MICC 2016-2
Office 2016-1
Justification and Approval For Other Than Full and Open Competition
1. Contracting Activity: Mission and Installation Contracting Command (MICC)- Fort Hood, Contract Management Division, 1001 761st Tank Battalion Ave, Room W103, Fort Hood, TX 76544-5025
2. Description of Action: Request approval to award a five (5) month Cost Plus Fixed Fee (CPFF) sole source interim contract to the incumbent contractor, Glacier Technologies, to perform non-personal services required to support the operational test, data collection, and experimentation mission of the Integrated Test and Evaluation Directorate (ITED), and Fires Test Directorates (FTD). Research, Development, Test & Evaluation (RDT&E) funds are available for this action upon contract award. The estimated value for the extension is $7.6M.
3. Description of Supplies/Services: The proposed interim contract is for the U.S. Army Operational Test Command (USAOTC) that has a statutory mission to conduct independent operational tests for material and equipment prior to full scale production in accordance with 10 U.S. Code Section 2399. This contract provides services in support of USAOTC test mission. The contractor shall provide all labor, management, supervision, supplies, materials, equipment, and tools, not otherwise provided as Government Furnished Property (GFP), to perform the non-personal services required to support the operational test, data collection, and experimentation mission of the USAOTC’s Fires Test Directorate (FTD) and Integrated Test and Evaluation Directorate (ITED). The contractor may also be required to perform testing, data collection, and experimentation in support of combined developmental and operational test, joint and multi-service tests, training activities, and other Department of Defense (DOD) activities. Primary locations of performance will be Fort Bliss, Texas and Fort Sill, Oklahoma. Other locations will be identified in individual task orders, and may require the delivery of test support services at locations both within the continental United States (CONUS) and outside the continental United States (OCONUS). The resultant contract will also provide for the support to other ATEC and DOD activities whose requirements are within the contract’s scope. The contract will consist of the following general requirements:
a. Test operations support that includes test planning, field test support, data collection and reduction, data base management, and support for test report preparations.
b. Test operations logistics support that involves the preparation and maintenance, as required, of the test site.
c. Maintenance and non-developmental item (NDI) enhancement to existing test instrumentation systems that are provided to the contractor as GFP.
d. Maintenance and dispatch services for test support vehicles and generator fleet.
Office 2016-1
e. Provide instrumentation, interfaces, platform installation kits, data reduction tools, data visualization tools, and test support tools. Write software and firmware as required.
Operated Government-provided instrumentation.
4. Authority Cited: 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: This proposed interim contract is critical to allow for continuity of service after the current task orders period of performance ends on 30 October 2015. The follow-on contract for the Test and Evaluation Technical Support Services (TETSS) contract is not expected to be awarded until 8 March 2016. The incumbent contractor, Glacier Technologies, is the only contractor that can continue performance of this contract without causing mission failure for numerous test events. Allowing a break in service would cause unacceptable delays in ongoing efforts. Please see firm schedule of ongoing tests below listed in justification.
a. Justification:
(1) A break in service will result in mission failure and severely impact eleven (11) test events in the planning or execution stage. The most immediate impact will be to the Terminal High Altitude Area Defense (THAAD) Flight Test (FTT) -18 and Flight Test Operational (FTO) -02 currently underway at Wake Island. THADD is a multi-billion dollar program with over $299M in RDT&E efforts in FY15. A break in service will cripple the current data collection efforts and have a subsequent impact on the Program Manager's development schedule at great cost and risk. Delays will ultimately impact Soldiers and national defense. There are additional programs in the planning and execution stages. A break in service will result in loss of contractor personnel, and impact the respective Program Manager's schedule for development/deployment or modifications/upgrades to systems at a great cost, negatively impacting our Soldiers. These scheduled programs include: Advanced Field Artillery Tactical Data System (AFATDS) 6.8.11 Government Confidence Demonstration (GCD), Electronic Warfare Planning and Management Tool (EWPMT) GCD, Joint Tactical Ground Station (JTAGS) Pre-Planned Product Improvement (P3I) Limited User Test (LUT), Integrated Air and Missile Defense (IAMD) LUT, Laser Target Locator (LTLM) II Developmental Test (DT) Support, Army Tactical Missile System (ATACMS) MOD, Patriot Post Deployment Build (PDB)-8 Initial Operational Test (IOT), M109 Family of Vehicles (FOV) IOT, and Command Post Computing Environment (CP CE) Customer Test (CT) and unscheduled programs that may arise.
