JUSTIFICATION DOCUMENT
FOR OTHER THAN FULL AND OPEN COMPETITION
Test Support Services for the United States Army Operational Test Command (USAOTC), Fort Hood, TX
CONTRACTING AGENCY: Mission and Installation Contracting Command (MICC)- Fort Hood, Contracting Division, 1001 761st Tank Battalion Ave, Room W103, Fort Hood, TX 76544-5025
DESCRIPTION OF ACTION: Request approval to extend the current Cost Plus Fixed Fee (CPFF) bridge contract for 30 days from 25 September 2014 to 24 October 2014 for test support services at Fort Hood, Texas. Research, Development, Test & Evaluation (RDT&E) funds are available for this action upon contract award. The estimated value for the extension is $6.3 million.
DESCRIPTION OF SUPPLIES/SERVICES: U.S. Army Operational Test Command (USAOTC) has a statutory mission to conduct independent operational tests for material and equipment prior to full scale production in accordance with 10 U.S. Code Section 2399. This contract provides services in support of USAOTC test mission. The contractor provides all labor, management, supervision, supplies, materials, equipment, and tools, not otherwise provided as government furnished property (GFP), to perform the non-personal services required to support the operational test, data collection, and experimentation mission of the USAOTC. The contractor is also required to perform testing, data collection, and experimentation in support of combined developmental and operational test, joint and multi-service tests, training activities, and other Department of Defense (DOD) activities. The contract consists of the following general requirements:
Test operations support that includes test planning, field test support, data collection and reduction, data base management, and support for test report preparations.
Test operations logistics support that involves the preparation and maintenance, as required, of the test site.
Maintenance and non-developmental item (NDI) enhancement to existing test instrumentation systems that are provided to the contractor as GFP.
Maintenance and dispatch services for test support vehicles and generator fleet.
Design and build prototype instrumentation and brackets, and build or have built designed items. Write software and firmware as required.
AUTHORITY CITED: 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition (FAR) 6.302-1(a)(2)(iii), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Needs.
REASON FOR AUTHORITY CITED: The extension of this current contract is necessary to provide continued support for ongoing operational test activities and test support for multiple Army and Department of Defense level programs executed by USAOTC during the period required to complete award of the competitive follow-on acquisition, conduct debriefing of the unsuccessful offerors and 10 day GAO protest window. Without continuing contract coverage, USAOTC will not be able to execute its test support mission. Disruption of on-going testing requirements will result in critical mission failure and unacceptable delays in the deployment of weapons and communications systems to the Warfighter in the field. This will also have a significant negative impact on the success of overseas contingency operations.
Justification:
This contract extension is for the continued provision of highly specialized services and award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. If the current bridge contract is allowed to expire prior to award and phase-in of the competitive award of the follow-on contract, USAOTC will be unable to execute operational testing in accordance with its program’s approved acquisition schedule – which would constitute mission failure in meeting its statutory requirements in accordance with 10 U.S. Code sections 139 and 2399. Mission failure is not an option. Delays in fielding the Army’s and Joint Services’ most vital systems will result in irreparable damage to the United States National Security. Failure to maintain contractor support will negatively impact OTC Fort Hood Test Directorates and the Airborne and Special Operations Test Directorate’s mission. There are currently over fifteen (15) tests currently being supported by this contract including the Business Information Training Modernization Auditability Program (BITMAP), Integrated Personnel and Pay System- Army (IPPS –A), Nett Warrior, Husky Mounted Detection System (HMDS), Joint Light Tactical Vehicle (JLTV), Forward Operational Assessment (FOA), Logistics Modernization Program (LMP), Medium Mine Protected Vehicle (MMPV1), Mid-Tier Networking Vehicular Radio (MNVR), Network Integration Event (NIE) Logistics, and the Warfighter Information Network – Tactical (WIN-T). It is vital that uninterrupted support continues to avoid substantial duplication of cost to the Government that is not expected to be recovered through competition, or unacceptable delays in fulfilling the agency’s requirements.
