for suspension of the SDB price preference).

F. The Acting Director of Defense Procurement and Acquisition Policy has

DOCUMENT 00 73 00.00 29 Page 7 suspended the use of the price evaluation adjustment for SDBs in DoD procurements (FAR Clause 52.219-23), as required by 10 U.S.C. 2323(e)(3), because DoD exceeded its 5 percent goal for contract awards to SDBs in fiscal year . The suspension will be in effect for 1 year and will be reevaluated based on the level of DoD contract awards to SDBs achieved in fiscal year . This suspension applies to all solicitations issued during the period from . Said FAR Clause is not included in or made a part of this RFP. FAR Clause 52.219-4, relating to a 10% price evaluation preference for HUB ZONE small business concerns, is included in and made a part of this RFP.

PLEASE NOTE HOWEVER, that paragraph (b) (3) of the FAR Clause 52.219-4, is inapplicable also due to the referenced suspension of FAR Clause 52.219-23.

1.2.5 SCR-GE060 Qualifications Of The Contractor Quality Control Systems

Manager (CQCSM):

(a) The CQC System Manager (CQCSM) described in SECTION 01 45 04.00 29 CONTRACTOR QUALITY CONTROL shall be assigned no other duties.

(b) In lieu of the education and experience requirements for the CQC System Manager listed in the CQC SECTION 01 45 04.00 29 CONTRACTOR QUALITY CONTROL, a candidate may qualify provided they have a minimum of 7 years experience in construction quality control and are International Code Council (ICC) certified as a Commercial Building Inspector. For Military Family Housing projects, ICC Residential Building Inspector certification is required in lieu of the Commercial Building Inspector certification.

1.2.6 SCR-GE070 Requirements For Contractors Performance Evaluation:

The Government will evaluate the contractor's performance and prepare a performance report using the Construction Contractor Appraisal Support System (CCASS), a web-based system (http://www.cpars.csd.disa.mil/). After an evaluation (interim or final) is generated by the Government, the contractor will have the ability to access, review and comment on the evaluation for a period of 30 days. If the Contractor fails to review, and or comment on the evaluation within the 30-day period, the Contracting Officer will take the appropriate steps to finalize the evaluation without the contractor's comments. It is the sole responsibility of the Contractor to purchase any necessary software to access the electronic system, including a Public Key Infrastructure (PKI) certificate.

Contractors are encouraged to obtain and use the Public Key Infrastructure (PKI) certificate. Details and information to access the system are listed below. The contractor shall provide the Contacting Officer the primary contact name and email address in order to receive the initial email and to access the system. Additional information and training material is available at http://www.cpars.csd.disa.mil/. This web site will give the contractor an understanding of the system and levels of access, the policies and regulations governing CCASS and the electronic workflow with particular attention to the Contractor comment function. Contractor users are required to obtain a PKI certificate in order to log into CCASS. PKI certificates can be purchased from DoD's industries partners under External Certificate Authorities (ECAs). A list of ECAs vendors are available at http://www.cpars.csd.disa.mil/pki_info.htm.

1.2.7 SCR-GE102 CONTRACTOR SUPPLY and USE OF ELECTRONIC SOFTWARE (April

2011):

The contractor is encouraged to use a commercially-available electronic system to process and submit certified payrolls electronically to the Government. The requirements for preparing, processing and providing certified labor payrolls are established by the Davis-Bacon Act as stated in FAR 52.222-8, PAYROLLS AND BASIC RECORDS andr FAR 52.222-13, COMPLIANCE WITH DAVIS-BACON or RELATED ACT REGULATIONS.

If the contractor elects to use an electronic Davis-Bacon payroll processing system, then the contractor shall be responsible for obtaining and providing for all access, licenses, and other services required to provide for receipt, processing, certifying, electronically transmitting to the Government, and storing weekly payrolls and other data required for the contractor to comply with Davis-Bacon and related Act regulations. When the contractor uses an electronic Davis-Bacon payroll system, the electronic payroll service shall be used by the contractor to prepare, process, and maintain the relevant payrolls and

DOCUMENT 00 73 00.00 29 Page 8 basic records during all work under this construction contract and the electronic payroll service shall be capable of preserving these payrolls and related basic records for the required 3 years after contract completion. If the contractor chooses to use an electronic Davis-Bacon payroll system, then the contractor shall obtain and provide electronic system access to the Government, as required to comply with the Davis-Bacon and related Act regulations over the duration of this construction contract. The access shall include electronic review access by the Government contract administration office to the electronic payroll processing system used by the contractor.

