FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Requiring Activity: United States Army Operational Test Command, Air and Missile Defense Test Directorate (AMDTD) and Fires Support Test Directorate (FSTD), Fort Bliss, Texas, and Fort Sill, Oklahoma.
3. Description of Action: Request approval of a 3-month extension to the existing 102-month ordering period for the Test and Evaluation Technical Support Services (TETSS), Indefinite Delivery Indefinite Quantity (IDIQ), Cost-Plus-Fixed-Fee (CPFF) contract (W9115116D0007) with SAWTST, LLC, 500 Swanson Rd Suite #4, Tyrone GA, 30290. This is an interim action to allow continued performance with the incumbent contractor. In accordance with Defense Federal Acquisition Regulation Supplement 217.204(e)(i)(C), contracts shall not exceed 10 years unless the head of the agency determines in writing that exceptional circumstances require a longer ordering period.
This extension will allow a total ordering period of 105 months. Modification P00030 was issued on 18 April 2025, and with options extended the ordering period from 19 April 2025 through 18 October 2025. This requested 3-month extension to the TETSS contract is needed until the follow-on award can be competitively awarded in January 2026. The extension will be incrementally funded through task orders using fiscal year (FY) 2025 Research, Development, Test & Evaluation (RDT&E) funds.
4. Description of Supplies/Services: U.S. Army Operational Test Command (USAOTC) has a statutory mission to conduct independent operational tests for materiel and equipment prior to full-scale production in accordance with Title 10 U.S. Code Section 2399. This contract provides services in support of the USAOTC test mission.
The contractor shall provide all labor, management, supervision, supplies, and materiel to perform non-personal services required to support the operational test, data collection, and experimentation mission of USAOTC for test support services located at Fort Sill, OK and Fort Bliss, TX. The contractor shall be required to perform testing, data collection, and experimentation in support of combined developmental and operational tests, joint and multi-service tests, training activities, and other Department of Defense activities. The contract will consist of the following general requirements.
a. Test operations support that includes test planning, field test support, data collection and reduction, database development and support for test report preparation as well as developing software and/or execution scripts as required.
b. Test operations logistics support that involves the preparation and maintenance, as required for test events.
2. Contracting Activity: United States Army Mission and Installation Contracting Command - Fort Hood (MICC-FH), 36000 Shoemaker Lane, Fort Hood, TX 76544-
c. Maintenance and non-developmental item enhancement to existing test instrumentation systems used during test operations.
d. Maintenance and dispatch services for test support vehicles and power generation equipment.
e. Design and build prototype instrumentation suites and associated mounting hardware as needed. Develop needed software and/or execution scripts to support system under test data collection and/or processing requirements.
Period of Performance: 19 October 2025 to 18 January 2026 Total Value: $2.89M
5. Authority Cited: 10 U.S.C. 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii)(B) - Only one responsible source and no other supplies or services will satisfy agency requirements for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agencys requirements.
6. Reason for Authority Cited: Pursuant to FAR 6.302-1 (a)(2)(iii)(B), when the supplies or services required by the agency are available from only one responsible source, or for Department of Defense (DoD), National Aeronautics and Space Administration (NASA), and the Coast Guard, from only one or a limited number of number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full an open competition need not be provided. For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agencys requirements. No other contractor can assume the TETSS mission with full performance by 19 October 2025, without USAOTC organizations and tenants experiencing mission stoppage. There are no comparable contracts, providing comparable services and technical expertise, which can assume the required mission support. Even if there were time required to solicit, evaluate, award and transition contractor support, it would result in a significant break in service to USAOTC due to the provision of highly specialized services. It is estimated that award to any other source would result in unacceptable delay of up to 12 months in fulfilling the agencys requirements.
a. Background.
1) A post award protest # B-423099 was submitted to GAO on 15 October 2024 following the preliminary award of a follow-on contract. Modification W91151-16-D-0007 P00029 was executed on 18 October 2024 to avoid a lapse in service on 19 October and to continue performance while GAO reviewed and rendered a decision on the protest. This modification was authorized by Justification and Approval (Control Number to adequately recruit and staff a trained workforce. This alternative is not viable and is not in the Governments best interest.
3) Conduct a competitive acquisition for a bridge contract. There is insufficient time to competitively solicit, evaluate and award a new contract, conduct phase-in activities, conduct property inventories, obtain security clearances and familiarize a new contract work force with the ongoing test mission. Any contractor other than the incumbent does not have a sufficiently knowledgeable workforce readily available to immediately assume the USAOTC test mission. This alternative is not viable and is not in the Governments best interest.
4) Extension of the current contract. Negotiating a 3-month extension of the current contract with the incumbent is a viable solution that provides continuity of support to the USAOTC mission. This alternative ensures there is no degradation of support to the highly technical requirements of the contract.
c. Impact if justification not approved. Not approving this extension will result in a lapse in service and USAOTC failure to execute its operational testing mission during this 3-month time frame as well as impacting planning for future testing in accordance with the approved testing schedule. Without this extension, USAOTC cannot meet its statutory requirements in accordance with10 U.S.C. Sections 139 and 2399.
7. Efforts to Obtain Competition: The Contracting Officer will publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.
a. Effective competition: Because this is a sole source action, effective competition is not applicable.
b. Subcontracting competition: The current contractor is a small business; therefore, a subcontracting plan is not required.
8. Actions to Increase Competition: A sources sought was posted to the SAM.gov website on 09 October 2025 to inform industry of the 3-month extension to the current contract with responses due from vendors by 14 October 2025. One response was received on 14 October 2025 and was submitted for technical evaluation and found to be technically unacceptable. The long-term follow-on requirement will be a 8(a) competitive award requirement estimated to occur in January 2026. On 14 October 2025, a corrected copy of the sources sought with the intent to sole source (6.302- 1(a)(2)(iii)(B) was published and closed on 15 October 2025. One response was received that expressed interest. However, the vendor did not submit a statement of capability.
9. Market Research: Market research was conducted in accordance with FAR Part 10 and in accordance with Defense Federal Acquisition Regulations Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance, and Information

14. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. This determination will be made using cost analysis in accordance with FAR 15.404-1(c) and the independent government estimate. As a part of this basis, certified cost or pricing data will be required due to this being a non-competitive, non-commercial action exceeding the threshold for obtaining certified cost and pricing data established in FAR 15.403-4(a)(1).

The estimated value of the modification is $2.89 million for a three-month extension to extend the ordering period from 19 October 2025 through 18 January 2026.
