Control Number Hood-2017-1
SOLE SOURCE JUSTIFICATION AND APPROVAL
Sigmon Frequency Surveillance Software White Sands Missile Range, New Mexico
1. Requesting Agency: White Sands Missile Range Information Management Directorate
2. Contracting Agency: MICC- Fort Hood, Texas
3. Description of Action: A software maintenance contract for the Sigmon Frequency Surveillance System (FSS) at White Sands Missile Range (WSMR).
4. Description of Service: Software maintenance shall be done through a combination of maintenance, technical, telephone, and online support, software updates, installation of new hardware, and site visits. The estimated value of this requirement is $650,308.00 which includes the base year and four option years.
5. Authority cited: The statutory authority permitting other than full and open competition is 41 U.S.C. 1901- Simplified Acquisition Procedures as implemented by FAR subpart 13.501(a).
6. Rational to support cited authority: SAT Corporation created the SigMon Software and is the only company that is able to perform maintenance or other software support. Other companies are not able to provide the level asked unless they have access to the software source code. SAT Corporation has not authorized or entered into a non-disclosure agreement with other companies. Allowing other companies to work on the software would increase the price to the Government. A new contractor would have to replace the software and enter new codes. This would place the Frequency Surveillance System out of service until the new software is uploaded. This would not be in the best interest of the Government.
7. Efforts to promote competition: A sources sought synopsis was posted to Federal Business Opportunities (FBO) on 17 October 2016 and closed on 31 October 2016. There were no responses received.
8. Fair and Reasonable Determination: In accordance with FAR 13.106-3(a)(2)(ii) the price is determined to be fair and reasonable based on comparison of the proposed price with prices found on previous purchases. The previous two purchases of software maintenance in 2014 was $144,266.00 and in 2015 it was $154,097.08. The estimated price of $164,598.10 for the base year 2016 is reasonable. This price is attributable to increases in wages, fringe benefits, and taxes payable.
9. Market Research: A Sources Sought synopsis was posted to FBO and there were no interested vendors for this requirement. Therefore, this requirement will be sole source to SAT Corporation.
10. Other factors to support other than full and open competition: None.
11. Interested sources (if applicable): None
12. Actions to remove or overcome barriers to competition (if any): None
13. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.
