Part 1
General Information
1.0. General. The United States Army Operational Test Command (USAOTC) at Fort Hood, Texas, Test and Evaluation Technical Support Services (TETSS) requirement is to plan and conduct operational test, data collection, data management, logistics, engineering, programming, field operations, and instrumentation to support the missions of the Air and Missile Defense Test Directorate (AMDTD) at Fort Bliss, Texas and Fire Test Support Test Directorate (FSTD) at Fort Sill, Oklahoma. Additional, operational test events will be performed at other test locations in the Continental United States (CONUS) and Outside the Continental United States (OCONUS) as identified in the individual Task Authorization Requests (TARs)/Task Orders (TO)s.
1.1. Description of Services. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform under the TETSS as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract. Primary locations of performance are Fort Bliss, TX, and Fort Sill, OK.
1.2. Background. The AMDTD is located at Fort Bliss, TX. The FSTD is located at Fort Sill, OK. These directorates conduct planning, and report on independent operational tests, assessments, and experiments in order to provide essential information for the decision making process for acquisition and fielding of air defense artillery systems and field artillery systems. The AMDTD and FSTD are subordinate units to the United States (US) Army Operational Test Command (USAOTC) whose mission is to plan, conduct, and report on independent operational tests, experiments, and assessments of Army materiel in order to provide information for the acquisition and fielding of war fighting systems. The mission includes planning and conducting joint and multi-service tests, reporting on system capabilities and limitations, operational effectiveness, suitability, and survivability. This mission requires planning and conducting force development tests in support of the combat development process, performing field experiments, evaluating technology demonstrations in support of the technology base, and supporting the Army's digitization efforts.
1.3. Objectives. The Contractor shall provide specific technical requirements in support of the operational test, data collection, data management, logistics, engineering, programming, field operations, and instrumentation to support the missions of the AMDTD and FSTD.
1.4. Scope. The Contract support shall provide all labor, management, supervision, supplies, materials, equipment, training, and tools, not otherwise provided as Government Property, to perform the non-personal services required to support the operational test, data collection, and experimentation mission of the AMDTD, Fort Bliss, TX, and FSTD, Fort Sill, OK. The Contractor shall perform testing, data collection, and experimentation in support of combined developmental and operational tests, joint and multi-service tests, training activities, and other Department of Defense (DoD) activities. Other locations will be identified in individual task orders, and may require the delivery of test support services at locations both within the continental United States (CONUS) and outside the continental United States (OCONUS). The Government will issue Task authorization requests (TARs) and task implementation plans (TIPs) In Accordance With (IAW) the procedures set forth in Technical Exhibit (TE) A, Contract Data Requirements List (CDRL) A004.
1.5. Period of Performance. The requirements period of performance will have a five (5) year base ordering period consisting of a 30-day phase-in period and eleven (11) months of full performance for the first year, and for the fifth year shall include a 30-day phase out period.
1.6. General Information.
1.6.1 Quality Control. Quality control is the responsibility of the Contractor. The Contractor is responsible for the delivery of quality services/supplies to the Government. The Contractor shall develop and maintain an effective Quality Control Plan (QCP) to ensure services are performed IAW this Performance Work Statement (PWS). The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QCP is the means by which the Contractor assures its work complies with the requirement of the contract.
The Contractor’s QCP shall contain a systematic approach to monitor operations to ensure acceptable services/products are provided to the Government. The QCP shall be submitted to the Contracting Officer (KO) for review and approval within thirty (30) calendar days after contract award. After acceptance of the quality control plan, the Contractor shall obtain the KO’s acceptance in writing for any proposed changes to the QCP prior to implementation. The Contractor must submit changes to the plan to the KO no later than ten (10) workdays prior to the effective date of the change and shall not implement any change without the KO’s written approval. As a minimum, the plan will be reviewed annually with updates submitted earlier as necessary.
