JUSTIFICATION DOCUMENT
FOR OTHER THAN FULL AND OPEN COMPETITION
Pre-Deployment Training Equipment (PDTE) Maintenance Services at Camp Atterbury, IN.
1. CONTRACTING AGENCY: Mission and Installation Contracting Command – Fort Hood, Texas.
2. DESCRIPTION OF ACTION: Request approval to issue a Firm Fixed Price sole source, requirements type, contract for PDTE Maintenance to Automation Precision Technology, LLC. The proposed contract will consist of a 3-month base period (1 May 2013 through 31 July 2013) and three (3) three-month option periods that could potentially extend the contract period to 30 April 2014. Task orders issued under this contract will use FY13 Operations and Maintenance, Army (O&MA) funds (or FY 14 O&MA funds if task orders are issued on or after 1 October 2013).
3. DESCRIPTION OF SUPPLIES/SERVICES: A brief synopsis of the requirement extracted from the Performance Work Statement (PWS) is as follows:
The Contractor shall provide all management, administration, administrative supplies and materials, and labor, except as specified as government-furnished in the PWS, necessary to augment the Garrison with trained personnel to provide multi-functional Pre-Deployment Training Equipment maintenance to support the mobilization and demobilization mission of Camp Atterbury, Indiana in strict accordance with the terms and conditions specified within the contract.
The Independent Government Cost Estimate (IGCE) for this procurement is $437,508 for the three-month base period and $1,750,032 for the base period and three (3) three-month option periods.
Performance of this requirement is anticipated as follows:
| Base Period: | 1 May 2013 through 31 July 2013 | |
| Option Period 1: | 1 August 2013 through 31 October 2013 | |
| Option Period 2: | 1 November 2013 through 31 January 2014 | |
| Option Period 3: | 1 February 2014 through 30 April 2014 |
The period of performance may shift to the left if this acquisition can be completed sooner. The services are required as soon as possible.
4. AUTHORITY CITED: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. REASON FOR AUTHORITY CITED: The Army Sustainment Command (ASC) is in the process of awarding an enterprise wide solution for Integrated Logistics Support Services (ILSS-II), which will include PDTE maintenance services. This bridge contract is necessary to provide maintenance support for the PDTE at Camp Atterbury, Indiana until the ILSS-II contract can absorb this requirement.
Award of the ILSS-II contract has been delayed by protest making it necessary to issue a bridge contract for this interim period. Award of the ILSS-II is currently projected to be on or about 10 May 2013. However, the requested bridge contract will contain options to allow for continued services until 30 April 2014 in order to mitigate the risk of additional delays (another protest) and to allow sufficient time to transition services between the ILSS-II contractor and Automation Precision Technology, LLC (if a contractor other than Automation Precision Technology, LLC wins that competitive effort).
Services can only be satisfied from Automation Precision Technology, LLC for this short term; award to any other source would jeopardize the Army’s capability to provide maintenance support and result in substantial duplication of cost to the Government that is not expected to be recovered through competition.
a. Background: See paragraph 5 above.
b. Alternatives:
i. Suspension of operations. Suspension of operations is not a viable option. These services are critical to providing maintenance for the equipment used for deployment training at Camp Atterbury. The lack of services would negatively affect Soldiers’ ability to train, deployment readiness, quality of life and potentially lead to mission failure.
ii. Use of in-house resources. Use of in-house resources is not a viable option. In house resources necessary to fulfill the required tasks do not exist.
iii. Award a sole source bridge contract to a contractor other than Automation Precision Technology, LLC. Awarding a sole source bridge contract to a contractor other than Automation Precision Technology, LLC is not a viable option. Automation Precision Technology, LLC has specialized knowledge and extensive experience in providing the required services, attributes that would be lost if a separate contractor was brought in for the short term. Automation Precision Technology, LLC possesses the resources necessary to continue providing the same quality of service without disruption of military operations and mission critical training to units at Camp Atterbury, IN. Attempting to bring in a new contractor on a requirement of this size and complexity, for the short term, raises performance risk to an unacceptable level. There is no assurance that a new contractor would be able to perform without critical delays and/or disruption of military operations. Awarding a bridge contract to Automation Precision Technology, LLC will provide the minimum performance period necessary to preclude a break in service or degradation in the quality of service between the expiration of the current contract and the award of the ILSS-II enterprise contract.
iv. Conduct a competitive acquisition. Conducting a competitive acquisition is not a viable option. There is insufficient time to complete the competitive procurement process. The required services are mission essential/critical and a break in service already exists - the services are needed as soon as possible. If a contractor other than Automation Precision Technology, LLC was awarded this action a 30 day transition (phase-in/phase-out) period would be necessary. The contract lead time required for a competitive action of this size and complexity is approximately 252 days. Furthermore, Automation Precision Technology, LLC has specialized knowledge and extensive experience in providing the required services, attributes that would be lost if a separate contractor was brought in for the short term. There is no assurance a new contractor would be able to perform without critical delays and/or disruption of military operations.
