SCOPE OF WORK

Clean Water Act Support Fort Wainwright, Alaska

FY 2013

Date: 28 May 2013

1. Introduction/Objectives

Under the authority of the Clean Water Act (CWA), EPA established rules to protect waters of the U.S. from pollutants transported by storm water runoff. These regulations are part of the National Pollutant Discharge Elimination System (NPDES) regulations found in Title 40 of the Code of Federal Regulations Part 122.26 (40 CFR 122.26) and mandate that storm water discharges obtain permits for discharges.

The objective of this scope of work is to assist the command in the implementation of the Municipal Separate Storm Sewer System (MS4) Permit, to comply with training and inspection requirements of both storm water permits (MS4 and Multi-Sector General Permit (MSGP)) and their associated plans (Storm Water Management Plan (SWMP) and Storm Water Pollution Prevention Plan (SWPPP), respectively). The Contractor shall provide management services at Fort Wainwright as specified in the tasks below for a period of one year, with four additional years at the option of the Government. This contract is contingent upon the availability of funds.

The Contractor shall furnish all necessary personnel, services, equipment, and materials, and otherwise do everything for, or incidental to, the performance of work set forth herein. All tasks shall be performed in accordance with U.S. Environmental Protection Agency (USEPA), Alaska Department of Environmental Conservation (ADEC) regulations and recognized industry practices.

1.1 Available Information

The Government shall provide the following documents:

• FWA SWPPP

• FWA PowerPoint training slides

• FWA Final MS4 SWMP

2. Description of Tasks

This work consists of development and presentation of Storm Water Pollution Prevention (SWPP) training for selected military and civilian personnel at Fort Wainwright, Alaska (FWA) who are responsible for implementing SWPPPs. Other work includes the physical inspection of facilities for proper site management, Best Management Practices (BMPs) related to storm water, and annual compliance summaries.

Because FW A has a number of facilities that meet the regulatory definition of "industrial", and storm water from FWA potentially discharges to waters of the U.S., the installation gave notice of intent and was approved to operate under the EPA's MSGP. The conditions of that permit include preparing and complying with a SWPPP, annual employee training, and quarterly facility inspections. FWA's SWPPP presently includes industrial facilities and facilities that have similar potential to contribute to storm water pollution (industrial-like" facilities).

In addition to the MSGP, much of FWA is in the Fairbanks urbanized area, which triggers the requirement to obtain a Small Regulated MS4 permit, to further reduce the potential for storm water pollution. FWA has prepared an MS4 permit application and SWMP. Once FWA is granted an MS4 permit (anticipated in Fall 2013), storm water compliance associated with nonindustrial facilities in the SWPPP will be managed under the MS4 permit. For purposes of this scope of work, it is assumed that employee training and inspection requirements for the non-industrial facilities under the SWMP will be identical to those of the MSGP, and that the total number of facilities subject to storm water permit requirements will generally remain constant.

There are presently approximately 54 industrial facilities or groups of facilities at FW A with the potential to pollute waters of the U.S. at FWA. These facilities require storm water permit coverage (MSGP). The rest of the facilities on the installation are non-industrial and will require coverage under the MS4 permit. (See tables of listed facilities at the end of this scope.)

2.1 Task 1: MSGP and MS4 Training

The Contractor shall review the available documentation and current ADEC regulatory and administrative requirements, and update and assemble the training presentation materials to ensure consistency with current FWA SWPPP/SWMP, revised BMPs, installation buildings and practices, and to solicit client feedback. The Contractor shall provide two (2) 3-ring or otherwise bound copies and one ( 1) electronic slide file of the training presentation for Army review. The electronic slide files shall be suitable for future use and adaptation by FWA. In addition, the Contractor shall provide 3-ring or otherwise bound copies of the trainee binders for use during the training sessions.

Each training binder distributed during the training session will include general industry specific SWPP information for industrial facilities and industrial like facilities: or for Housing Town Hall Training sessions will include SWMP information. Training binders will include general compliance instructions.