1.6.1.2. The QCP, at a minimum, shall address the following:
1.6.1.2.1. Inspection Program. Included shall be a quality control inspection program covering all general and specific tasks included in the PWS. It shall specify tasks or areas to be inspected on a scheduled or unscheduled basis, the manner in which inspections are to be conducted, the titles of the individuals who will perform the inspections, and the percentage of the work that will be inspected on a recurring basis. In developing this inspection program, the Contractor shall identify the key activities and associated characteristics in each process that have a significant influence on specific services and provide for methods for evaluation of the selected characteristics.
1.6.1.2.2. Deficiency Identification. The QCP shall include a method of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable as defined in the Performance Requirements Summary, TE B. This shall contain processes for corrective action without dependence upon KO direction.
1.6.1.2.3. Deficiency Correction. The QCP shall contain process control and process performance measurement procedures that shall include how the Contractor shall implement preventive corrective actions. The Contractor shall demonstrate that it has designed quality into the delivery of services thereby mitigating the risk(s) associated with delivery of deficient or nonconforming services.
1.6.1.2.4. Documentation and Enforcement. The QCP shall include a method of documenting and enforcing quality control operations of both prime Contractor and subcontractor work, including inspection and testing.
1.6.1.2.5. Trend Analysis. The QCP shall include a method of performing trend analysis and assessments with metrics.
1.6.1.2.6. Surveillance Methods. The QCP shall contain specific surveillance techniques for all contract services. The surveillance methods shall be comprehensive and adaptable to the reporting system of the plan.
1.6.1.2.7. Complaints. The Contractor shall document all customer complaints and report the complaint to the Contracting Officers Representative (COR) within one (1) workday after receipt of complaint. The Contractor shall use electronic mail or other written memoranda as notification. Each customer complaint reported to the COR shall have a scheduled completion date subject to COR approval. The QCP shall be updated, at no additional cost to the Government, as required to preclude a recurrence of the complaint.
1.6.2. Quality Assurance. The Government will monitor the Contractor's performance under this contract using Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed IAW the performance standards. The QASP defines performance standards shall be applied, the frequency of surveillance, the performance threshold, and deductions, if applicable. The Performance Requirement Summary (PRS) (TE B) in this PWS defines how the performance standards shall be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.3. Recognized Holidays. Work shall not be required on the following holidays unless specifically required by a technical requirements.

1.6.4. Hours of Operation. The contractor is responsible for conducting business, between the hours of 0730 to 1630 Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
Continuous Contractor service may be required for one or more test operations, running sequentially or concurrently day or night, or in any combination. The Government may require the Contractor to provide services on weekends or holidays to meet contract requirements, such as tests, data collection and experimentation, repair of equipment failures, and documentation generation. Test preparations, test execution, and/or post-test data reduction and report generation may require an extended workday that could require two or more work shifts or adjusted workweeks.
1.6.4.1. Other than Normal Operating Hours. The following events may affect the normal workday:
Installation Commander closes the post during the normal business day or delays opening the post to a later time than normal due to unforeseen events, i.e. inclement weather. The Contractor shall follow KO’s guidance for early release or delayed opening. However, the Contractor may utilize their own system of time off (e.g. compensatory time, time off awards, vacation time, personal time, or leave without pay) in accordance with company policy.
ADVANCED POST CLOSURE: Post is closed by the Commander prior to the start of the normal business day.
CONDITION GREEN: Normal conditions. No restrictions on driving or on installation operations.
CONDITION AMBER: Caution. Roads may be icy in spots. Exercise caution while driving. Installation operations and training continue as scheduled.
CONDITION RED: Roads are icy. Driving is hazardous and is limited to mission essential traffic only. Installation activity is limited to mission essential training and operations (i.e., national defense, health, safety, law, and order.)
CONDITION BLACK: Severe reduction of traffic flow; no vehicular movement except emergency vehicles. The post is closed to all motor vehicular traffic except emergency vehicles such as Military Police vehicles, ambulances, engineer vehicles, fire fighting vehicles, utility vehicles, and subsistence trucks.