The contractor's provision and use of an electronic payroll processing system shall meet the following basic functional criteria: commercially available; compliant with appropriate Davis Bacon Act payroll provisions in the FAR; able to accommodate the required numbers of employees and subcontractors planned to be employed under the contract; capable of producing an Excel spreadsheet-compatible electronic output of weekly payroll records (format at http://www.rmssupport.com/guides.aspx) for export in an Excel spreadsheet to be imported into the contractor's Quality Control System (QCS) version of Resident Management System (RMS), that in turn shall export payroll data to the Government's Resident Management System (RMS); demonstrated security of data and data entry rights; ability to produce contractor-certified electronic versions of weekly payroll data; ability to identify erroneous entries and track the data/time of all versions of the certified Davis Bacon payrolls submitted to the government over the life of the contract; capable of generating a durable record copy, that is, a CD or DVD and PDF file record of data from the system database at end of the contract closeout. This durable record copy of data from the electronic Davis-Bacon payroll processing system shall be provided to the Government during contract closeout.

All contractor-incurred costs related to the contractor's provision and use of an electronic payroll processing service shall be included in the contractor's price for the overall work under the contract.

The costs for Davis-Bacon Act compliance using electronic payroll processing services shall not be a separately bid/proposed or reimbursed item under this contract.

1.3 SAFETY/SITE/SECURITY SCR'S

1.3.1 SCR-SS010 Safety And Health Requirements Manual: EM 385-1-

The Contractor shall be responsible for complying with the current edition and all changes posted on the web (see web address above) as of the effective date of this solicitation and shall comply with the version in effect on the contract award date. This EM 385-1-1 shall remain in effect throughout the life of the contract.

1.3.2 SCR-SS030 Communication Security:

All communications with DOD organizations are subject to COMSEC review. Contractor personnel shall be aware that telecommunications networks are continually subject to intercept by unfriendly intelligence organizations. The DOD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from or terminating at DOD organizations. Therefore, civilian Contractor personnel are advised that any time they place a call to or receive a call from Alaska District offices or Resident Engineer offices located on military installations, they are subject to COMSEC procedures. The Contractor will assume the responsibility for ensuring wide and frequent dissemination of the above information to all employees dealing with official DOD information.

1.3.3 SCR-SS050 Salvage Materials And Equipment (JAN 1965):

The Contractor shall maintain adequate property control records for all materials or equipment specified to be salvaged. These records may be in accordance with the Contractor's system of property control, if approved by the property administrator. The Contractor shall be responsible for the adequate storage and protection of all salvaged materials and equipment and shall replace, at no cost to the Government, all salvage materials and equipment which are broken or damaged during salvage operations as the result of its negligence, or while in its care.

1.3.4 SCR-SS060 Preservation Of Historical, Archeological & Cultural Resources:

A. Known historical, archeological and cultural resources within the Contractor's work area are designated on the contract drawings. The Contractor shall install protection for these resources as shown on the drawings and shall be responsible for their preservation during the contract.

B. If, during construction activities, the Contractor observes items that might have historical or archeological value, such observations shall be reported immediately to the Contracting Officer so that the appropriate authorities may be notified and a determination can be made as to their significance and what, if any, special disposition of the finds should be made. The Contractor shall cease all activities that may result in the destruction of these resources and shall prevent its employees from trespassing on, removing, or otherwise damaging such resources.

1.3.5 AM01# Not Used #AM01

1.3.6 SCR-SS080 Electrical Conformance Inspection

Provisions shall be made by the contractor for Government inspection of those parts to be energized of all service equipment, transformers, switchboards, panel boards, non-power limited industrial control panels, and motor control centers. Inspections shall be performed after electrical construction is complete, before equipment is energized, and prior to final inspection. However, if special circumstances require parts to be inspected while energized, the contractor shall provide exposure of, and safe and controlled access to, the live parts.

The Government shall be notified not less than 48 hours work days in advance of the scheduled inspection date. The Government inspector will be an electrician or electrical engineer qualified (as defined in NFPA 70E) to perform this type of work. Deficiencies found during the inspection shall be documented and corrected, and, at the Government's discretion, re-inspected under the provisions of this paragraph.