(2) A break in service will result in mission failure for ITED and FTD infrastructure and a loss of valuable expertise, time, and money. The TETSS supports IT and help desk services, video teleconferencing (VTC), security, data management, and logistics. Ongoing technology efforts will be delayed, such as the ATEC Precision Event Tracing System – Real Time Casualty Assessment (RTCA) system development, radio and RF network development (in progress and on track for a 22 November completion), and Risk Management Framework (RMF) (a break in service will impact use of hardware/software systems for use in test events). Additionally, this interim contract would support the maintenance and sustainment of 40 vehicles, 14 antenna towers, and numerous
Office 2016-1 instrumentation data collection suites, all which would suffer degradation without experienced and knowledgeable oversight.
(3) The incumbent contractor, Glacier Technologies, is uniquely qualified to perform the requirements of this interim contract. As demonstrated through its successful performance, annotated in the COR monthly reports and CPARS evaluations, Glacier Technologies already has on hand the specialized expertise necessary for operational testing, operation of unique instrumentation, and fire support modeling and simulation equipment and software. As these skills are not readily available in the workforce, another contractor would not be able to assemble the required trained workforce on short notice to seamlessly assume the performance of these ongoing tests and services. Nor would it be able to acquire all needed equipment. It will take up to two years to complete a separate source selection process to identify another contractor with the necessary qualifications to perform this requirement. A re-compete would not be logical since the current source selection process is underway for a follow-on contract. An interim contract will allow for the time necessary to properly conduct a thorough and complete source selection.
Recommendation
b. Alternatives Considered.
(1) No contract support after the current period of performance until award of the follow-on contract. This alternative will result in mission failure and result in serious injury to current and future programs. Impact will not only be financial, but will delay in development and fielding of critical systems as described in paragraph 5.a. (1). Therefore, this alternative is not viable and will result in mission failure.
(2) Use of in-house resources. The USAOTC relies heavily on contracted test support services. USAOTC lacks sufficient manpower, technical expertise and resources to perform the required test support services. This alternative is also not viable and will result in mission failure.
(3) Short-term award to another contractor. There is insufficient time to complete a source selection for a qualified contractor as described in paragraph 5.a. (3). This alternative is also not viable and will result in mission failure.
6. Efforts to Obtain Competition:
a. Effective Competition: Effective competition for this interim contract is expected for the follow-on contract. It is being competed under the competitive 8(a) program under solicitation W91151-14-R-0002 and more than two proposals were received in response to the solicitation.
b. Subcontracting Competition: The current contractor has and will continue to use a small business subcontractor. The subcontractor used on the current contract is a 8(a) Alaskan Native Corporation and will be the same subcontractor used on the interim contract. The Government will continue to review and verify the contractor’s subcontracting plan.
Office 2016-1
7. Actions to Increase Competition: It is not possible to compete this interim contract due to short timelines from information provided by the customer in regards to ongoing and upcoming test. The follow-on contract is currently undergoing a competitive re-compete but will not be awarded before the period of performance ends on the current task orders.
8. Market Research: Market research was conducted for the follow on requirement and historically this requirement has been awarded as a negotiated procurement under the authority of Section 8(a) of the Small Business Act as codified in FAR 19.8, and solicited according to the policies and procedures of FAR Part 15, and DFARS PGI 219.800. Based on the responses received from industry, customer feedback and acquisition history, a determination was made to continue to set this requirement aside for 8(a) small business concerns. An 8 (a) Offering Letter was sent to the Dallas Fort Worth District Office of the U.S. Small Business Administration and accepted on 17 January 2014.
9. Interested Sources: The sources sought notice required by FAR 5.201 was posted to Federal Business Opportunities on 5 October 2015 with a closing date of 19 October 2015.
The notices required at FAR 5.201 will be posted and any responses received shall be considered.
10. Other Facts:
a. Procurement History: Contract No. W9115U-10-D-0001 was awarded 23 November 2009 to Glacier Technologies, LLC at an estimated contract value of $45M in support of USAOTC’s operational testing mission at Fort Bliss, Texas. The acquisition was an 8(a) direct award with 10 U.S.C. 2304(c) (5) as the authority for using other than full and open competition. The period of performance was for five (5) years from 20 November 2009 to 19 November 2014. On 21 May 2010, the contract maximum of this contract was increased to $68M in order to include test support requirements for FTD at Fort Sill, Oklahoma. On 13 November 2014 the contract was modified to extend the contract in accordance with FAR 52.217-8 for a period of 6 months from 20 November 2014 through 19 May 2015. At that time, the maximum of the contract was also increased to $74M. Prior to the expiration of the contract extension, six (6) Task Orders were issued to provide continuous support through 31 October 2015 under the estimated award date of the follow on contract being 1 October 2015.
b. Currently the follow on contract is in the source selection phase.
Office 2016-1
Approval
Based on the foregoing justification, I hereby approve the procurement of a five month extension for an estimated cost $7.6 million to the incumbent, Glacier Technologies, for Test Support Services on an other than full and open competition basis pursuant to the authority of 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements, subject to the availability of funds and provided that the services herein described have otherwise been authorized for acquisition.