TRAINING HOLIDAY: Work day designated by the Command, normally preceding a Federal holiday. Only applicable to active duty military members.
COMMAND CLOSURE: Time off given by the Commander to Federal and Military personnel, does not apply to contractor personnel. However, the Contractor, mission permitting and approved by the KO, may utilize their own system of time off (i.e. compensatory time, time off awards, vacation time, personal time, or leave without pay) in accordance with company policy as a result of the closure. This time shall not be charged as a direct charge to the contract.
1.6.4.2. In all cases, the Contractor shall perform requirements as directed by the KO. In the case of actual test execution, the Contractor shall coordinate with the cognizant COR or KO for guidance before dismissing employees involved in the test.
1.6.4.3. As directed by the KO, the Contractor shall comply with installation policies above for late openings and early release due to Inclement Weather conditions identified above. For reporting purposes due to inclement weather, the Contractor shall report in conjunction with the earliest report time guidance provided by the installations web link or otherwise directed by the KO. In the case of Contractor employees operating in remote locations other than Fort Sill, OK, or Fort Bliss, TX, the Contractor shall follow the policy at that installation, using the general guidelines herein.
Contractor shall provide and maintain an emergency contact list, identified as contract level or to a specific task order, and provide a copy to the KO and COR within 30 calendar days after date of contract award and for each change within two (2) working days of the change date. 1.6.4.4. Overtime. Overtime may be required for one or more of the shifts. During contract performance, overtime requirements shall be identified in test plans and shall be approved in advance by the KO. Any change to the approved overtime shall be submitted to the KO and the COR immediately upon identification. No overtime shall be performed without the express, prior written approval of the KO. Failure to obtain prior approval may result in the denial of the contractor’s request for payment for those overtime hours. The contractor shall maintain copies of all approved overtime requests in the file to substantiate reimbursement. The Contractor must maintain a workforce that covers the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons in section 1.6.4.1.
1.6.5. Place of Performance. Primary locations of performance are Fort Bliss, Texas and Fort Sill, OK. Support at other locations will be identified by individual Task Authorization Request (TARs), and may require the delivery of test support services at locations both within the continental United States (CONUS) and outside the continental United States (OCONUS). All requirements will originate from Fort Bliss, TX and Fort Sill, OK. Installation Information about Fort Bliss and Fort Sill can be found at the home pages.
1.6.6. Type of Contract. Cost Plus Fixed Fee (CPFF).
1.6.7. Security. Contractor personnel or any representative of the Contractor entering Fort Bliss, TX or Fort Sill, OK shall abide by all security regulations and shall be subject to security checks.
1.6.7.1. Search and Seizure. Contractor personnel and property shall be subject to search and seizure upon entering the confines of a military installation, while on the installation, and upon leaving the confines of the installation.
1.6.7.2. Installation Access and General Protection/Security Policy and Procedures. The Contractor shall be responsible for assuring all contractor personnel authorized to perform work under this contract obtain installation access as required by Fort Sill, OK Installation - https://sill-www.army.mil/vcc/ and Fort Bliss, TX Installation-https://home.army.mil/bliss/index.php/about/Garrison/DES/gate-information. The installation access is through obtaining a Common Access Cards (CAC). The CAC shall be returned to the Government when the employee no longer performs work for the Contractor under this contract.
1.6.7.2.1 Facility Clearance. The Contractor shall possess, or obtain, prior to contract start date, a facility clearance at the classification level of SECRET. The Contractor is periodically required to handle information classified at a higher level. When this occurs, the Government will provide an appropriately cleared facility.
1.6.7.2.2. The Contractor and all associated sub-contractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures IAW Operational Test Command (OTC) Memorandum 190-2. Contractor personnel or any representative of the Contractor entering Fort Sill, OK, Fort Bliss, Texas, or other military installation designated as a performance location shall abide by all security regulations and shall be subject to security checks. The Contractor and his employees shall observe all rules and regulations issued by the installation Commanding Officer pertaining to fire, safety, sanitation, severe weather, tobacco use control, admission to the installation, and conduct of operations. (Reference to OTC memorandums are listed in Part 6 of the PWS).
