About this file

This solicitation requests quotes for the delivery of real-time PCR machines and compatible tests to the Ministry of Health and Social Welfare of the Republic of Srpska in Bosnia & Herzegovina. Vendors must address five technical subfactors demonstrating compliance with requirements, including providing new equipment that meets the contract line item descriptions and shipping capabilities. Evaluation will be based on technical acceptability and lowest price. Amendments to the solicitation modified the technical evaluation subfactors and language in certain FAR provisions. Quotes are due within 30 days of receipt of the solicitation, and purchase orders will be awarded on a lowest price technically acceptable basis to vendors who demonstrate the ability to meet the requirements.

SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government may award multiple Purchase Orders with fixed unit priced CLINs resulting from this solicitation to the responsible Quoters whose quote(s) conforming to the solicitation will be most advantageous to the Government, price and technical factors considered.

(b) Evaluation. Awards will be made using the Lowest Price Technically Acceptable (LPTA) evaluation process.

Awards will be made to the responsible quoters on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for technical factors. The Government intends to make awards without conducting discussions. After the initial evaluation of quotations is completed, if one or more quotations are rated Acceptable Technical, the initial evaluation will become the final evaluation of quotations and award will be made without discussions to the lowest priced quote. If any one (1) technical subfactor is rated Unacceptable after the initial evaluation, the technical factor will be rated Unacceptable and the quote will no longer be considered for award. If all quotations submitted result in an unacceptable technical evaluation, then clarifications may be necessary. In that event, the Government evaluation team will evaluate the quoter's response to the Government exchanges with each quoter.

FACTOR 1 - Technical: The Technical Factor has five (5) subfactors. Quoters shall explain how they will comply with the requirements in the RFQ by submitting narratives that demonstrate their capability to provide non personal services, facilities, personnel, transportation, materials, equipment, and supplies required to provide the requsted items, as follows:

Subfactor 1: The delivered equipment shall be new and not a used or remanufactured product.

Subfactor 2: The delivered equipment shall meet the Contract Line Item Number (CLIN) description.

Subfactor 3: The delivered equipment/supplies shall meet all items listed in Addendum to FAR 52.212-4.

Subfactor 4: The Quoter shall demonstrate capability to ship door-to-door to the following address:

ASG BALKANS - FOC SARAJEVO

CAMP BUTMIR

POC: MLADEN MARJANOVIC

PHONE: +387 61 147 791

BUTMIRSKA CESTA BB

71210 ILIDZA, BOSNIA

Subfactor 5: Quoter shall submit a Statement of Compliance indicating that offered items are in compliance with the Medicinal Products and Medical Devices Act of Bosnia and Herzegovina ("Official Gazette of BiH", No. 58/08), and shall provide the Certificate of Registration proving that the quoter is registered in the Register of Wholesalers of medical devices issued by the Agency for Medicines and Medical Devices of BiH for trade of medical devices.

EVALUATION STANDARDS. The quoter’s technical quote will be evaluated using the following standards for a final rating:

W9114F21Q0060

ACCEPTABLE: A quote that meets the Government’s technical requirements identified in the Request for Quote.

UNACCEPTABLE: A quote that fails to meet the Government’s technical requirements identified in the Request for Quote.

Factor 2 - Price: The Government will issue a Purchase Order to the vendor who submits a quote that has lowest evaluated price, which is technically acceptable. All Contract Line Item Numbers (CLINS) must be priced by the quoter. If the quoter failed to price all CLINs, the quote will not be considered for issuance of a Purchase Order.

Paragraph (b) is hereby replaced with the following:

(b) Options are not included in this acquisition and therefore this paragraph does not apply to this acquisition.

Paragraph (c) is hereby replaced with the following:

(c) A quote is not an offer and, consequently, cannot be accepted by the Government to form a binding contract.

Therefore, issuance by the Government of an order in response to a supplier’s quote does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.

Paragraph (d) is hereby added:

(d) The word "quoter" shall be substituted for the word "offeror" wherever it appears in FAR 52.212-3, Alternate I and DFARS 252.212-7000.
