Contracting Office Control Number: Hood 2016 7
BRAND NAME JUSTIFICATION
FAR SUBPART 13.5 LIMITED SOURCES
OTHER THAN FULL AND OPEN COMPITITION
1. Contracting Activity: MICC –Fort Hood, 1001 761st Tank Battalion Avenue, Room W103, Fort Hood, Texas 76544-5025.
2. Description of Action: Approval is requested for Brand Name Justification to purchase TLD- 400 Thermoluminescent Dosimetry Material for Survivability, Vulnerability, and Assessment Directorate (SVAD), White Sands Missile Range (WSMR).
X An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: Fifty Eight Thousand Two Hundred Fifty (58,250 each) CaF2:Mn /TLD-400 chips, 1/8” x 1/8” x 0.035. Total Value:
4. Authority Cited: The procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C
5. Reason for Authority Cited: SVAD Dosimetry Lab’s mission is to perform gamma radiation testing. They use TLD Readers in order to perform their mission of testing for gamma radiation.
The CaF2:Mn TLD-400 chip must be placed in the TLD Reader. The chips are consumed in use.
Thermo Fisher Scientific is the sole manufacturer of both the chip and the reader. No other method of gamma radiation testing is available that can provide fast and reliable gamma readings for the customer.
For only one source or a limited number of sources under FAR 6.302-1 follows as brand name:
Thermo Ebeline LLC, a part of Thermo Fisher Scientific is the manufacture company that makes this dosimeter has distributors across the United States. The unique feature about this supply is correct dimension, concentration of Mn in CaF2 and quality control when making the chip with the proper standard deviation. The capabilities of the TLD-400 Chip are essential in WSMR gamma testing environment to accomplish their mission.
Brand name justification IAW FAR 6.302-1(A)(2)(ii)(A) or (iii)(A), is part of the Government estimated cost to manufacture this chip with the correct materials in correct proportions and measurement; therefore, an estimate of the cost that would be substantially duplicated (not expected to be recovered through competition).
Competition is limited because there is no other manufacturer. This manufacturer has patents, proprietary data and copyright on the TLD-400. Customer indicated the most important consideration was to solicit based on salient characteristics of the supply due to the unique features of the product.
Due to the particular requirement of the product, this requirement is a brand name item;
peculiar to one manufacturer.
General Requirement: The contractor shall provide TLD-400 chips which are 7% std. dev.
from a single batch. The chips shall be 1/8” x 1/8” x 0.035” in size. Control of Mn dopant is critical to the performance of the TLD.
Failure to meet these specifications would result in SVAD Dosimetry Lab losing its ability to perform its mission of gamma radiation testing. The dimensions of the chip are specific. Other sizes cannot be used with existing equipment. No other method for fast and reliable gamma radiation testing is available to the customer for supporting the warfighter.
6. Efforts to Obtain Competition: Sources sought was posted on 7 Jun 2016. Two small businesses expressed interest via e-mail.
Market research identified a number of small business retailer/ distributers capable of competing for this requirement. Two small business expressed interest in competing along with the manufacturer:
1. Owens Scientific, Inc. POC: Betty Hail email: sales@owensscientific.com (small business)
2. Government Scientific Source. POC: Jeannie Ruiz jruiz@govsci.com (small business) Address: 12351 Sunrise Valley Drive Reston Va. 20191.
Phone: 800.248.8030 x 160
3. Manufacturer information: Thermo Fisher Scientific; POC: Jennifer Brown, Inside Sales Representative Address: 27 Forge Parkway / Franklin, MA 02038 Tel: +1 (508) 553-1508 / Fax: +1 (508) 520-2815 jennifer.brown1@thermofisher.com / Caution-http://www.thermoscientific.com/rmp
The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.
Effective competition will be achieved. This requirement will be a 100% small business set-aside. Every effective will be made to ensuring that multiple quotes are received. Quotes will be solicited and the award will be made to the lowest vendor.
7. Actions to Increase Competition: The actions taken to increase competition will be monitoring for possible new sources of CaF2: Mn TLD-400 chips with the appropriate material, form, dimensions, and quality.
8. Market Research: The following market research techniques were employed:
1) Performed an Internet searches across (Yahoo.com, Google.com, Ask.com, Dogpile.com, SAM and GSA) databases including the SBA DSBS data base revealed no other sources available for the manufacture of CaF2:Mn dosimeters, TLD-400 chips.
2) Posted a Sources Sought Synopsis on FEDBIZOPS to identify potential sources.
3) Reviewed existing industry base utilizing search engines on the Internet.
4) Investigated the NAICS database utilizing code 541380 to determine the acceptability of businesses utilizing this NAICS code.
4) Investigated the GSA database to determine the availability of small business to meet this requirement by utilizing the NAICS code and keyword – TLD.
5) Spoke with technical experts regarding how the chips are used, possible sources of supply and historical information.
Review of Existing Industry Base: After reviewing the existing Industry Base, only one manufacturer was found who provides the required TLD-400 chip. Other vendors provide gamma radiation detection and testing equipment, but the equipment is not compatible with the TLD Readers currently in use by the customer, SVAD Dosimetry Laboratory. Only one company produced the TLD-400 chip in the needed configuration size, 1/8” x 1/8” x 0.035” which is compatible with the TLD-400 Readers.
•Radiation dosimetry (i.e., radiation testing) laboratories or services •Radiation testing laboratories or services
NAICS Review: After reviewing the NAICS database, the best NAICS code was found to be 541380 for “Testing Laboratories.” This is due to the fact that the TLD (reader and chip) is an application specific device that is made for gamma “radiation testing.” No other NAICS code addresses “radiation testing” laboratories or services.
a. Was AbilityOne offered new services or services currently being performed by a large business? The AbilityOne website was reviewed and no products are offered to meet this requirement. This is not unexpected, due to the unique technical knowledge and significant infrastructure required to manufacture TLD technology.
b. What did the analysis of the information obtained through the Central Contractor Registration (CCR) database reveal? The SAM website was reviewed for the NAICS code and revealed there is 1 company that can support this requirement.
c. What capabilities of Small Business concerns were identified? Was the Office of Small Business Programs, contacted? The SBA website was reviewed utilizing the key words of TLD and 541380 NAICS code to identify the viability of utilizing small business.
Interested Sources: There are different retailer / distributors able to provide quotes. There were two small business companies that showed interest via e-mail responses to a sources sought announcement. Also, there is only one manufacturer found during market research. They are as follows:
1. Owens Scientific, Inc. POC: Betty Hail email: sales@owensscientific.com (small business)
2. Government Scientific Source. POC: Jeannie Ruiz jruiz@govsci.com (small business) Address: 12351 Sunrise Valley Drive Reston Va. 20191.