1.6.7.2.3. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
1.6.7.3. Vehicle Registration and Operation. Contractor or contractor employee motor vehicles entering any military installations designated as a performance location shall comply with military installation vehicle registration requirements as applicable. Contractor personnel shall return visitor passes, when applicable, to the Visitors Welcome Center immediately upon conclusion of the conduct of business authorized on the installation.
1.6.7.3.1. Contractor personnel operating motor vehicles on the installation shall have a valid state operator’s license for the category of vehicle being operated and shall comply with installation vehicle operation directives regarding motor vehicle use on the installation. State license, registration, and insurance shall be maintained current during the time the vehicle is in use on military installations. All vehicles shall be insured IAW Defense Federal Acquisition Regulation Supplement (DFARS) Subpart 28-3 Insurance and Federal Acquisition Regulation (FAR) 28.307-2 Liability.
1.6.7.3.2. Contractor owned vehicles used in the performance of services on military installations shall bear the Contractor’s company name/logo on both front doors or otherwise be clearly marked as commercial contractor vehicles. No unmarked vehicles or personally owned vehicles with company logos/signs affixed to them are authorized to be on Government restricted areas (i.e. motor pools) without express prior authorization IAW Fort Bliss and Fort Sill Regulation 190-5, Motor Vehicle Traffic Supervision. 1.6.7.4. Personnel Security Clearance. The Program Manager (PM) and Site Manager (SM) shall possess a Secret Clearance. All Information Technology personnel supporting Secret - Sensitive Compartmented Information (SCI) efforts shall have the SCI clearances at contract start date. Contractors requiring Joint Worldwide Intelligence Communications System (JWICS) accounts shall have North Atlantic Treaty Organization (NATO) clearances. Final clearances shall be required at contract start date for key personnel. All other contractor personnel shall possess at a minimum an interim secret clearance upon contract award. It is the responsibility of the contractor to ensure prior to performance that appropriate security clearances have been obtained. Contractor personnel who have not received required security clearances shall not be granted access to classified information nor allowed to perform classified work. A request for clearance shall be made within five (5) working days after hiring and shall contain a request for an interim clearance. Contractor personnel shall comply with Army Regulation (AR) 380-67 and AR 380-5 to include the security training requirements in AR 380-5 paragraph 9-7 and AR 380-49, Chapter 3, Section 3 mandatory training for Contractor employee who handle classified materials. The Contractor shall also comply with the Industrial Security Program IAW DoD 5220.22-M. The approved Department of Defense (DD) Form 254, TE L shall be incorporated as part of this contract. The classification of the work to be performed and the items delivered under this contract will be determined and handled IAW DD Form 254 pertaining to this contract. Check list for new Facilities: http://www.dss.mil/isp/fac_clear/fac_clear_check.html. Contractor employees performing on this contract in positions designated Army Doctrine Publication (ADP) I, ADP II, and ADP III sensitive positions, per Army Regulation (AR) 380-67, paragraph 3-54, 3-67, and Appendix K will have appropriate investigations.
1.6.7.4.1. The Contractor shall provide personnel with SECRET and/or Sensitive Compartmented Information (SCI) clearances as required in accordance with the DD Form 254, TE L, Contract Security Classification Specification.
1.6.7.4.2. All personnel hired under this contract who do not require a security clearance must have a Tier 1 (T1), formerly known as National Agency Check with Inquiries (NACI). IAW AR 25-2, all users must meet security clearance requirements in AR 380-67 for the classification level processed by the IT system they are accessing. Users must obtain the appropriate clearance and need to know for the system or network prior to gaining access.
1.6.7.4.3. Privileged users must hold a security clearance commensurate with the classification level of the information processed by the IT they are accessing.
1.6.7.4.4. Denial of Access. Contractor personnel who have not received required security clearance will not be granted access to classified information nor allowed to perform classified work.