The Contractor shall provide training presentations for required personnel at FWA. Storm Water training shall include the following elements:

• SWPP and SWMP awareness

• Best Management Practices (BMPs)

• Spill prevention and response

• Inspections

• Non-storm water discharge inspection

• Storm water monitoring

• Record keeping and documentation

The Contractor shall contact the facility manager, unit HAZWASTE NCO, or Housing Division equivalent to schedule the annual training. This schedule and updates shall be provided to the FWA Water Program Manager, USACE Project Manager, and USACE Technical Lead. The training sessions shall include presentation and discussion of slides and video(s). Additionally, the sessions shall include an overview of the applicable SWPPP and, when applicable, SWMP requirements.

The Contactor shall develop a training CD, based on training slides noted above, suitable for use by the installation (RCI/ACTUS) and industrial facility personnel to train personnel newly assigned or to train personnel unable to attend initial training presentations.

2.2 Task 2: MSGP and MS4 Inspections

The Contractor shall conduct MSGP and MS4 inspections at FWA on a quarterly basis. The contractor shall be accompanied during facility inspections by the building manager or unit HAZWASTE NCO and/or alternate (or their designee, in their absence). MS4 Inspections will be accompanied by installation water program manager. Copies of inspection results will be provided to the facility manager, and the MS4 results to the FWA water program manager.

Facility inspections should be timed to fit the MSGP schedule, which follows calendar years and quarters.

However, due to time constraints, the first four quarterly inspections will be conducted as follows:

Inspection 1 July 2013 Inspection 2 September 2013 Inspection 3 November 2013 Inspection 4 Jan - Mar 2014

If the option years are awarded, it is anticipated that the quarterly schedule will be followed, as detailed below:

Inspection A Apr – Jun 201X Inspection B Jul – Sept 201X Inspection C Oct – Dec 201X Inspection D Jan - Mar 201(X+1)

2.3 Task 3: MSGP and MS4 Reporting

In conjunction with the facility inspections conducted during the 3rd quarter of the calendar year, the contractor will conduct outfall visits and obtain other information from the FWA Water Program Manager as needed to meet the annual reporting requirement of the MSGP. This reporting requirement shall be fulfilled by entering information into the Alaska Department of Environmental Conservation MSGP Annual Reporting Form (October 2009).

3. Project Schedule and Period of Performance

The following table shows the requirements for the submittals. The number of days indicated are calendar days. The Contractor will distribute documents with the required number of copies shown below.

Training CD ROM 0 CD 30 days prior to commencement of training

This Quality Assurance Surveillance Plan (QASP) is a Government developed document used to ensure that the Government receives quality services, and pays only for services actually provided. The QASP provides a systematic method to evaluate the services the Contractor is required to furnish.

2. SCOPE. The role of Government Quality Assurance is to ensure contract standards are achieved. The QASP provides guidelines and methods for the Government’s oversight of the Contractor’s quality control efforts to assure timely, effective services are provided IAW the contract/order. The Contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract.

3. ROLES AND RESPONSIBILITIES.

Contracting Officer (KO) - A person duly appointed with the authority to enter into, administer and terminate contracts on behalf of the Government. The KO is the only person who can legally commit the Government and only the KO, as the Government’s agent, can modify the contract/order. The KO is the final authority for determining the adequacy of the Contractor’s performance. KO decisions arising under or relating to the contact are final.

Contracting Officer’s Representative (COR) – An individual designated in writing by the KO to perform specific technical and administrative functions within the scope and limitations of their written appointment (e.g., surveillance of Contractor’s performance, accept services). The COR is not empowered to make any contractual commitments or authorize any changes to the order/contract or in any way obligate additional funds by the Government; such authority rests solely with the KO.

Quality Assurance Evaluator (QAE) – An individual designated by the requiring activity, typically the Project Manager, to assist the COR and provide technical oversight of the Contractor’s performance. The QAE’s primary duty is to monitor the Contractor’s performance by physically checking to see that tasks are completed, reports are submitted, and desired outcomes are achieved. When a surveillance observation results in an unacceptable evaluation, the QAE will report the unacceptable performance to the COR. The QAE is not authorized to direct work, offer advice on how the work should be performed, change the contract, or in any way obligate payment of funds by the Government.

4. METHODS OF SURVEILLANCE. Surveillance is performed by the Government to provide objective quality evidence that there is a reasonable level of confidence that the services provided by the Contractor have met all the requirements of the contract before authorizing payment. The primary methods of surveillance are periodic inspections and customer feedback.