c. Justification: Automation Precision Technology, LLC is the only contractor with sufficient and trained personnel currently available to meet the requirement and minimize the already existing lapse in service. A new contractor who is not familiar with Camp Atterbury’s optempo would require at least a 30 day learning curve, an unacceptable risk for the customer and the units supported by this contract. Continuation of services at the present level of effort must remain static through the procurement process of the follow-on contract. The services provided are critical to Camp Atterbury’s mobilization and de-mobilization mission. Services can only be satisfied from Automation Precision Technology, LLC for this short term; award to any other source would jeopardize the Army’s capability to provide maintenance support and result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Award to any contractor other than Automation Precision Technology, LLC would require a 30 day phase-in/phase-out transition period. The customer estimates that this transition period would cost approximately $151,340 over awarding to Automation Precision Technology, LLC directly. The transition cost involves work required to perform technical inspections during the transfer of equipment. The estimated cost was calculated as follows:
$28 Hourly Rate for a Shop Mechanic x 2.5 Hours (Average Time Necessary to Perform a Technical Inspection) = $70 Average Cost Per Technical Inspection
$70 x 2,162 (total equipment requiring a technical inspection) = $151,340
d. Prior Acquisitions: Task Order W911SE-07-C-9001 (now W911SE-10-C-9000) was awarded against CONUS Support Base Services (CSBS) master contract, W911SE-05-D-0001 to Automation Precision Technology, Inc. This Task Order was awarded on 29 June 2007 for a three-month base period and four twelve-month option periods. On 28 December 2010 FAR 52.217-8 clause "Option to Extend Services (Nov 1999)" was used to extend the period of performance from 29 December 2010 through 29 January 2011 for a Phase In period. Due to protest and the Government successively taking corrective action, a modification was used to extend the contract 7 months until a new solicitation could be accomplished. W911SA-11-P-0203 followed and was a standalone service contract that provided services for 1 September 2011 through 28 February 2012 and included a six month option period of 1 March 2012 through 31 August 2012. During this six-month option period it became clear that the enterprise solution, ILSS-II, would be delayed as a result of protest. Therefore the six-month extension of services clause under contract W911SA-11-P-0203 was exercised – extending the period of performance from 1 September 2012 through 28 February 2013. There is currently a break in service.
e. Impact: These services provide maintenance of standard/non-standard equipment in support of contingency operations such as the International Security Operation (ISO) and Operation Enduring Freedom (OEF). Rotational units utilize the equipment serviced under this contract for theater specific deployment training. Currently there are more than 3000 soldiers at Camp Atterbury that are dependent on the maintenance provided by this contract. This contract provides two kinds of maintenance to the equipment utilized at Camp Atterbury for deployment training: 1) Repairs above and beyond the unit’s capabilities and 2) Routine Maintenance (Semi-Annuals, Annuals, and Bi-Annuals). The intent of this contract is to keep equipment maintained and within code so that it can be issued to units for their deployment training. Right now there is enough equipment within code that the current break in service has had no negative impact on the units currently training for deployment at Camp Atterbury. However, if equipment currently within code breaks down or if this bridge contract is not awarded soon, so that routine maintenance can be performed to keep equipment within code, the equipment available for issuance to training units will decline to the point of mission failure. If equipment is not available for issuance to units training then those units will be delayed from deploying which will cause delays in unit rotations within theater. Furthermore, the Army Reserve Units at Camp Atterbury have already been activated so any delay in deployment will result in substantial waste of resources (full-time pay/benefits for reserve units that are unable to complete their mission).
6. EFFORTS TO OBTAIN COMPETITION: A notice of the Government’s intent to issue this bridge contract to Automation Precision Technology for a two-month base period and six one-month option periods (total period of performance of eight months, if all options are exercised) was synopsized in FedBizOpps on 3/20/2013. The notice was amended to update the period of performance on 28 March 2013. The amendment indicated that the Government’s intent is to issue a six-month base period and 2 three-month options; no comments have been received to date.
7. ACTIONS TO INCREASE COMPETITION: ASC is in the process of a competitively awarding a follow-on contract to support the PDTE mission at Camp Atterbury (Refer to Solicitation Number W52P1J-12-R-0004 ILSS-II).
8. MARKET RESEARCH: See paragraph 6, above.
9. INTERESTED SOURCES: In accordance with FAR 5.201, a notice of the Government’s intent to issue this bridge contract to Automation Precision Technology, LLC for 6 to 12 months was synopsized in FedBizOpps on 20 March 2013 (and amended on 28 March 2013); to date no other sources have written to express an interest in this bridge contract.