1.6.7.4.5. Common Access Cards (CAC). All contractor employees requiring computer access will be required to obtain a CAC through the Contractor Verification System (CVS). This is a requirement for all contractors to receive a CAC through the CVS and to have access to the Government Local Area Networks (LAN).
1.6.7.4.5.1. Before CAC issuance. The contractor employee shall at a minimum, a favorably adjudicated national Agency Check with Inquiries (NACI) or an equivalent or higher investigation in accordance with Army Directive 2014-05. The Contractor employee shall have a NACI or an equivalent or higher investigation in accordance with Army Directive 2014-05. The Contractor employee shall be issued a CAC only if duties involve one of the following: (1) Both physical access to a DoD facility and access, via logon, to DoD networks on-site or remotely; (2) Remote access, via logon, to a DoD network using DoD-approved remote access procedures; or (3) Physical access to multiple DoD facilities or multiple non-DoD CAC may be issued based on a favorable review of the Federal Bureau of Investigation (FBI) fingerprint check and a successfully scheduled NACI at the Office of Personnel Management. Industrial/Company background investigations are unacceptable to receive a CAC or to have access to the LAN. Contractor shall provide the Government a Trusted Associate Sponsorship System (TASS) Application Registration Request, Army Human Resource Command (AHRC) TASS Form 1, for each employee requiring a CAC card. For CAC reverification, the contractor shall provide the Government an AHRC Form 1 every six months for each employee.
1.6.7.4.5.2. For contractors that do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.6.7.4.6. Identification and Badges. The Contractor shall provide all employees working on this contract with identification badges. As a minimum, badges shall include contractor name, contract number, contract expiration date, employee photograph, employee's name, and appropriate code for security clearance access. The badge shall be worn on the outermost garment, clearly visible, and shall be worn at all times while the employee is on duty, at a Government facility, or at a field test site.
Contractor shall ensure all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contractor shall include company name in all e-mail addresses, on facsimiles, and in written correspondence.
All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. When presenting briefings, conducting or attending meetings/seminars, contractor employees shall wear identification and introduce themselves as “contractor employees”.
1.6.7.5. Sensitive Item Storage. The Contractor shall maintain a Data Management Storage Facility at Fort Bliss, TX, IAW AR 190–51, AR 190–13, and local guidance for storing sensitive items.
1.6.7.6. Transporting Classified Material. Anytime the contractor is required to transport classified material, they must coordinate with the directorate AMDTD or FSTD Security Manager. The security manage will determined if they need a courier card or a security courier memorandum signed by the security manager. The courier card or the memorandum must be carried at all times by the contractor when transporting classified material. The classified material must be double wrapped with only the inside package marked with the classification or in an authorized lockable security bag (which will be furnished by the government
1.6.8. Physical Security. The Contractor shall implement the Government-directed Physical Security Plan. Physical Security Plan will be IAW all USAOTC, ATEC, and Fort Bliss and Fort Sill physical security procedures and regulations. The contractor shall be responsible for safeguarding all government equipment, information, and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured. The Contractor shall implement and maintain a Physical Security Standard Operating Procedure (SOP). The Physical Security SOP shall be submitted to the KO for review and approval 30 calendar days after contract award. Changes to the SOP shall be submitted to the KO for review and acceptance not later than ten (10) working days prior to the effective date of change. The Physical Security SOP must be capable of responding to both internal and external attack situations in the realm of physical security and shall provide the maximum elements necessary to ensure the safety and security of the facilities and the critical assets within, without interfering with day-to-day operational procedures. It shall address critical elements, such as Deterrence, Detection, Response, and Recovery. The Physical Security SOP will be IAW all OTC policies, ATEC and installation Physical Security procedures and regulations. All Government facilities, equipment, and materials shall be secured at all times in compliance with the Badge Access System installed on the facilities.
