c. Impact if not approved: Disapproval of the J&A will result in a break-in-service and ATEC-WSMR’s failure to execute its mission in accordance with the approved testing schedule, create barriers to efficient processes, and inflate the risk of impacting the outcomes and data collected from various ongoing test missions. A break-in-service will cause a loss in data collection, data management, and resources obtained to conduct these test efforts which is estimated to be $1 million per month because of test event failures. As discussed in paragraph (4) above, attempting to compete this requirement would result in unreasonable delays and would cause mission failure for ATEC-WSMR and other tenant commands on the installation due to the lack of services.

6. Efforts to Obtain Competition: The Contracting Officer will publish the J&A sole source notice as required.

a. Effective competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting competition: The current contractor is a small business; therefore, a subcontracting plan is not required.

7. Actions to Increase Competition: The follow-on requirement is in the process of being competed as an 8(a) competitive requirement.

8. Market Research: The Government has posted two Sources Sought Notices supporting the competitive 8(a) follow-on procurement. The first Sources Sought Notice (SSN) was posted on 12 October 2021 through 12 November 2021 and received 20 responses from 8(a) vendors. Nine of these vendors were determined to be capable of performing the follow-on requirement. The second SSN was posted on 23 March 2023 through 30 March 2023 seeking comments on an updated performance work statement.

While there is abundant interest in the follow-on requirement, there is not adequate time to compete an interim short-term requirement without occurring a break-in-service and impacting ongoing test and evaluation of DoD programs. A SSN was not issued for this 14-month extension due to the waiver approved by Mr. Wade C. Cole, SES, Deputy to the MICC Commanding General.

9. Interested Sources: Given the approved SSN waiver executed in accordance with DFARS PGI 206-302-1(d), no notices were posted to SAM.Gov for this interim action.

10. Other Facts:

a. Procurement history: The TEAS contracts has historically been awarded under the Small Business Administration (SBA) 8(a) program with a Cost-Plus-Fixed-Fee (CPFF) contract type.

1) W91151-18-C-0013 was awarded on 20 March 2018 for a total contract value of $73.1 million for a period of performance of 1 June 2018 through 31 December 2023.

Approval

Based on the foregoing justification, I hereby approve the procurement of Test Engineering and Analysis Services (TEAS) on other than full and open competition basis pursuant to the authority of 10 United States Code 3204(a)(1) as implemented by Federal Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. The estimated value of the award is for up to a 14-month extension of the period of performance from 1 January 2024 through 29 February 2025. The approval is subject to availability of funds, and provided that the services herein described have otherwise been authorized for acquisition.