Periodic Inspection: Inspections are planned at specific intervals or dates as determined by the surveillance schedule. Periodic inspections will be performed regularly, yet randomly, during all hours of the Contractor’s operation. Periodic inspections may be performed more frequently if the COR/QAE discovers the quality of the Contractor’s performance is less than acceptable.

Customer Feedback: Customer feedback is firsthand information from the actual users of the service and is typically obtained via telephone or email. Customer complaints obtained via telephone must be followed up in writing/email.

The customer complaint must clearly articulate the nature of the complaint, time, date, etc. The COR/QAE will validate the complaint within 24 hours of receipt and forward a copy to the KO for resolution with the Contractor. If the COR/QAE determines a complaint is invalid, rationale will be cited in the validation section and retained for future reference. Customer feedback will be used to supplement other forms of performance evaluation, but will not be a primary method of evaluating the Contractor’s performance.

5. SURVEILLANCE PROCEDURES.

a) Government shall perform oversight during the Inspection or training event to the following levels:

i. For the first two (2) quarters of the base year a Government representative shall conduct 100% checks of the contractor storm water operation to ensure that State of Alaska and EPA standards are being followed.

ii. If successful performance is demonstrated for the first six (6) months of the contract, the quality surveillance shall be reduced to 50 % for the remainder of the base year.

iii. If the quality of performance is maintained throughout the base year the oversight will be reduced to 25% for the option periods exercised.

b) A Government representative shall conduct a 100% review of all Inspection and Training results received on this contract. Inspection shall consist of:

i. Verification that Contractor response time and deliverable time are within contract specified limits.

ii. Verification of requirement against Work Request/Delivery Order.

iii. Data review to identify any questionable results.

iv. Deliverables are on company letterhead and have an original signature.

c) A Government representative shall conduct a 100% review of all MS4 first year implementation requirements completed on this contract. Inspection shall consist of:

i. Verification that Contractor response time and deliverable time are within contract specified limits.

ii. Verification of requirement against Work Request/Delivery Order.

iii. Data review to identify any questionable results.

iv. Deliverables are on company letterhead and have an original signature.

d) Questionable or compromised inspection and or training results will be communicated to the contractor telephonically and followed up via email or written correspondence to the contractor. A copy of the correspondence shall be forwarded to the KO.

e) The Government may perform unannounced, inspection and training attendance for quality verification twice yearly for the life of the contract.

f) The COR shall immediately prepare a Contract Discrepancy Report (CDR) if the contractor fails to meet the Quality Control levels identified in their QAP.

g) The Government representative shall utilize the attached Contract Field Diary to record ALL inspections and comments related to any aspect of this contract.

h) A copy of all inspections, field notes and receiving reports shall be forwarded to the KO.

i) The COR/QAE will accept the services provided and authorize payment, typically on a monthly basis or upon satisfactory completion of the work.

6. QUALITY ASSURANCE SURVEILLANCE FILE. When services are provided IAW the Contract/Order it is not uncommon for a low dollar value and low complexity and/or duration service to be performed without any remedial actions required by the Government. Based on the low dollar value and the low complexity and/or duration of the Contract/Order, documentation will be kept to a minimum. Documentation of COR surveillance of contractor performance can be as simple as a memo for record as long as it includes date, type of surveillance, what was observed and results. The COR must forward all records they maintained to the KO after accepting the Contractor’s services for use in the event of a future contract claim/dispute. The COR/QAE file may contain:

a) A copy of the COR appointment letter from the KO, any changes to that letter, and any termination letters;

b) A copy of the Training Certifications for COR;

c) A copy of the contract and all contract modifications;

d) A copy of the applicable Quality Assurance Surveillance Plan (QASP);

e) A copy of any correspondence initiated by authorized representatives (Contractor or Government) concerning performance of the contract;

f) Records of inspections performed and the results;

g) Any customer feedback;

h) Memoranda for record of minutes of any meeting, telephone conversations and discussions with the contractor or others pertaining to the contract or contract performance;

i) Documentation pertaining to acceptance of services, reports, or data.

7. RECORDS: All records will be retained for the life of this contract.

8. CHANGES: The QASP is a living document and, as such, may be changed as needed. However, the KO must approve changes. The COR will submit recommended changes to the KO for approval.