1.6.8.1. Handling or Access to Classified Information. The Contractor shall comply with FAR 52.204-2, Security Requirements. This clause involves access to information classified “Confidential,” or “Secret,” and requires Contractors to comply with (1) The Security Agreement (DD Form 441, TE O), including the National Industrial Security Program Operating Manual (DoD 5220.22-M); any revisions to DoD 5220.22-M. (2) The Contract Security Classification Specification (DD Form 254, TE L), and (3) AR 380-5, Department of the Army Information Security Program. The Contractor shall immediately report the loss or possible compromise of classified information or material to the COR and OTC Security Manager.
1.6.8.2. The Contractor shall obtain a courier card for transport of classified devices and information.
1.6.8.3. Reports of Adverse Information. The Contractor shall report to the COR all adverse information on Contractor personnel, such as security violations, arrests, bankruptcy, and denial, suspension, or revocation of security clearances. Employees may be denied access into restricted areas by the OTC Security Manager based upon the adverse information.
1.6.8.4. Key Control. The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost, used, or misplaced by unauthorized persons. NOTE: All references to keys include key cards. The Contractor shall not duplicate government issued keys. The Contractor shall develop procedures covering key control that shall be included in the QCP. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall report any occurrence of misplaced or lost keys to the COR and KO within 12 hours after discovery of occurrence and submit a written report to the COR and KO by close of business the next duty day. The written report shall provide complete details relating to the duplicated, misplaced, or lost key.
1.6.8.4.1. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the KO, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
1.6.8.4.2. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the KO.
1.6.8.5. Lock Combinations: The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s QCP.
1.6.8.6. Release or Disclosure of Information. Contract performance may require the Contractor to access data and information proprietary to a Government agency, another Government contractor, or of such a nature that its dissemination or use other than as specified by this PWS, or applicable TAR, would be adverse to the interests of the Government or others. Neither the Contractor, nor contractor personnel, shall divulge nor release data or information developed or obtained during contract performance, except to authorize Government personnel, or upon written approval of the KO. The Contractor shall not use, disclose, or reproduce such data, which bears a restrictive legend, except as authorized.
1.6.8.6.1. Release of News Information. The Contractor shall not release any information (including photographs and films, public announcements, statements, denial or confirmations) on any part of the subject matter of this contract, and its TARs, or any phase of any program hereunder without the prior written approval of the KO, the OTC Public Affairs Officer (PAO), and the Government Operations Security (OPSEC) Officer.
1.6.8.6.2. Disclosure of information regarding operations and services of the activity to persons not entitled to receive it or failure to safeguard any classified information that may come to the Contractor (or any persons under the contractor's control) in connection with contract performance, will subject the Contractor, contractor's agent, or employees, to criminal liability under Title 18, Section 793 and 798 of the United States Code. Neither the Contractor nor the Contractor's employees shall disclose or cause to be disseminated any information concerning the operations of the activity, which could result in or increase the likelihood of the possibility of a breach of the activity's security or interrupt the continuity of its operations.
1.6.8.7. The Contractor shall direct to the KO all inquiries, comments, or complaints arising from matters observed, experienced, or learned as a result of, or in connection with the performance of this contract, the resolution of which may require the dissemination of official information.
1.6.8.8. Inquiries received by the Contractor from non-Governmental sources for documentation regarding work performed under this contract shall be referred to the KO for evaluation under the Freedom of Information Act of 1975,Public Law 93-502,5 U.S.C. 552. The determination of whether records will be released will remain with the KO. The Contractor shall be responsible for search and submission of records upon request by the KO.
1.6.8.9. Classified Information. This document is not classified; however, the classification of the work to be performed and the items to be delivered under this contract will be determined and handled in accordance with the DD Form 254 pertaining to this contract. When the services and support being performed require access to security controlled or classified information, the Contractor shall obtain and provide personnel with the appropriate security clearance.
1.6.8.10. The Contractor shall not use any electronic information processing equipment in its possession for the purpose of processing or transmitting classified information under this contract without the written permission of the KO.