Direct test support for ongoing tests has an estimated cost of over $6.3M during this extension period. The incumbent contractor, Combined Technical Services (CTS) is already postured to continue performance; its personnel are familiar with required contract terms and conditions and are intimately familiar with operational tests that are currently underway. There will be no degradation of services in this highly technical requirement. Another contractor does not have sufficient equipment and trained manpower readily available on short notice to seamlessly assume the performance of these ongoing services. Additionally, award of a short term contract would result in substantial non-recoverable duplicative costs for verification of data, changes in personnel, familiarization with on-going tests estimated to be $6.3 million ($6.3 million for CTS to assist/instruct a new contractor and $6.3 million for the new contractor personnel) that would not be recaptured through competition. Extending this contract with CTS for 30 days is in the best interest of the Government.
In the unlikely event there is a protest of the competively awarded follow-on contract that extends beyond 24 October 2014, it is the intention of the Government to exercise an additional contract extension to allow the Government to minimize the risk of duplication of costs to the maximum extent practicable while fully supporting the Army, the USATOC and its mission during the protest period.
Alternatives –
Suspension of Contract support. The support services provided by the test support contractor are ongoing and critical to mission accomplishment. Suspension of the test support services would cause major, if not critical, disruption to the USAOTC’s mission. Therefore, this alternative is not viable.
Use of In-House Resources. The USAOTC relies heavily on contracted test support services. USAOTC lacks sufficient manpower, technical expertise and resources to perform the required test support services. This alternative is also not viable.
Award a competitive contract. A re-award of a competitive contract is currently underway. However, there is insufficient time for MICC to award the contract before the current interim Test Support Contract expires on 24 September 2014.
Justification – USAOTC requires contract services to meet their statutory mission of testing and evaluating weapons and communications systems for the Department of the Army. Continued contract support for ongoing test missions is vital while corrective actions are being implemented. Considering the fact that the current contract is about to expire and there is no other contract mechanism in place; there is no other option but to extend the current contract with CTS to continue current and ongoing test support to over 15 critical programs. Another contractor does not have sufficient equipment and trained manpower to seamlessly assume the performance of these ongoing services during such a brief interim period. Extending this contract with CTS as opposed to attempting to compete this interim requirement is in the best interest of the government.
The contractor CTS is already postured to continue performance; they are familiar with required contract terms and conditions and are intimately familiar with operational tests that are currently underway. There will be no degradation of services in this highly technical requirement. Use of another contractor is not feasible because there is insufficient time to re- award the new contract, phase-in a new contractor and transfer and account for the large inventory of Government Furnished Property. There would be significant degradation in test support as contractors’ transition in the midst of testing.
EFFORTS TO OBTAIN COMPETITION: A full and open competition of these services is currently underway. This is an extension on an interim bridging action required to complete the corrective action on the full and open competition for the performance of USAOTC testing services.
ACTIONS TO INCREASE COMPETITION: See paragraph 6, above
MARKET RESEARCH: Market research was completed for this requirement on 15 April 2014, and sources evaluated for their ability to support this requirement.
This requirement is for non-commercial services. Therefore, FAR 8.002 and its subparagraphs are not applicable to this requirement.
AbilityOne impact study results – It was determined that AbilityOne resources would not be practical for this requirement. AbilityOne’s Program was considered for the motor pool operations requirement only (fleet management), during the follow-on market research. AbilityOne appeared to be more than capable of managing motor pool operations. However, they did not appear capable of supporting other test support requirements such as the operational testing, experimentation and modeling/simulation mission support. The operational test support mission requires the contractor to manage motor pool fleet vehicle maintenance requirements, support test planning/test execution requirements and provide all logistical test support requirements. USAOTC’s test support vehicle management, logistical support, testing and evaluation are all so integrally linked they cannot be separated without losing responsive test support capabilities. AbilityOne is not capable of meeting all contract test support services requirements that are contained in the PWS.
GSA e-Library was searched and based on the test support services requirement being non- commercial, there were no contract categories found for utilizing the term “test support services.”
Market research was conducted on Thomas Register utilizing the terms “test support services,” there were no results returned for the term used in the search.