1.6.8.11. Controlled Unclassified Information (CUI). Information provided under this contract shall be safeguarded IAW AR 380-5 for protecting material. For government installations, performance of duties will be accomplished by the use of official government computer equipment. For selected activities, as denoted by the Government, classified level computers shall be used. Classified data shall only be processed on specifically approved and marked terminals and workstations for the appropriate security level(s). Technical Controlled Unclassified Information (CUI) is export controlled and must be marked with the export control warning statement cited in Department of Defense Instruction (DoDI) 5230.24 (and AR 380-5). The Contractor shall not disclose or release the content of any Government software, procedures, or information provided to the Contractor to other than Government-authorized persons or activities.
1.6.8.12. Privacy Act Information. The Government may task the Contractor, in writing, to design, develop, maintain or operate a system of records on individuals which shall be operated in conformance with the Privacy Act of 974 (5 U.S.C. 552a) and Office of Management and Budget (OMB) Circular No. 108.
1.6.8.13. The contractor shall manage and monitor telecommunications systems and services (including but not limited to telephone usage to include toll and long distance calls placed over Government phone lines and for telephone calls made via cellular phones and/or other communication systems/services) for which the contractor is reimbursed under the terms of the contract. The Defense Switched Network (DSN) is the official DoD switched voice network and is the preferred telecommunication mean when it can be utilized.
1.6.9. Special Qualifications.
1.6.9.1. Training of Contractor Personnel. The Contractor is responsible for hiring qualified personnel with appropriate certifications and for any required refresher training to maintain certifications as appropriate. The Contractor shall be financially responsible for training required to support the current assigned mission. The Contractor shall provide written justification for training and obtain advance approval from the KO for personnel to attend during normal duty hours.
Any training that is required by the Government for Contractor personnel must be recorded and reported monthly IAW TE I, CDRL A008, Personnel Status. This could include such things listed under Section 5.2.2.1. The Contractor shall maintain training requirements with new hires and current hires to include the number of contractor employees.
1.6.9.2. In-Service Training. The Government may periodically provide in-service training to Contractor personnel on a space available basis. The Contractor shall submit to the KO or his representative a written request for space for Contractor personnel attendance at Government conducted training. Government training to Contractor personnel may be provided when one of the following criteria is met:
1.6.9.2.1. The training is only available from Government sources and at no additional cost to the Government.
1.6.9.2.2. Specialized training is required by the Government in order for the Contractor to perform the technical requirement.
1.6.9.2.3. The training is directed by the Government for contractor personnel.
1.6.10. Key Personnel. Certain skilled/experienced professional and/or technical personnel are essential for successful Contractor accomplishment of the work to be performed under this contract. Key personnel are those individuals designated by the Government and/or Contractor as persons in the Contractor’s organization who provide in-depth operational testing and management experience. The follow personnel are considered key personnel by the government: one Program Manager (PM), one Site Manager (SM) and three Risk Management Framework (RMF) System Administrator and one Scientific Programmer. The Contractor shall provide a PM who shall have full autonomy and shall be responsible for the total management and coordination of the contract. The PM shall act as the central point of the contact for the Contractor with the KO and COR on all contractual matters relating to the daily operation. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the KO. The PM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The PM or alternate shall be available between 0730 and 1630, Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. The SM shall perform as the SM and the Subject Matter Expert (SME) able to perform tasks in accordance with FSTD tasking’s. RMF System Administrator shall meet DOD 8570 baseline certification to meet requirements of the RMF accreditation process, control assessment, and can use enterprise Mission Assurance Support Service (eMASS) application. The Scientific Programmer shall be specialized with ExCIS data reduction experience.
1.6.10.1. Qualifications for all key personnel are listed below: The PM will be assigned at Fort Bliss and two RMF System Administrator will be assigned at Fort Bliss, TX and one RMF System Administrator and SM will be assigned at Fort Sill, OK. The Scientific Programmer with ExCIS specialized skills in data reduction will be assigned at Fort Sill, OK.
1.6.10.1.1. Program Manager- Requires a minimum of a Bachelors (BS) Degree in Computer Science, Engineering, Math, Physics Science, or Equivalent. Requires at least ten (10) years in management positions with ten (10) years of military testing and evaluation experience.
1.6.10.1.2. The Site Manager requires a minimum of BS in Computer Science, Engineering, Math, Physics Science or Equivalent. Requires at least eight (8) years in management positions with eight (8) years of military testing and evaluation experience.
1.6.10.1.3. The RMF System Administrators shall have knowledge in Defense Information Systems Agency (DISA) Accreditation process including System Categorization, Security Controls Implementation and Assessment. Knowledge of governing policies Committee on National Security Systems Instruction (CNSSI) 1253, DoD 8500.01, DoD 8510.01, DoDI 8510.01, National Institute of Standards and Technology (NIST) SP 800-37 and NIST SP 800-37r and meet DoD 8570 baseline certification to meet requirements of the RMF accreditation process, RMF Control assessment, and use of enterprise Mission Assurance Support Service (eMASS) application.
1.6.10.1.4. The Scientific Programmer shall have five (5) years ExCIS data reduction specialized experience. Requires a BS in Computer Science, Engineering, Math, Physics Science or Equivalent as well as Security+ certification. Develop system scripts to support system development, data collection, reduction, management, analysis, and reporting. Assist in configuration and maintenance of ADP connected to the LAN. Configure and maintain network and communications software. Provides input to instrumentation designers to assure that instrumentation can receive process and output the desired data products to assure stimulations, simulations and harvested data support the requirements of Operational Test. Provides input to Engineering Technical package. Implements and maintains database with respect to access methods, access time, batch processes, device allocation, validation checks, organization, protection and security, documentation, and statistical methods; includes maintenance of database dictionaries and integration of systems through database design.
1.6.10.2. The Contractor shall notify the KO, in writing, at least two (2) weeks in advance of replacing Key Personnel. Review of replacement key personnel qualifications shall occur prior to employment/ utilization on the duties of the key personnel being replaced. All requests for approval of substitutions hereunder shall be in writing with a detailed explanation of the circumstances necessitating the proposed substitution(s). The request shall contain a complete resume for the proposed substitute, and any other information requested by the KO to approve or disapprove the proposed substitution. The KO will evaluate such requests and promptly notify the Contractor of the approval or disapproval thereof in writing before key personnel are removed, reassigned, or replaced.
1.6.10.3. Termination. The Government will review any request for replacement of key personnel to include its qualifications prior to employment/utilization of the duties the personnel is replacing. All requests for approval of substitutions hereunder shall be in writing with a detailed explanation of the circumstances necessitating the proposed substitution(s). The request shall contain a complete resume for the proposed substitute, and any other information requested by the KO to approve or disapprove the proposed substitution. The KO or authorized representative will evaluate such requests and promptly notify the Contractor of the approval or disapproval thereof in writing.
1.6.11. Contractor Personnel. The Contractor shall provide personnel with the necessary skills, knowledge, and training to perform the required support and services of this contract.
1.6.11.1. Contractor Personnel Qualifications. Contractor personnel shall possess the required experience listed for each labor category in Attachment #, Historical Data and Labor Categories. In addition to the attached experience and qualifications for labor categories, Contractor personnel performing work under this contract shall:
· Read, write, speak, and understand the English language at the Defense Language Institute (DLI) Level II.
· Be highly proficient in spoken and written technical English
· Possess training, certification(s), and experience commensurate with the work they will perform, the level of responsibility they will exercise, and personnel requirements.
1.6.11.2. Recruitment and Retention. The Contractor shall maintain methods of recruitment and retention that retain qualified skill sets, and special skills to sustain continuity of services for this contract.
1.6.12. Post Award Conference/Periodic Progress Meetings. The Contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The KO, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the KO will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.12.1. The Contractor shall attend coordination meetings with the Government to discuss status, problem areas, and future events and activities. The Contractor shall attend technical and coordination meetings and briefings. The Contractor shall provide the KO with a summary of events by email if changes are identified during the meeting that will cause contract or cost impacts.
